EAG is being Sued and I Testified in Court

- When EAG collapsed, the investor took the intellectual property and spun up a new company called Macchina Motorwerx. And they are suing EAG and Art Bartosik. They reached out to me and asked I would be willing to testify in court. Of course, I said yes and got to tell my story and put it into public record. So, here's what I said in court, and what is going on as far as I know.

I've been ripped off by a friend that I considered a brother and had to sue him. I know all to well about red flags and hindsight, Difficult in the moment. Glad it eventually worked out for you.
ugh. i'm in the same boat and never sued the guy. worse part about it he's a part of something that makes me see him from time to time so it's a sore reminder. frustrating.

Dan I had two buddies who had cars there for a long time with nothing happening, no updates, etc. Luckily, they went in person from halfway across the country and got them completed and returned!

Yeah it's a very complicated and lengthy story with all kinds of details that are hard to remember. So even this isn't really the entire thing. But it's pretty good.
Another comment...years ago when I had a E-gear 430...i reached out to Art through my CNC shop's IG messenger about a kit...he replied right away and clearly he looked at the company's profile as he asked me if I was interested in making parts for him. Anyways...we had a brief conversation about it but I didn't follow through with anything as my thinking was I'm in Canada and there has to be lots of local to him shops that could make these parts...why is he asking me?? I'm probably never going to get paid. Glad I didn't get involved.
They made a 430 with a Lamborghini E gear? That’s crazy! Did they also make a Porsche inspired triptronic 430?
He means the F1 system. It's actually the same thing as the e-gear basically.
And there you have it from a actual CNC job shop, they can smell a "no pay" from a mile away - as most any decent sized shop has been burned at least once.
@@tedsaylor6016 Correct. Texas among other things has a massive oil drilling and off shore market needing a massive amount of machining services. So machining services obviously exist locally. Canada's prices after taking into account shipping/duties etc. are not going to be cheaper compared to local shops. As they say...if it doesn't pass the "logic" or "smell" test...stay away.
I've been watching your channel since 2018 and remember all those EAG videos, Chris' interview, Art on one of the Thursday night NGS 'Lives', Hoovie's 599 conversion in 25 hrs. A very compelling business story indeed. Thanks for sharing the additional details from your testimony.

Some of our business experiences are similar. There were times in my career that I made decisions based on high expectations... not reality.
If I had stepped back and taken an adult look at things, I would have run.
For the most part, I lost time and energy, not money. I told myself that I learned a lesson then a few years later, I did it again!! That time I got it out of my system.
Avoid all "partnerships". They almost always turn out bad. Yours turned out bad immediately.

The best part of this history was your efforts to ensure your investors got paid back. My late father started a roofing business with his brother. After some time my father found out his brother was stealing from the company. My father immediately shut down the company taking a significant loss. My father had been a fighter pilot in the military with a 20-year career. Officers in the Air Force are not given a 2nd chance if they are dishonest. Lies get people killed. So I learned that you cannot do business with someone who tells lies. There is no 2nd chances. I believe you learned a very hard lesson.

Speaking as an attorney, although not in Texas, standard practice for potential witnesses, excluding parties obviously, to not be allowed in the courtroom to hear others testify

Not an attorney, but been involved in a few trials and that was standard practice with the witnesses.
Not permitting you and other witnesses to be present in the courtroom while other witnesses testify is known as invoking The Rule.

You and I had a phone conversation about this in 2021 I believe. You were professional, polite and lead me between the lines to draw my own conclusions which have played out pretty much as I expected. My dealings with Art were less than professional on most levels. When something was wrong it was my fault (as the installer) He wouldn't accept responsibility to remedy the situation. I had to figure it out on my own. Good thing I'm in the industry and have good connections. I'd be more than willing to share my experiences to anyone involved in a lawsuit

What options are available now for conversion kits for 430, Scuds, and 599s? And who does the installs? (Reputably)
We do 430s and 360s. The others we can arrange.
Made a business deal with a coworker and he guaranteed I would be made whole if things went bad. Years later things tanked I pointed out that he said he would make it right and he pointed out how much he had lost compared to me.

When I think of super car owners and auto dealerships, this is what comes to mind. Someone getting taken advantage of and the last person holding the cards looses. No surprises here but makes fun stories and content I guess. Cheers!

I am still debating about my own 599 conversion. It appears that the market takes into account the cost of parts and the conversion, but there is no additional value to the vehicle.
The secondary market for converted 599s is to thin to really know what's going on

wow what a mess now looking back on it. it always boggles my mind when people make the decision to completely renovate or pour tons of money into a LEASED or rented property. taking out a wall or two ok not a huge investment but to pour thousands and thousands of dollars into someone elses property makes zero sense to me.
Yeah I never understood that. If you have that much money to throw at a renovation, why not buy a property and get the equity?!
I'm an engineer and product designer for a fortune 500 engineering firm, just looked at these kits lololol, I could design these for efficient manufacturing and produce them at any scale for soooo cheap.

Some of the best advice I’ve ever been given is don’t do partnerships and of course I didn’t listen and had to learn the hard way, what a mistake that was, never again! I’d drop and run from this Art scammer!
Having the right partner can be very beneficial... But clearly it wasn't in this case.

I am wondering if Daily Driven Exotics got some of the stolen kits for their 599's. of course they would have no way of knowing if they were stolen or not because they were dealing with Art directly under the assumption of EAG at the time being a legitimate business.

Dan, you've handled this matter correctly from day one, and continue to. If you were feeling nasty and vindictive, you could sue Art for breach of contract. He would likely not even bother filing a Statement of Defense, in which case you'd get default judgement. If he did file a S.o.D., just withdraw the suit as it's pointless. If you do get a default judgement, register it against the CNC machine, as EAG is probably the legal owner. Then tell Macchina Motorwerx you have a judgement against the CNC machine and are going to court, to force the sale of it. They will settle, just to get rid of you. Obviously, if you care about your relationship with Macchina Motorwerx you would not want to do this, as you'd be shooting yourself in the foot. It's fun to speculate though.

@@normalguysupercar - Naturally, you want to spend as little $ as possible, so your Statement of Claim should be short and sweet. Don't let your lawyer turn it into an exercise in billing. Bring him into your strategy too, so he knows the suit will be dropped if Art tries to defend. That will minimize the cost. Finally, if you decide to do this, let me know and I'll delete these postings, so you aren't giving away your strategy.

I remember learning about Normal Guy and the conversion kits through Hoovie's 599 conversion. Later we saw DDE go through a similar video. With TH-cam exposure a market was created. Just with the wrong guy. Art for president?

Yes. I contacted multiple lawyers. They all came to the same conclusion, I would probably end up throwing good money after bad.
It's unfortunate that you had to put in all that work, and go through all that drama only to see the operation implode. Our character is something we own, that can't be taken away. Yet, some people simply thow it away as soon as they see an opportunity to take advantage. Instad of doing the work to build something substantial (e.g. a business), they take advantage of others and try to slither away. A classic case of smoke and mirrors! Good Luck!

If you have the money to buy a Ferrari, then you should get all work done thru an authorized Ferrari shop! These mechanics have gone thru hundreds of hours of training to work on these cars! Ferrari dealerships won't convert cars, which is why an external conversion market exists at all.

Looking at this, I'd say he is. Have you even tried communicating with him? I have when I was interested in a 430 conversion - then I asked about the whole debacle when this came out. The level of arrogance regarding this is mind bending. We all tend to give people a chance and we love good business opportunities, and that's what Dan did based on what he initially saw. But it also seems like it started to go downhill fast.
Go and ask Art about this. He is the perpetual victim, he does not care about anyone. It's all mememememe. He does not act as someone who gives a chit about what has transpired. Someone who does, will be apologetic and humble. What I've seen, Art is neither.
