    I am a Canadian owner/operator commercial truck driver. With E2 Visa, can I convert my Canadian Commercial Driver's License (CDL) into US CDL and keep driving trucks, given the promise that I'll expand in the future and hire American truckers?

    I am Pakistani, my b2 visa was revoked at Washington Airport and i was sent back to my residence country UAE, can i get E2. My b2 revoked visa will not be hurdle and reason to deny my E2 application?

      Yousaf - a revoked visa can serve as a negative factor in adjudicating a future E2 Visa. I'd recommend you speak with an experienced attorney about the specifics to go over your case.

    At 15.02 you said that we don't need to physically present in USA to start the E 2 process.
    My question is how could I open up the bank account without physically presenting in usa ?

      In terms of the business bank account, an authorized representative of the business can open up a bank account for the business at most banks. However, you would need to be present in the US in order to open up a personal bank account. As we noted, the vast majority of clients are present in the US for at least a brief period prior to filing for the E-2 Visa. However, it is possible, though difficult, to do the process from abroad if you have a business partner or authorized representative of the business within the US.

    I have started my business in Usa with my partner who is Usa citizen. Sir i had open a personal account to bring my money from my home country but I utilize my funds through my personal account as well. My partner helped me in every transaction because he was familiar with everything here. But you said utilization of funds has to be spend through Business bank account.
    So what should i do now ?

      No. It is preferable to utilize the company bank account to make the investment of capital as that is clearer for the Officer to evaluate. However, although it is preferable it is not required. Many of my clients utilize funds invested through their personal account to purchase assets for the business. In fact, some capital invested does not go through a bank account at all and could be inventory or equipment brought into the business. I'd recommend that you speak with an experienced E-2 Visa attorney to analyze the best way to proceed with your application.

      Kryz -- you cannot change your status within the US on the ESTA (Visa Waiver). However, you can prepare and file for the E-2 Visa at the consulate through which you will process while you are here in the US. Many of my clients enter the US on their Visa Waiver in order to set up their business prior to obtaining the E-2 Visa as there is much to be done here in the US prior to the interview.

    hi, a have a question: my dad has green card but I don't, because i was born in Mexico. So, it is possible that my dad open a business and then later transfer the business to me or I "buy" it to petition for my E-2 visa?

      Jose - it is theoretically possible but it may prove difficult. The consular officer would likely consider the sale of a business from your father to fail to qualify as a true "arms length" purchase based on the familial relationship. Keep in mind that your father could, certainly, gift you capital that you could utilize to invest in a business and that may well serve as a viable E-2, but a purchase of a business from your father would likely meet with pushback from the Consulate.
