- An Okanagan regional district is threatening fines and legal action against a couple living in a tiny home they built on their rural property near Peachland - one of at least two cases where people living in non-traditional homes are being pressured to leave. As Brady Strachan reports, the residents say they have no place to go.

Just imagine if the government allowed tiny homes to be built on people's property without a million miles of red tape. Did they put up a 5 storey eyesore in a neighborhood of 2 storey homes? No. Would it make sense for them to be homeless when they own their property? No. Are they conducting a business that will create industrial waste? No. Do all builders comply with building codes? No. There is a whole subdivision in a town near me falling apart because of the builder's not following code. I think a 3 or 4 bedroom house not following code is a bigger problem than a tiny house, not to mention a bigger footprint when it has to be torn down.

Ironically it's my dream to own a tiny bit of land far from the city; if I could have that I wouldn't care what I lived in. In BC a tent would suit me fine; I grew up in Saskatchewan so as far as I'm concerned we don't even have winter here.😂

@@thecanadiancaribou Grey water is NOT black water! Most off-grid tiny homes use composting toilets. Outhouses are tried and true as well. Grey water is from kitchen sinks, showers and handwashing. Usually, it flows into gardens to irrigate and recycle itself. It is not filth - it is a valuable resource in semi-arid landscapes like the Okanagan.

looks like they are living a model life. low enviromental impact compared to people in a mcmansion. safer than any manufactured trailer and a huge amount of old houses that are not up to code. sounds like the city would prefer to see more people live on the street. keys issue is that they are on their own property in a province with a housing shortage. maybe you shouldn't be able to sell it to someone else but anyone should be able to build their own shelter on their property without government harassing them. the housing affordability is criminal and the people involved in trying to shut this down should be thrown out of positions to govern and care for their fellow humans.
This is unbelievable. The BC government allow addicts to live in tents on our city streets but they won’t let people live as they choose on their own property. This is brutal. These people should be left alone. Period.

They didn't build it to code. All could have been avoided by doing the correct paperwork. If they can stay it sets a precedent for somebody slapping together a large home. It's not about the size, it's about following the rules we all abide by

Sickening. The guy couldn't give a specific reason why this is not safe for the couple to live in a tiny home on their own land. All there's said is bureaucratic rhetoric. As said in other comments, it's legal for homeless living in tens to occupy public parks, but it's not safe for the couple to live in a tiny home on their own land.
His basic response of, "it's not safe for habitation, and not built to BC building code" is such a cop out. They've been living there for 5 years. I'm sure they can get it inspected and or certified.
The fact that bylaw came to them on their rural property smells like someone gave bylaw a tip..

Here’s one….did the billions in damage cause by last years fires in the Okanagan motivate the need to enforce permitting regulations? I’m glad my house doesn’t get destroyed by carefree people like this.

Most permits are practically garbage...
Permits ensure you follow code, which helps prevent all kinds a horrible stuff.
You didn't pay for a permit, so that means everyone across the country is in immediate life threatening danger.
Powers that be and who make money off of taxes don't want this. It's not at all about safety or environmental protection, it's about money. I'm in Cambodia living quite nicely on a 1,500/month pension. I retired early, beaten to near death and homelessness by the Canadian machine. In fact I tried living in a small trailer towed by my car and no one wants that either.
So, here I am..36 degrees today and I'll put the a/c on soon for 6 hours, walk to the market and buy fantastic fresh foods/fruits and have a nice stir fry...for 1/4 of what I would pay in Canada. I'm living nicely here and saving 3-400 dollars each month while living off my pension. Shame, Canada, Shame!

If it's your land, put it on a flatbed trailer and you're on a mobile home. You can still live in it, and build a deck around it.
It's already on a trailer, the issue with the district is they require you to build a home that requires endless permits(taxes) all for the end result of charging you more yearly taxes for having a permanent structure.
I imagine the deck is the permit issue since the home is on wheels and the sewage/grey water can be solved in a jiffy with an incinerating toilet.
It’s there land. If house been there for more 10+ years. Kinda wrong for BC ago after them now. They the proper owner should be calling a lawyer.

Seems the various levels of government would rather slam more, more, more housing on top of, beside, underneath existing buildings! Use/Lose half your garden space to allowable second dwellings but do this to a place people have called home for 5 years. These poor bylaws people would completely shut down if they ever looked at what people built & raised families in the past. Leave us alone, let us live and stop being hell-bent on jamming everyone into cookie cutter homes. Guess what else is illegal to live in.....the 5th wheel I called home for 3 years.

That's not what's happening really. You're close but i suspect you might be giving too much weight to the fear mongering around low income housing.
In reality almost every Canadian municipality that isnt a large city has ample space for development of whatever neighbourhoods they want. Big cities on the other hand are full of largely inefficient subdivisions that would produce more money if they contained a mix of land uses. (i.e. you don't have to drive an hour to hit walmart when there's a small store down the street... walmart pays a pittance of tax compared to that same space used for a strip mall and without the huge parking that stripmall could even be a community hub like we used to see in most small downtowns.)

I just saw a video where a Toronto cop was telling residents to keep their car keys outside for car thieves so that they don't harm you. why did they build it without permits? silly idea if it is stationary. or, it should be built on a trailer, so it doesn't fall under building codes. The solution here is not for the district to tell them to remove the home, but to work with them to modify it to bring it up to code where required for safety etc. tons of people do renovations, additions etc without permits and arent told to tear it down after.
It looked to me like it was a trailer home. The deck would have required a permit. The zoning of the property would be a issue. Living full time on a property involves a occupancy permit, and the land would need be zoned to allow occupancy. There is to much red tape when it comes to solving lack of housing.

Modifying it would require a foundation and that it be built at least a stick frame attached to a permanently anchored foundation with municipal sewage and drainage as well as a permanent connection to hydro.

Perhaps removing the deck would help but the home itself is on a trailer and should not require a foundation; it's mobile. There's no reason they shouldn't be allowed to use solar power.

Same thing happened to my sister and her husband. They got a letter saying they need to remove their tiny home off of their own land which is a huge piece of land in a rural area. Or else they will fine them 1000$ a day until they do. They changed the law last year in April so nobody can live in a mobile home on their own land
People need to realize governments don't care about us. They just care about our money. They don't want us to live freely or care about our quality of life. Canada sucks!

The government doesn’t enjoy dealing with this issue. I imagine a neighbour in a $ million home is forcing the issue because they’re concerned this tiny home will affect local property values. Also this couple knew they needed permits to build long before they even started with the tiny home. You might own your land but you’re far from free to do whatever you want with it.
Not certain of this situation exactly but you may have noticed tiny homes in canada all kinda look the same despite the fact that in other nations theyre very creative structures. Its because theyre all converted trailers.
In various municipalities i lived it was legal to park a trailer on land with an allowance for externally powered and plumbed structures. Decks less than two feet in height or 1 fott that are unattached to buildings are also something i can build where i live without a permit. Also a shed of less than 12x15 ft..... but that could be smaller i checked years ago.
Anyways part of the benefit of tiny homes was supposed to be the less rigorous paperwork.

I think the rules are a bit rediculous and the deadline is horrendous...but how did they not check the bylaws before going forward? Ive thought about a tiny house for years, but haven't done it because I looked up the bylaws, and in many areas tiny houses aren't to code.

@@ThomasH7Well, in the written article, it's stated that the couple bought the tiny home in the USA, trailered it up to their 12 acre property, only the GREY water goes back to the land (not BLACK water), he can hook it up and take it away if there is wildfire risk, and he only added the outside deck and live-edge countertop after the fact...
While building code is important in some ways, it can also be incredibly asinine too depending on the situation. Ryan should fight this, use some gofundme to get a lawyer happening, and work with some people in the area to find a place to park the home in the meantime. I am almost certain the regional district is doing this for ulterior motives. And if they are, the courts will have an absolute field day with them. Might have one anyways, because considering the situation with our housing crisis, I am pretty certain that basically anyone with a brain is going to chew them out.
The regional district should have instead just made it clear they want to see some changes instead. But that's probably not their actual intent. What is it then?
Land taxes. They probably aren't collecting as much tax revenue as they hoped, and are trying to 'fix' the problem from their point of view. Which, should be illegal.

A true tiny home is on wheels so that it is not considered a building it is more of an RV.
Residential Building Safety Codes have ZERO to do with a mobile tiny home.
Beyond size restrictions I see no reason not to permit an RV.
Well grey water is kind of an issue.
Honestly, a lot of the home on the gulf islands were built without permits.
It's on a trailer with wheels and an incinerating toilet would solve sewage issues. Grey water can be used to water the garden. The local government just can't stand that they can't charge these folks more for their taxes.

Of course there are permits required. Is it a permanent structure...meaning it is larger than a prescribed width, length and height, and has no wheels? Or is it a mobile home...which needs to be under a certain width, length and height, plus have the appropriate waste disposal hook-ups, or a septic system that passes code? They also need to be sure that the property is zoned for either of those structures. Building inspectors would need to be hired for a whole variety of systems upon installation, just to ensure that everything is up to spec. You can't just build a house inside municipality limits, and ignore all the regulations that apply to housing.
So it's okay for people to live on the streets but it's not okay for someone to live in lovely little home on their own land?? What is our world coming to.
Bylaws, Municipal Zoning, and BC Building Code should be updated to include tiny homes, especially in our current market environment. Get it together people it's overdue.

I make over 40k a year and I'm about to end up homeless if my landlord sells his property. There's no rentals near me.
I have been looking into Co-op housing, need 37K year to qualify for a studio apt of 325 square feet. I don't qualify for that either. 😭
If they find house insurance, to protect their equity, they should be left alone.

Here in Vancouver some homeowners who were letting friends with a tiny home rent their backyard to live in it were reported by neighbours who didn't like it; the city forced the tiny home owners to leave. It didn't sound like the tiny home residents were noisy or dirty or otherwise bothering the neighbours. They just knew it was against "code" and that's enough for these busybodies.

I just read an internal RCMP report warning that lack of home ownership could lead to a destabilizing uprising in Canada. People with nothing to lose could rise up and start smashing things. I feel the wealth gap is going to fuel hard resentments here soon.
The system is broken. Even people who are building a permanent home are fined for living on their land until the house is complete. The system claims to be protecting these people from themselves, yet the system is the only thing harming them. There should be allowance if the concerns are addressed. There could be additional temporary equirements to control for any fears neighbors have. In the end it should boil down to what is fair for everyone.
Municipalities all over the country have taken an irrational stance on Tiny Homes, I suspect because they are loath to see reduced tax revenues compared to the current trend of building developer-approved, oversized, overcomplicated castles.
Things like this are the small hoops they make people jump through to keep house prices high.

They don't want us to be self sufficient and work for ourselves, they want us to be a welfare state that needs gov assistance.

This comment is about two different districts but…..They speak about building code and permits. What about the new houses in Ontario that were torn down because of structural issues? They had all the permits and inspections done!

I agree with the couple, they are being unreasonable. Perhaps they should look a bit closer at the structures being built in towns and cities whereby the workmanship and quality of product used are of poor quality. Odds are it is better built than most other new homes. Try a little forward thinking, given the housing crisis faced by so many. Shame on you.
Local government regulations blocking access to housing on people's own land.
I am a regional director in an electoral area that has not adopted these regulations that are a barrier to housing.
Provincial ministries look after water and septic concerns here, without having to burden the local taxpayers.
Tents in the city are being looked after with all the supports imaginable by my tax dollars, & they won't let this couple live on their own land thats obviously being taken care of responsibly?

I live in a tiny home, I do not feel unsafe. This couple should be left alone to live in peace.

This could be handled differently with diplomacy and tact. Have the home inspected and the allot time for repairs. Sounds like the main issue is lost revenue from permit sales.

I can see both sides. If the wiring isn't done correctly, it can set a forest fire and that is why we have the building codes also the constant draining of human waste in an area that isn't made for disposal. BUT why not work with them to help them fix the issues? They shouldn't have to leave their own land.
The government can't have people build anything, everywhere, because we would be overrun with the aforementioned problems. We solved these issues 150 years ago.
Obviously there needs to be an exemption for certain types of structures given the current social and economic conditions.

In my opinion I think building code safety standards should be irrelevant, for the couple, and at couple's own discretion. I think land use designation should have been mentioned to someone before building. The intent perhaps was never declared, and what this means is what someone wants to do with a piece of land.

This is an affordable option that these people worked for and earned. How dare the government try to rip it away from them. Perhaps they should just issue the permits for them to make that building legal instead of being a bunch of sticks in the mud to try to help the rich land developers, get richer.
They have been there for 5 years already. Leave them alone. Lovely home, lovely couple.
