Voicemail contradicts Phoenix PD in reporter's detainment

- When video of Wall Street Journal reporter Dion Rabouin’s detainment went viral this month, the Phoenix Police Department said the matter was under internal investigation and has been open since it happened. But a voicemail left for Rabouin in December seems to contradict the city’s claims.

Phoenix PD needs to state exactly what the "probable cause" was. Bad policing is why Phoenix crime is out of control, & the Police Chief needs to be replaced.
The police chief was just replaced. After arresting protesters and charging them with being in the ACAB gang, the DOJ started investigating. The previous chief resigned and Phoenix hired one a few months ago that has experience with departments under DOJ review.
You don't say anything. You just keep quiet until it all blows over.
Probable Cause or PC is commonly referred to only summarily in police reports. It is almost never succinctly and clearly stated as per constitutional requirements.

But they did not lie. He literally says that the investigation of employee misconduct was closed, not the investigation of him. Are people just hearing what they wanna hear? He clearly says they found no employee misconduct against the bank, so that investigation was closed, and says nothing about investigating him. They were simply informing him that the bank did nothing wrong.

There's a horrible video from years back that shows an Arizona officer shooting and killing an innocent man on his knees outside his apartment while he pleads not to be killed. 12 jurors found the murderer not guilty. What an amazing place to live.

Also how would you feel after complying with all commands, showing proper identification as press, and then still being handcuffed and put in the back of a car like you’re going to jail, all while you ask the officer the reason for arrest and he is silent. Another layer of we investigated ourselves and found no wrongdoing in violating someone's rights again and again.
It's a good thing we don't stop at just reporting the incident to the departments, we also push for civil lawsuits against the city and officers involved. Qualified immunity is revoked when your civil rights (in this case the reporter's 4th and 1st amendment rights) are violated.

The police union? Hmm almost as if they are one of the biggest problems with police. A public office with it's own union? How effective would our military be with a union? Or county supervisors, mayors....etc. No real accountability or change as long as the unions keep funding they're own agendas.

This makes an interesting point. If Police had the same authority as, say, DOT or workers, then maybe a Union is good for everyone involved. But Police are part of the Criminal Justice System -- a system which is obviously flawed and some say broken. Maybe this incident will motivate enough people (and the right people) to see about some improvements in how we Americans handle this issue. Then again, who am I kidding!? Nothing will change. Not sure how Chase Bank got off so easy on this issue. Starbucks went into full on meltdown mode after a manager called cops on some black men in a store. It led to sensitivity training, public outcry, CEO statements and apologies, and stock decline. Chase has dodged a bullet so far.
Banks are the most common place at which this kind of thing happens, and there’s usually no repercussions for the caller or any employees. It just kinda flies under the radar after a while because they do make lots of actual arrests at banks.
Because there are issues of people attacking people at ATMs. He obviously wasn't and I'm hoping the staff were just following protocols. It would be one thing if they were calling because he entered the building and sat down when that is place you can do so, but loitering around and asking clients questions is suspicious and without ID or even with it there is no guarantee a person really is who they say they are.
They never asked the reporter to leave, the police cant just walk up and arrest someone for tresspassing if he hasn't first been asked to leave!
The cop likely asked the employees if they wanted him trespassed. Soliciting a trespass has been deemed unconstitutional. Store or bank employees, will normally do what an officer suggests, because they tend to trust them. When a cop goes into a store, where a young person is working, they know they can trick them in to trespassing someone the police doesn't want filming them shake down a citizen in the parking lot!
Starbucks called the police on a black man inside the store. Citibank called the police on a black man on the sidewalk that they never asked to leave. Police respond inappropriately. Starbucks, Citibank and the police are guilty; all parties need diversity training.

It's so laughable when a citizen records and the police say "we are recording too". The public now knows that the police recording means nothing because they will drag their feet, lose the footage or who knows what else but do everything they can to not release it. We only know what we know here because a brave citizen decided to record. (And was threatened with arrest) The police have not released the body cam footage. Imagine what their bullshit narrative would have been if there was no public recording. It's already bullshit, but...would have been soooo much worse.
They are not actually required to release footage if it's unfavorable to police.

If the police are only required to release the footage that "makes them look good", that's not transparent at all. An act of true transparency would be releasing the footage in any situation, good, bad, or ugly.

At one time, I believed law enforcement could do no wrong. I grew up with law enforcement and I have family that are LE. Problem was, I based my entire experience on the ones I know, outside an occasional traffic ticket.
In this day and age, it's hard to find a difference between police and gangs. They both believe they are above the law and both defend thier own action without reproach. Police now days a fascists

The state of Arizona has a serious problem with out of control cops across the state, not just in Phoenix. Mesa PD is probably the worst.

What was the probable cause? Where can I find out more about this story?
Notice how the police Union representative made no mention of the officer threatening to arrest the woman that was filming. AND.... no mention of the female officer that told the woman the law was 8' and she was breaking the law. Perhaps the union representative would like to put out another statement, this one explaining why the female officer:
1. Doesn't know the law (or)
2. Knows the law but used her police power (under the color of law) to misquote or misinform a citizen to try to get them to stop filming.
By not addressing the above, the police union is telling residents (and visitors) of Phoenix that they are ok with that behavior too.

The Wall Street Journal in particular is a bootlicker for the GOP, which almost always has the back of the police (except when Republicans are storming the Capitol, or course).
If this is just one layer, Phoenix PD should be happy to provide examples of cases where complaining witnesses were told an investigation was closed, only for an additional layer to change the results.
Like the incident in Dallas where Police roughed up a guy who was inquiring about his son's arrest. The police report showed he was aggressive and uncontrollable yet across the street Ring Door Cam showed different and all of a sudden the police report was an error they cleaned it up.
@@slimpickens01 I followed a case where guy was accused of assaulting a police officer and resisting arrest, he was facing serious time. When he bonded out of jail he knocked on doors and found a house that had a security camera, the footage showed that the police officer literally walked up to the man and sucker punched him. The officer said he made an "error" in his report, due to the "stress" of the event. The stress, LOL...the stress of what, him assaulting a citizen unprovoked? I do not believe the officer even lost his job.
They sure stepped in it this time.

Have you ever took time to read the 16th amendment of the constitution regarding taxes? It specifically says “The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several States, and without regard to any census or enumeration.” So they could literally raise taxes to anything they want and literally the states, president Supreme Court and citizens have no power to vote on it nor strike it down. Obviously the people more than likely would vote them out of office in the next election but even if the next Congress changed it back day one of their terms it wouldn’t immediately change it back until the next election cycle. I think it is time for a few auditors to test the sidewalk in front of Chase bank and see how safe it is for people with a little lighter skin color. Those cops in Phoenix need a few lessons...
in case anyone else is seeing this without the background of the original story: this reporter was standing on the sidewalk (public property) asking people to comment. bank employees came out to talk to him then went back inside without asking him to leave (which they cannot do anyway since he was on public property and not obstructing passage). the police officer then showed up and cuffed the reporter despite his right to remain on public property and also his right to speech, and also he wasn't even asked to leave even if it had been private property. that's 3 violations right there yet "no wrongdoing".
i find it telling there's no reasoning given with this "no wrongdoing". no 'because', no addressing any of the points raised in the complaint.

This is kind of confusing if one department of the police says theres no wrong doing. Is there another department that opens another investigation? What probably happened was the police department thought this was not a big deal and called it closed. Then when the press started asking questions all of a sudden things are being handled professionally now.
No, it was the same authorities overseeing the investigation who gave conflicting results. They lied and told the victim, and the witness the case was closed, hoping that they would believe it and go away. When major news outlets inquired about it they discovered that the case was, in fact, never closed. The cops lied to the victim and witness because they thought they were naive enough to believe the lie.

Normally if they get a complaint of misconduct for a officer they let the police department investigate themselves because that was their decision.
So I think this comes down to whether a cop can, or should, take the complaint at face value. Just because someone stated he was asked to leave doesn't mean it happened. Is there a legal requirement for the trespass warning to be made in front of the officer or is the word of the compaintant enough, legally??

The Business/Property Owner must identify the person being trespassed.

Voicemail says no wrongful actions by an employee, but says nothing of arresting officer as though that statement does include the officer as the "employee"(doublespeak).....
If reporter was asked to move off private property he should have moved but if this happened on public property it is an entirely different story and it seems like he is on private property.
Was he asked or given written notice of his trespass? Before officers can trespass you have to get a "written notice" & can THEN be arrested for "refusing to leave" the property..
Watching a lot of "audit" video's leads me to think along this path which I believe to be accurate, even in Canada.. "Thin Blue Line" secret fraternity likely made the "anonymous" calls...

How in the sam hill did the cop have probable cause, there's a series of steps involved in trespassing, he would have to be told to leave first, then if he didn't they could move forward issuing him a formal trespass notice, and if he came back then arrest, am I wrong? It's a sad state in Phoenix when the citizens have to police the police, This is a case of Black Man near a bank....
Probable Cause is a clearly defined legal standard that very rarely gets actually articulated in a police report.

A police department should never be allowed to investigate itself. There should be a board with PD officials, city officials, and citizens that review every complaint against an officer or the PD.

You don't have to imagine. There are reports from decades ago where innocents were imprisoned decades ago. Also keeping eyes open about cases that are dismissed or not pressed. You see it around a lot. And it is horrid. And yes, there is stuff beyond that. But the sad fact is that you don't even have to imagine, just open your eyes and look.
