One thing i would like to mention here although it was a slip of tongue at 7:47 that administering of oath is barred in the recording of a confessional statement. If oath is administered it loses its character of a confessional statement.

Confession is not substantive piece of evidence.Provison of section 164(1)(2)(3)(4) nither use the word"evidence"nor makes any provision that the oath shall be administered to the accused before confession is recorded.Hence accused can not be punished for retracted confession.
But Section 164(5) says that the statement shall be recorded in a manner provided for recording evidence and the magistrate shall have power to administer oath to the person whose statement is recorded.Hence,if a witness retracts from a statement given under oath under Section 164 cr.p.c,he can be punished under sec.193 I.P.C.

Now I can easily understand sec 164 crpc.thanku so much.
Sir I have a question if there is a case of 4/25 arms act , 323 ,341 and 201 ipc and where complainant statement is recorded u/s 164 crpc.and now complainant doesn't want further proceedings and want to compromise,as accused is his cousin brother .so can he change his statement.pls reply if there is any other way to compromise.
