It's somewhat different in practice. For example, if you claim that your wife is in a relationship with another man and fail to prove it, be ready for the ire of the court. Also, be ready for some cruel words from the judge even before he hears your side.

If husband and wife are living seperately since 7 years as husband is unable to bear the cost of basic necessities of himself and wife (Both living abroad) as he is bearing cost of living of his brother and their family living in India, can the wife file for seperation or divorce as due to bearing the financial responsibilities of the husband's brothers family, husband has to stay abroad and work, also stay seperate from the wife who is in India. Both own a house on joint name in one city in India but husband not willing to stay there but wants to live closer to his brothers family in another state in India.
Can wife claim the house (which is on their joint name) and maintenance as she isn't well educated and can't bear her own expenses?

Sir, in a scenario, where a wife has left job after delivery because the child born is handicapped and can be cured a little with regular exercise....after 7 years of living together with husband and his family, leaves house alongwith the handicapped child, after a dispute with husband and starts living with her parents....should any maintenance be given in such a case....she has not filed any legal complaint till now but deserted her husband from 6+ months
