    It was a scam from the very beginning, hence the reason that they didn’t provide the purchasers with a copy of the warranty documents from “Cars”. They didn’t want them to reach out to that company, only to find out that they had no contract with them whatsoever.

      I own a used car lot and actually sell warranties with this exact company. Once the papers are filled out and the warranty is paid for C.A.R.S. sends the customer a packet of info on what is and isn't covered and a membership card with their name and the information on the car being covered. This is seriously wrong what the salesmen did in this case and I will bet you if they did it once they did it hundreds of times. This is the type of thing that can put a dealer out of business.

      Pretty much every extended or extra warranty you buy, majority of the price is profit for the dealer. It’s why they work so hard to sell you one

      I own a used car lot. I have sold a couple of warranties with this exact company. I have only been in business since the end of last year and only been a member with C.A.R.S. for about 6 months. But the warranty company seems to be pretty good so far. C.A.R.S. warranties are legit if they are paid for. And I offer them to my customers at my cost just as a benefit if they want one.

    What always gets me is the audacity. He KNOWS he’s a scammer and he still agreed to go on national TV. I’d either just settle or sue me privately so the world doesn’t know I’m a scammer afterwards smh

      I own a used car lot and actually use that exact company. I haven't been in business for all that long but I can tell you that the few customers I've sold the warranties to seem satisfied. I specifically asked them to come in and let me know if the company actually covers what they are contracted to or not and so far every one has had positive reports. I also only sell the warranties at my cost. It's just a service to the customer if they want one.

    This is so common that it is like the number one thing that used car dealers get sued for. They charge you for a warranty but never submit the warranty. If you come in with a problem they either fix it on their own dime or submit the warranty and then make a claim. This is why these third party warranty companies are forcing a 30 day waiting period before the warranty is in effect. If you buy a used car and a warranty you should get paperwork for that. Because she had no paperwork it seems likely this dealer was scamming people out of their money and never buying any warranties.

      Devil’s advocate- if the dealership wants to cover exactly what I bought and act as the warranty provider, I don’t really mind. If they want to pay out of pocket and gamble on it, go for it. Either way, I should be covered exactly as the warranty coverage outlines.

    I could see that coming from a mile away! I kind of wish the Judge pulled him back in after he gave that answer to Doug and told him she changed her mind and to pay them now because you didn't bring the proof here and I don't believe a word you say...
    For him to say she "deviated from the case" and he's not liable regardless... Like no dude, that has absolutely EVERYTHING to do with the case because if you never bought the warranty for them, then you just kept their money and you're just a dirty scamming thief.

    Me and my husband went through this same deal! Bought a truck at a uses care dealer, warranty was through a third party. Engine blew after four months from the purchase. Warranty was denied. We had no money to hire legal help. So we were sunk. It was our only vehicle at the time, so we had to buy a whole new engine. DONT EVER BUY A CAR WITH A THIRD PARTY WARRANTY.

      I purchased a 3rd-party warranty plan when I bought a used Mustang. They paid to have the transmission rebuilt or replaced. I can't remember which one, exactly. All I remember is that the warranty company did what they were paid to do. It probably helped that I purchased the car from a big Ford dealership, because they gave me employee pricing; as opposed to a ratchet, fly-by-night car lot.

      Some people either don't know how to or are scared to go through the process. I always recommend that people chat with legal aid because they will at least point you in the right direction and explain the process so it isn't as daunting. @@mexicanspec

    The defendant has probably done this more than a few times, and this one time got caught on International TV (Canada / USA) and this will warn people to be really careful before they ever buy a car from this shifty shady sheisty slithery scammy sales lot.
    I hope this judgment becomes public record so that any other affected customers can exercise their rights.

    I just HATE it when somebody, especially a litigant who thinks they're being very attorney-ish, says, "Your Honor, with all due respect ..." How much respect do they really think is due?

    2:23 the check engine light was on “before” you brought the car from that guy. Either he or his “mechanic” unplugged the negative battery cable for a few minutes and then reconnected it. That will clear the “pending” codes stored in the cars computer and usually turn the check engine light “off”. What happens then is that eventually the computer will reset itself and if the condition that triggered the check engine light come on still exists the check engine light will come back on… This is why when you are looking at buying a new car it’s worth it to spend some money having a competent working mechanic thoroughly inspect the car “before” you buy it….

    His argument at the end makes no sense. He does NOT have a legally binding contract that says he has no liability. That contract was never executed. He never sent the money for the warranty.

    I'd love to hear what happened after that week. And one thing I learned in my Civil Law course was that putting "We're not liable" in a contract does NOT free you from liability. If it did, everyone would put it in.

    The defendant knows about the pocketing of the warranty money too bc he lied and said he’s been in contact with the company and they said they deny the warranty because of the age of the car. If he really called they would have told them the same thing they told the judge, “we don’t know wtf you’re talking about”😂😂. Judge should have pointed that out🤔🤔

    There was a similar case like this once before. JM ripped the defendant a new one. Search the people's court extended warranty. The title is Un-Warranting a Warrant. It's worth a watch.

    When the defendant walked in that idea entered my head that he never submitted to warranty. It is a common scam. They never gave the the woman a cop of the warranty for her to check into it herself.

    As a former successful garage owner. I seen a lot of these scams. One pacifically was a dealership that advertised Christian Services, they charged the customers for Extra coverage cashed the checks and pocketed the money. I helped many customers get this resolved. I pointed out to customers a Christian doesn’t need to advertise their Christianity! 😅

    This happens all the time with used car dealers lol, people just don't know. The judge used the term "roulette" which is 100% what it is. Here is how it works:
    The used car dealer sometimes (not every sale obviously) charges a customer for warranty, but never actually purchases the warranty from the 3rd party warranty company (just like this case). They hope the term of the warranty runs out before anything goes wrong with the car, which is how they profit the warranty cost. If something DOES go wrong during the term, they usually just count it up as a lost scam, and pay the money out of the dealerships pocket to fix the problem, and just tell the customer it was covered under the warranty. This is still profitable to them because the amount of scam warranties they sell with no mechanical issues during the term of the warranty outnumber the ones where something actually goes wrong and they have to pay out of pocket to keep it hidden.
    What's crazy is usually the warranties they play roulette with are not 1 year unlimited miles lmao. Thats way too long, and something (even small) is bound to go wrong on a used car in that time frame. Usually the warranties they scam with are 3 month 3k mile warranties (the most popular ones from used car dealers). This idiot ruined his own scam by playing roulette with a LONG ASS warranty on an old ass car, and ALSO telling them the warranty was denied, instead of just shutting up and going fully into pocket and counting it up as a loss and just not telling the customer. He figured he didn't want to take the loss of 1,800 (2800 for new tranny minus 1000 he already made from the scam). He was banking on them just rolling over and taking it, and instead they went to court.
    This case just touched the tip of the iceberg of this scam, but its a very real thing. Also, this guy has absolutely done this tons of times before.

      I own a used car lot and sell this exact warranty. C.A.R.S. sends paperwork to the customer at their home along with a membership card that has the customer info and vehicle being covered's info. So I guess that consumers need to educate themselves when buying this type of stuff. Since it's 3rd party they need to expect some kind of contact from the company after the sale to validate everything. Otherwise you are right that the customer will pay for something they never got.

    The judge didn't realise she caught him in a lie when he said he had called the insurance company and they told him they were declining the claim, yet when the judge phoned them they said they had never seen that policy, so he lied to the judge, as it is impossible for the company to decline a claim when they didn't even have the policy. He should be in jail for fraud and theft...

    This EXACT same thing happened to me! The warranty cost was $150 but they never sent it in with the paperwork and I ended up a plaintiff in small claims for a transmission against the dealer that sold me my vehicle as well! I think it cost him around $3500 (it was years ago so can’t quite remember)

Her mind went where mine didn’t consider ….. why was he so overly involved in calling the warranty place. Usually the dealership would hand you the warranty department phone number and info and you’re on your own. Something smelled fishy and she figured it out … great job

    I’m shocked that the Judge didn’t nail him to the wall for outright lying to her that he was told by the warranty company that they denied the application, which he knew he was going to lie about before he even stepped in to court because he never submitted it in the first place!!! He didn’t expect the Judge to call the warranty company - I could see it in his eyes - and he knew he screwed up BIG TIME! Another crooked used car salesman tried to strike again and it served him right to have to pay the Plaintiffs.

    Don't buy warranties from Wal-Mart with your purchases. I did once and was given a repair shop to call. They refused to honor the warranty because they said "We don't fix those anymore". The item was six months old.

    He was a scamer from the start car has check engine light come on two days after she purchased the car, she takes it back and now the warranty she purchased two days before won't cover the repairs then he offers his shop for the same 1000 knowing the engine is way more than that. Who takes someone to dinner while there car gets fixed, BMW doesn't even do that. He should be closed down
