    Can hindu family members make partnership firm?

      Hindu family members can make a partnership firm, but not as a Hindu Undivided Family (HUF). A partnership firm is a result of an agreement between two or more persons, and it can arise only from a contract and not from status. A HUF is a joint family consisting of lineally descended members from a common ancestor, and it is governed by the Hindu law and the law of succession. A HUF does not have a separate legal identity from its members, and it cannot enter into a contract with anyone.
      Therefore, a HUF cannot become a partner of a firm, because a firm is an association of individuals, and not of families or groups. However, individual members of a HUF can form a partnership firm with each other or with outsiders, provided they have the consent of the Karta (the head of the family) and they do not use the HUF property or funds for the firm3. The partnership firm formed by the individual members of a HUF will have a separate legal identity from the HUF, and it will be governed by the Indian Partnership Act, 1932.

    Do the illegitimate childrens of undivided family can ask maintanance?

      Yes, illegitimate children of an undivided Hindu family have a right to claim maintenance under the Hindu Adoption and Maintenance Act, 1956. Section 20 of the Act provides that a legitimate or illegitimate child may claim maintenance from his or her father or mother who is capable of providing the same, in case he or she is unable to maintain himself or herself.
      In the case of illegitimate children, maintenance can be claimed only from the father and not the mother. This is because the father is considered the natural guardian of the child in Hindu law. The right to claim maintenance is a legal right and cannot be denied to the child on the basis of illegitimacy.

    My father has 3 brothers and 3 Sisters and I am living in my Grandparent' property by birth. The eldest brother of my father cheated on my Grandmother and signed a Will from her when she was alive. After that my uncle divided that property among all these brothers.
    Do I have Coparcenary rights in this property now? Which is the Case Law for reference?
