You can take travel ban exception letter and also contact your employer for NIE request letter ..if in case you get that it’s better . Am saying this because the checklist has employer NIE letter as one of the documents.

yes , she requires nie . most of the visitor visa nie gets rejected . please explain why you cant travel to india to bring your child back and why your child needs to be in USA as soon as possible ,with supporting documents , while you request NIE for your mother .. This might help your case get NIE approval

Hello Suja, thank you for this video. Are you aware of a situation where bi/b2 visa holders who are parents of a non minor American citizen are able to travel on family separation grounds ? Or any other grounds ?
They are providing very limited approval for b1/b2 visa holders for a very genuine reasons like pregnancy care or usc kid minor care if both the parents are working and unable opt for daycare/ nanny .. you have to produce supporting documents for the reason you mention.

Hi Madam, Thank you for sharing the valuable information and clarifying our doubts. I am waiting for the dropbox appointment to get my visa renewal stamping and plan to travel to India once I get the slots. I have the following doubts. 1) As you mentioned, I can not get NIE approval before visa stamping so do I need to apply while attending dropbox appointments or after getting the visa approval? 2) is it the same for dependent H4 visas? if I plan to visit India on September 1st, how should I plan to get all these and return to the USA after a month or 40 days? 1) yes , you need to submit NIE letter during your Dropbox
2) yes , same for dependents
Time line depends upon your Dropbox appointment, currently processing time takes from 1 week to 3 week .. so plan accordingly

So my query is that whether I need to take the NIE request letter along with a supporting document from the employer during the interview ?? You can refer the list of NIE category in the description.. please go through it and find your category and submit for NIE with employer letter ..

It’s going to be almost 6months .. things can change anytime.. I can’t assure you that . It’s better to get one while your going to attend the interview

For dependents you can use your own NIE letter , as of I heard only work visa people need NIE letter from employer..

Hi Suja .... Thanks for posting the video.. I am in H1b and planning to apply NIE along with my dependants in H4.. Do i need to apply separate NIE for them too and if so do we need to provide justification for the same. ? unlikely this wont come under family separation since i am in India

I think you and everyone else is missing another criteria which requires NIE:
Currently working in India, and relocating to US on H-1B via internal transfer, by applying extension to a previous Visa..
How to justify the need to travel to the US in this case?
Again in this case you need to get employer NIE letter.. in which employer will explain why you are eligible for NIE and why your presence in USA is need ( work related) at this point

It’s better if you get it from employer, since lots of 221g are issued even for family separation.. employer should mention primary applicants job duties, why his presence is needed in usa at this time and NIE category

Thanks for the valuable information. I have got a question regarding rules for attending drop box visa (h1b)stamping in HYDERABAD. My nephew is having an appointment on 18 th August. Can he come on 10 th and attend the appointment on 18 th August or is it necessary that he should be here in India 14 days before the appointment date. He is fully vaccinated ( already one month over). Can you please clarify.
He can come anytime to attend the interview, please refer to state guidelines for quarantine rules

In that case they will provide 221 g with rejection explanation.. both visa and NIE will be rejected

Ask them to mention your NIE category also in the letter .. most of NIE for H1b are getting approved .. hope for the best
Hello mam, I have a Dropbox appointment on this 9th and I have 8 month (us kid ) who needs to be vaccinated next month, but due to family emergency I came with my kid last month and difference between interview date and my india arrival date is exactly one month, will there be any issue on it as you said you should be there more than 4 weeks away from spouse(in USA).
It shouldn’t be a issue since your exempted from travel ban and you only need travel ban exception letter

They need NIE approval, you can state the same reason and explain why parents can not travel back to India to pick up the kid and attach the kids passport and birth certificate

Go with NIE format and in justification write your job duties and details why your presence is needed in USA at this point of time .. ask your employer to provide details of the same

I have valid stamped h1b and NIE approval by email. I am still in India.
My wife went for h4 visa but was issues 221g and asked to email h1b visa copy and NIE approval by email. Surprisingly, They collected her passport at the consulate. We submitted it immediately same day but we still got reply that it is refused till presidential proclamation is in effect. I am confused as to why it was refused as we submitted the docs and passport were collected by them.
Initially they asked for nie approval. When we submitted, they are giving reason of PP. If that was the case, they should not have asked for nie approval.
Pls advice.
for some cases they are doing it now a days , they are going to lift the travel ban in nov. but exact dates are not yet announced , please wait until then and re apply again .

you can call the customer service number and confirm with them ... they will mostly ask you to email the nie request else the officer will approve after looking in to you case

You have to produce negative rtpcr rest report but NIE is not needed

If it’s less than 4 weeks don’t mention the duration, it’s better that way

1. For B1B2 visa holders , do I need to mention my Job Title , Company Name , etc. in my email? I am applying because my dad just had a critical surgery in USA and needs me as Primary Care Giver. I have all the supporting documents from the hospital .
2. Do I also need to mention my NIE category? If so, what category do I come under?
3. Also, do we need to type the NIE format in a word document or PDF or directly write on email?
4. Once I get approval , how long can I stay in USA…Can I stay for 6 months , now that the NIE validity has been increased to 12 months

Hi, Do we need to have a valid visa stamping in passport to apply for NIE ? I had a Dropbox appointment at Hyd in April and i got my passport back with 221g related to travel ban. Any idea how to apply for NIE in this case ?
If your 22g is regarding visa refused then you need a visa slot again and then you have to drop your documents with NIE request letter as I said in the video
Hey I'm also in same position I also got 221g due to presidential proclamations so have you again booked your slot for visa interview with nie request letter . What is your upcoming process for this 221g

I had H1 interview at Hyderabad a week back and I also shared NIE letter with interviewer and at end she mentioned following
“At this point we do not need anything from you and I’m placing your passport in NIE queue”
What this mean and when can I expect stamped passport?
Please advise. People from other consulates are already receiving passport and I do not have any update yet
It should take 1-2 weeks , hopefully You get your passport with NIE stamped in it

You have get NIE request letter from employer explaining your NIE category and why your physical presence is need in USA for work related stuff

Hi, Thank you for your information. I am the H1 main applicant staying in the US.. In my case, my family in India. My wife and 1st daughter have a valid H4 VISA, My newly born 2nd daughter doesn't have a valid H4 VISA. In this case, how to proceed with NIE. First shall I apply for NIE for my 2nd daughter VISA interview. Then Before travel I will apply for a NIE for my spouse and 1st daughter. Please give me some advice.
First apply NIE for wife and 1st daughter, once approved.. take the approval copy and NIE request for 2 nd daughter while visa interview. So when her visa is stamped she will receive NIE annotated in the visa page itself .

NIE approval have 30 days timeline.. you need to travel with in 30 days or the approval have dates mentioned in it

He also send email to consulate attaching the NIE from Employer in mid June but Consulate refused to give Expedite Visa appointment. While going for your Dropbox appointment you need to take NIE request letter from employer

You can take your NIE letter during Dropbox appointment, while approving your visa they will annotate it with NIE exception

I got NEI stamp on my visa but there is only issue date of NIE and expiry date of NIE but I applied for 2 years
NIE is valid for 12 months multiple entry
But there is no visa issue date and expiry date only NIE dates

Hello mam. As per your guidance I requested my NIE approval for family separation in Chennai consulate on 7th July. I received an automatic reply within few mins. On 16th July I received one more email from consulate saying thank you for enquiry and same content as in automatic email. Getting confuse what is the next step I should take now.
