I recently had a HLR review and while he didnt see my record prior to the call he did tell me we would try to get them serviced connected first. If he couldnt he would do his best to find a DTA. And if he couldnt he would deny the claim. 2 days later i got a DTA. He did give me an opportunity to explain why i reasoning for my claim is connected to my current disability. I have read the decision letter and i have favorable finding with having diagnosis for both claims. Stating "We failed to get an examination(s) and/or medical opinion(s). We will develop for medical clarification." Hoping for the best. Thanks for your videos!

Back in 1987 I was denied as not being a veteran and that there was no record of my back injury. I did not appeal until 2018 because I believed the experts. They found my service treatment records that proved injury. With a Nexus and hearing I was granted service connection this year but not back to 1987. I believe I have a DTA but need to talk with someone to learn more.
Why didn't you appeal it back then, the appeal period has expired but you will have to review all the information in your folder to see if there is an CUE, I have a video on CUE's on my channel. I filed for tinnitus, and after I requested a higher level review, a duty to assist error was found. It took almost a YEAR for that error to finally be corrected and for them to find in my favor. 😢

I filed my initial supplemental claim for increase of benefits Dec 04, 2023. I received the DTA Error on 4/10/2024. Never had an informal conference. On October 24, 2024. I received a call from Optum to set an appt for C&P exam. I did a C&P exam in February of 2024. So my appt for C&P exam #2 is Nov 7 2024. This is hardly expedited from April to October.
Supplemental claim is when you have been denied. If you are service connected that would not be a supplemental claim, you would have to put that on a 526EZ. A DTA would fall HLR. Been denied for 20 years and they never considered evidence from doctor, “ recurrent back pain” exam favorable with rationale and nexus for in service for back pain and added radiculopathy both legs. This info was included in HLR… trying to get them to go back and pay to original claim… is that possible ??
Had a stroke filed a claim got 100%. Now Va wants to put back 90% because they said I’m getting better. Had not since 6 September 2023. Got an appointment in two weeks to see Va doctor. Is there any thing I can take or say.

My claims have had multiple DTA's all from the Houston office. This last denial they severed my service connection but ignored the nexus letters and all new and existing evidence. They copied and pasted the previous denials also didn't even look at the nexus letters or new evidence. They processed the claim in less than 2 months. They are padding the resolution times.

Hey boss I was discharged in 2021 I just got service connected for PTSD while I was deployed in 2020 which got me to 100%, am I entitled to all that back pay from my service discharge date or no?! I just recently got diagnosed for PTSD as well:/ btw thanks for all the video’s you do for us it means more than you’ll ever know, thank you for your service sir❤️
The effective date will depend on the date you submitted the claim or if you had an ITF. Congrats on the 100 percent and thanks for the support to the channel.

I did not have an ITF but I do remember returning from that war pretty messed up waking up from nightmares constantly, nightly from what I went through:/ and then recalling specific events almost on an everyday basis it was pretty traumatic
I'm seeking help on a DTA. I filed for an increase on July 3, 2023, and was denied by a lousy nurse practitioner on October 23, 2023. So, I filled out a HLR. HLR found a duty to assist error due to NP on March 4, 2024, went to my C&P exam on April 16, 2024, and the DBQs were sent to the VA on April 18. I have nothing left to do. The VA has all the evidence they need, and they told me that when I contacted VERA. I'm still waiting for a decision. How can I get them to move my claim to the decision phase since they have had all my info since April 18? Thank you.
You can try the VA White House Hotline but once they send the complaint to the VBA, they may say claims are worked in order received. Ensure that evidence you have show you meet the criteria for the increase. If not, they may not grant the increase.

I received a HLR call last week about my depression, anxiety and insomnia that I filed a claim for earlier this year that had been denied. On June 14, 2024 I was diagnosed with Adjustment disorder with mixed anxiety and depressed moods. They still denied my claim. Just last week the Va notified me on my online account saying that they found an error and issued a DTA. It stated that I was treated for hyper insomnia and insomnia from October 2012-Jan 2013 while I was in the military. It also stated that I was treated for depression on December of 2012 while I was in. Also if stated that they diagnosed me with depression on February of 2019. I never knew they diagnosed me with depression back then they never told me until now. They also said “we failed to get an examination and or medical opinion” and that they denied my depression back then because there wasn’t a clinical diagnosis. I just got diagnosed with service related depression this year when I could have been diagnosed years ago. Shouldn’t I receive some sort of back pay once this HLR is done for the error they made years ago?? Somebody please let me know.
All the evidence from back then to now would have to be reviewed. If you let 365 days pass from the time the VA first notified you, your appeal period has expired but it could, could fall under a CUE. I have a video on a CUE on my channel.
If you filed a claim, the VA informed you of your options in the letter they sent you informing you of your options. One of them are lay statements and you DD214.

I had a HLR, and they found a DTE error. The letter stated, "We failed to get an examination(s) and/or medical opinion(s). We will develop for a VA opinion examination. Under favorable finding, it says, "The claimed primary disability is service-connected." Does this REALLY mean I have GERD service-connected and they need to review my symptoms to get rating?

Dta error was found 8/27/2024 and i still have not heard anything. Higher level review request was submitted 05/13/2024. The dta error was the that the va doctor they sent me to for a c&p stated that it was out of her scope of practice meaning she was not qualified. Then they sent my records to a ace exam and it was a family practice doctor that's not qualified either because it's a brachial plexus injury making it neurological in nature so doc should have been neurologist. Can I file a higher level review against that higher level review on those grounds if it comes back negative?
They don't send it as an ACE exam, the examiner made that determination to do an ACE exam. In the notification letter, the VA informs you what you can do if you disagree with an HLR. You have to read the notification letter that came with the rating decision. You can't do an HLR on an HLR, there is instructions on that. Also, the main question is, do you have evidence in your claims folder at the time of the HLR showing you meet criteria for the next higher percentage. Does duty to assist cover correcting claim. I initially claimed sleep apnea secondary to ptsd and it should have been sleep apnea secondary to sinusitis. My claim is still deferred. I asked them to change it and submitted a new claim.
That could fall under a CUE, that's why it's important to have a copy of your entire claims folder before submitting another claim or HLR. I ran into a DTA error after I filed a supplemental claim, which they raised to a DTA error they sent a letter to me and said they found favorable findings & they scheduled me an C&P exam but I’ve been waiting now for 5+ months. Everytime I call they say it’s in decision.

As of now DROs are so behind RVSRs are doing their jobs….Unfortunately Decision Review Officers aren’t thorough in explaining to the VSR what should take place so they the VSR order these exams without having the examiner specifically address the issues by the DRO. All this does is force RVSR to kick the claim back or reorder the exam which delays the claim… Also these C&P examiners are rushing as well and their rationale isn’t matching the evidence of record nor are the addressing the specific questions that the DRO has. So this problem is really deeper than the claim process itself
Most of the DTA errors are coming from RVSR's and DRO's are sending it back as supplemental claims. The production points are real and the training is not so good. Thanks for sharing.

The DRO had a difference of opinion from the doctors opinion. If they find a CUE, it could go back since your appeal period for that previous rating is expired, could.
The DRO had a difference of opinion where my claim was denied. He allowed new and relevant evidence from me submitting a snipet from my medical records with handwritten notes from the PA. That information wasn’t previously considered and my file never made reference to it. I had to get a new exam and it came back favorable. I also called the White House after watching your video and they opened a case since it’s been since March 2024. VA hasn’t expedited still sitting. You are the G.O.A.T.

It’s unfortunate that it takes so long to correct these errors. It seems like the VA needs a better way to evaluate these.
My DTA took 13 months from date of informal conference. 16 months total from filing HLR to decision on a presumptive claim.

What regulations states they will go back that far. Are you saying there is an CUE from back then.

I had a HLR, and they found a DTE error. The letter stated, "We failed to get an examination(s) and/or medical opinion(s). We will develop for a VA opinion examination. Under favorable finding, it says, "The claimed primary disability is service-connected." Does this REALLY mean I have GERD service-connected and they need to review my symptoms to get rating?

I haven't filed my claims right
Dta error was found 8/27/2024 and i still have not heard anything. Higher level review request was submitted 05/13/2024. The dta error was the that the va doctor they sent me to for a c&p stated that it was out of her scope of practice meaning she was not qualified. Then they sent my records to a ace exam and it was a family practice doctor that's not qualified either because it's a brachial plexus injury making it neurological in nature so doc should have been neurologist. Can I file a higher level review against that higher level review on those grounds if it comes back negative?
They don't send it as an ACE exam, the examiner made that determination to do an ACE exam. In the notification letter, the VA informs you what you can do if you disagree with an HLR. You have to read the notification letter that came with the rating decision. Had a hlr dta for gerd and was granted 10%. Can i do another hlr for an increase because I got lowballed.
You can't do an HLR on an HLR, there is instructions on that. Also, the main question is, do you have evidence in your claims folder at the time of the HLR showing you meet criteria for the next higher percentage. Does duty to assist cover correcting claim. I initially claimed sleep apnea secondary to ptsd and it should have been sleep apnea secondary to sinusitis. My claim is still deferred. I asked them to change it and submitted a new claim.
That could fall under a CUE, that's why it's important to have a copy of your entire claims folder before submitting another claim or HLR. I ran into a DTA error after I filed a supplemental claim, which they raised to a DTA error they sent a letter to me and said they found favorable findings & they scheduled me an C&P exam but I’ve been waiting now for 5+ months. Everytime I call they say it’s in decision.

As of now DROs are so behind RVSRs are doing their jobs….Unfortunately Decision Review Officers aren’t thorough in explaining to the VSR what should take place so they the VSR order these exams without having the examiner specifically address the issues by the DRO. All this does is force RVSR to kick the claim back or reorder the exam which delays the claim…
Also these C&P examiners are rushing as well and their rationale isn’t matching the evidence of record nor are the addressing the specific questions that the DRO has. So this problem is really deeper than the claim process itself
Most of the DTA errors are coming from RVSR's and DRO's are sending it back as supplemental claims. The production points are real and the training is not so good. Thanks for sharing.

Hello from Murfreesboro, I had a DTA difference of opinion for new and relevant evidence. Been denied for 20 years and they never considered evidence from doctor, “ recurrent back pain” exam favorable with rationale and nexus for in service for back pain and added radiculopathy both legs. This info was included in HLR… trying to get them to go back and pay to original claim… is that possible ??
The DRO had a difference of opinion from the doctors opinion. If they find a CUE, it could go back since your appeal period for that previous rating is expired, could.
The DRO had a difference of opinion where my claim was denied. He allowed new and relevant evidence from me submitting a snipet from my medical records with handwritten notes from the PA. That information wasn’t previously considered and my file never made reference to it. I had to get a new exam and it came back favorable. I also called the White House after watching your video and they opened a case since it’s been since March 2024. VA hasn’t expedited still sitting. You are the G.O.A.T.
