It isn’t just that. It is also her inexperience in the courtroom. Emily Baker thinks she may handle cases that don’t go to court or only goes to court for motions but she doesn’t handle testimony. It looked as if she hadn’t spent much time even observing in a court trial. She didn’t know how to form questions. Her inexperience had her dropping lines of questioning because she couldn’t think of how to rephrase. And she hadn’t prepared her witnesses on how to answer properly formed questions so rephrasing might not have helped. She rambled during closing and in a few minutes destroyed all the ground her opening lawyer had made. He had me questioning what I thought while he was on. Then she got up and ruined it.

I am PRETTY FUCKING SURE she was briefed NOT to change her story, probably also to not say more than she needs to, but she went out there and did it anyway because she knows everything better than the experts. And then these experts, her lawyers, have to do damage control. Seriously, if it wasn't so obvious AH performance is just an act, If she would just not break character the time the opposing side is talking, if she would just keep her sad puppy demenour up instead of switching between hurt and crying to annoyed, arrogant and above the world, and if she would just stick to her story instead of elaborating on it every minute she has the opportunity to... she could be doing so much better in this trial DESPITE obviously lying. Obviously Amber would have came to them telling them everything would be true upfront and upfront there would be no reason for them not to believe her. My biggest issues with Elaine are that she taunted a witness while he was crying (common sense of human decency; she could've been kinder by saying something like, "I'm sorry to have upset you, I know you believe your friend. Let's move on to the next question," gearing him back to the realization that it's a court room and not a therapy session while also respecting him as a witness and human being), argued with the judge a few times (disrespect), and lacked professionalism (it's okay to make mistakes, but you should still be doing better in your profession than to say things like, "Amica Cream," "The Umbrella Man," and bringing up a makeup brand that Amber couldn't have possibly used at the time. For some of these things, all she had to do was look at the notes in front of her!) A lawyer should know what they're going to talk about and fact check things before saying them. It's unprofessional. These things are not a part of her job. On the contrary, they're showing her frustration with the case she is pleading and the jury will see that. "She's just doing her job." If she were doing her job, then she'd rely on tactics to make Amber look believable for people who are completely ignorant about everything that happened during the toxic relationship. She also would follow the rules that a lawyer is supposed to follow, such as respecting the judge and witnesses. She did seem to believe Amber in the beginning of the trial, but I no longer think she does. This makes her task much more difficult and so, I can understand her frustration. The only two reasons I could pity her are she doesn't deserve the bullying online (and yes, it's bullying) and it's gotta be so rough representing someone like Amber. I feel bad for her stress and emotions, as she is a human being, but her attitude throughout this trial makes it difficult for me to like her. I don't like Rottenborn either, but that's more just for personal reasons and not as rational to why I dislike Elaine. As to Amber's other lawyer, even though people made fun of him objecting to himself, I actually like him. He really was just trying to do his job and made a few mistakes, but not like Elaine. I hope all her lawyers learn some new tactics for future trials and recover from this.

No one wants Elaine to suffer. This whole trial has probably taken years off her life. But lawyers CHOOSE the cases they take. Amber's team could have researched her assertions before agreeing to represent her.

Here’s why she deserves respect (read all)
    1. this is (edit: one of the) highest televised/profile case ANY lawyer could have gotten
    2. whoever represents AH will be attacked regardless
    3. her client is controlling, manipulative, deceitful, and uncooperative
    4. her client is (allegedly) disrespectful and abusive to her
    5. lawyers have to defend their case to the end, even if they know they’re on the wrong side
    6. (we knew) she was on the wrong side from the start
    7. AH constantly threw her and her team under the bus
    8. Elaine kept a straight face and emotional control as much as she could throughout the trial
also, objectively speaking, the big 3 factors that determine the team
    1. client-attorney trust; JD just let’s his team do what they need. no notes
    2. organization, be it opening, evidence, witness, timeline, closing. they always give a roadmap
    3. Time management. nuff said
