I have a question sir, to what extent has article 26 of the constitution of Uganda been a guarantee to people's right to ownership of land
To a larger extent.
But sir Literally it looks like the citizens don't own land as per that article
Land in Uganda belongs to the citizens of Uganda and shall be vested in them in accordance with the land tenure systems provided for in the Constitution under Article 237. In line with Article 26 of the 1995 constituon, and with the help of decided cases, discuss the extent to which this constitutional provision has been a guarantee for the citizens in enjoying their land rights.
Sir I came across this question, how do I approach it
@@eiluloreenbelinda60 no that's not true, the article requires among others that before land belonging to any person is used by govt, they have to be compensated, prior to take over.

thank you so much but Customary law is not primary law its secondary law
Your welcome. Customary law is not a secondary source. It's a primary source of law. Please address yourself to section 15 of the judicature Act cap 15. Also see section 10 of the magistates courts Act cap 16 that mandates courts to enforce customary law. Just like other sources of law, customary law is only void where it contradicts the constitution under Article 2(2) of the 1995 Constitution of Uganda.
