As a “married” foreigner and spouse to aFilipina I absolutely jointly own the land with here! If she dies before me and say we had no children. Then the laws says I have ONE year to sell or sign the land over into the name of a Philippine nationals name! But as we do have a child together my son of course gets all the land after I die. But I own it with my son until I’m dead. That the law! A concerning divorce. The Philippines will NEVER legalize divorce! Why? Because the Philippines Constitution highly protects the Family! That’s WHY divorce is illegal! So the Constitution would have to be changed to allow divorce. Which will Never happen because that is extremely hard to do!

I have a friend of 20 years who is Filipino owns a lot of land and insists he can give me land being a foreigner. I explained my research as he has been living stateside for those 20 years and he’s not really up on the law there obviously. So my question is since my friend is “giving” me the land does the government force you to prove or take out a lease on the land to build a home? Ownership of the land between us isn’t that important really as he has key to my house and vice versa here in the states, he’s not a random stranger in other words. It seems like my situation is kind of unique in the internet Philippines sphere as most people are talking about wives, girlfriends and joint ownership. Not so much brothers from other mothers.
That's an excellent question. You don't have to take out a lease on land that the owner essentially wants you to own and occupy, the gov't hardly has the budget to cement roads, let alone enforce such a clause of requiring a lease, there is a lot of freedom here man, do what you want but when building but 2 story I would permit it. If you are worried about it, you could always draft up a contract stating the lease is over x number of years at 0 dollars rent or any other particulars. The land obviously cant be transferred to your name solo unfortunately if you are not filipino blood, but what you can do is draft up a contract so you can pull a permit to build outlining the details, what that contract outlines I am not sure that is up to your specific situation. One challenge you will have and you want to permit a build, is the land is in the Filipinos name, and may be a challenge to explain if you dont have some sort of agreement in place is my only thought. My wife and i are thinking of buying a small lot in Botolan for weekend trips near her folks and we do not intend to pull a permit, we will only build a small weekend home. Honestly man you can do whatever the heck you want in the province, the problem is when it comes to dispute time, or time to sell, that's the challenge, especially if there are heirs involved, without a contract you are not protected under a verbal agreement. Get it in writing, if not, keep your build at a small cost, dont permit it, and just hire some laborers on a single story build IMO not legal advice

In my opinion that area near Clark Airport will be a massive global hotspot and hub in the very near future and will explode in growth. Leasing is definitely a solid option but I am not familiar with it so i didn not discuss it on this video (it was just a down and dirty video), I thought its 50 year lease with a 25 year extension? I also read there was a bill attempting to extend it to 99 years. Absolutely, there could be a lot of malicious activity but if the spouse seeks a loan they require a spouses signature, they see them referenced on the physical title, that would leave even a pawn loan up for litigation.
