Id like to see more case law protecting the first ammendment with copyright law. My problem was posting a karaoke video of donhenleys where we dont make a penny and then getting a copyright strike where you tube may be profiting. Even off of our own creations. But we arent. I ve akways heard that posting art was free from copyright infringement as long as there was no profit. You can mow your lawn and sing a song even if people pass by. Its not clear where that line is.
Thanks for commenting. One problem is that content creators are afraid of litigation, and so they don’t fight, and that means there is little case law specifically about TH-cam and especially TH-cam and music.
Anither thing thats always bothered me with copyright law. You had the bee gees how deep is your love. And this is where i see your point about vague laws being unfair unjust to creators. The bee gees were in their domain writing a song. And another artist wrote one in his domain where neither artist had access to the other and by coincidence there was some overlap. How much overlap is allowed. Sunday morning coming down i wont mention it again ray price early morning rain all have overlap. A real notorious one lady antebellum i need you now and alan parsons eye in the sky has a real conspicuous similarity. The bee gees got ripped at the lower court because of vague laws my opinion like you said.
2:57 Dang! There goes most people fair use defense!

Interesting! I hope Rick sees this.
Thank you!

Thanks for commenting. If there is real, true independent creation then it’s not copyright infringement.
