  • In this video, I shared the importance of an Authority to Sell, what it is, and a sample of an Authority to Sell that you may use.
    TIP for real estate agents: Always secure an Authority to Sell before selling a property.
    AUTHORITY TO SELL o LISTING AGREEMENT is a contract between a property owner or an authorized seller and a real estate broker or real estate salesperson working under a real estate broker. Such a contract authorizes the real estate broker to sell the property at a specified price and term in return for a commission or other compensation.
    There are two common types of Authority to Sell:
    1. Exclusive Authority to Sell
    2. Non-exclusive Authority to Sell

    Malaki ang Income sa private listing... Yes Tama na dapat my ATS para iwas sa lokohan at dapat naka notary lahat lalo na kung my sub agent.... At dapat clean title para hindi kana magka problema at ang buyer

      Recommended po talaga ang exclusive listing para hindi sayang ang effort po at required din naman po talaga ng may written ATS kasi pwedeng i-report ng kapwa broker pag wla nyan at ma-suspend ang license 😊

    I'm not sure kung na-miss ko: what if a buyer approaches the seller directly (the buyer is unaware of ATS)?

      Hi, just to clarify the buyer directly goes to the original owner po? If that’s the case then, no need for an ATS if registered owner po. If the seller is an attorney-in-fact, there is no need as well but he/she needs a Special Power of Attorney 😊

      Ideally meron po which is Authority to Lease. Kaso may mga ibang owners ayaw pumirma kasi hindi nila naiintindihan importance po noon 😊

      If the owner/ seller is based abroad, the Authority to Sell should be authenticated by the consul office (Philippine embassy in their country). This is an alternative to the notarization in the Philippines especially if they can’t physically go to the Philippines 😊

      ATS is confidential between seller and real estate broker po 😊 If under processing PRC niya for sure may official receipt naman siyang mapakita at iba pang proof na real estate broker siya. Kung accredited real estate salesperson ang kausap m po, hingin mo po name, license and birthday nung real estate broker niya para ma-validate. Dapat aware po yung broker niya sa activities niya po 😊

    thank you ma'am how about sa mag real estate broker na walang alam sa ibang transaction ng hhnty langf ng benta pede bang ireklamo din blurb. saga di ngbbigay ng commission on time kahit nabigay na ng developer, kailangan pang remind sa Tanya. wala din binibgy ng computation ng commission.

    I have a question po, anung actions pwede gawin pag may fraud transaction na nangyari. My mothers own a property rights from previius owner then her cousin sell it without any permission from my mom dahil pinatira lang sila at nagpatayo lang ng bahay. We have papers but on their side meron daw silang papers na naproduce but the sellers are not a licensed at kapitbahay pa namen. I hope masagot po ang tanong. Thank you po

      Hire a lawyer po so you can file a criminal case your mother’s cousin 😊 Iyan po ang best scenario na alam ko po
      Kunin niyo rin po yung papers nila, you can use that as evidence against them na nagprapractice sila ng real estate service ng hindi legal po 😊

      Yes po, kapag hindi pa accredited salesperson, yung licensed real estate broker lang po ang na sa ATS. Pag sinama kasi ang pangalan ng hindi legal real estate service practitioner, pwede kasi po iyon magamit na ebidensiya na hindi legal yung nagbebenta po 😊

    Good am po, may question po preho lng po ba contract to sell at authority to sell? Ok lng po ba ung kumuha na pre-selling lot private owner daw po, bale nkapangalan sa family, my spa ung isa member ng family na nkakipag negotiate ky seller/agent/sya dw po mgddevelop subdivided lot po.       Magkaiba po yung Contract to Sell at Authority to Sell. Ang Contract to Sell ay between seller and buyer habang ang Authority to Sell ay between seller and real estate broker. Base sa sinabi niyo po, dapat ma-convert muna ang agriculture to residential land bago magbentahan at i-develop into subdivision po.

      Extension ng Authority to Sell po sa inyo so pwedeng contract niyo iyon with the real estate broker. Kaso kahit may ganun, hindi ibig sabihin na gamiting panlaban iyon kapag hindi binigay ng seller yung commission po.

      Kung training po, for accredited real estate salesperson po iyon kasi kapag real estate broker need po mag-BS Real Estate Management course then pumasa sa Real Estate Broker Licensure Examination po.
      Kung training, meron po yung Cesar Academy at PREVAIL.

    Good day po..ask ko lang if yung buyer ang direkta na nakipag usap sa seller for the reason na hindi naman inaasikaso ng binigyan ng ATS, to make it short ay wala pong ginawa yung ahente yet since sila po yung may ats e all of a sudden kikita sila 5% without even doing anything for a very long period of time..pwede po ba namin i void yung ats especially kung hindi nk notarized?

      Hello po, pwede niyo pong kausapin yung ahente na babawasan niyo yung ibibigay dahil walang ginawa pero need pa rin bigyan kung ang reason kng bakit nalaman nung buyer tungkol sa binebenta niyo ay yung ahente. Pero ang lusot niyo po rito ay kung hindi legal yung ahente. Kapag ganoon, automatic void ang ATS kahit pa notarized po iyon

      Pwede po kapag payag po parehong agents and just draft a commission sharing agreement. Make sure everyone is a legal real estate service practitioner para may habol kapag may nagloko po 😊

      Kahit ano pong ibebenta, kapag hindi may-ari o SPA mismo ang magbebenta, yung taong babayaran nila ng commission para magbenta ng property ay dapat licensed real estate broker po 😊

Question: From the buyers’ end, Mayroon po bang documents or anything na maaaring irequest sa Real estate agents and brokers bilang validation na sila ay legit and affiliated sa realty company na magdedevelop ng property na bibilhin. Anu-ano po ang mga dapat tandaan para sa isang safe, secure and legit transactions prior sa pagbili po ng mga properties. Maraming salamat po.

      Hi po, some real estate developers provide I.D.s, some do not. So the next best things you can ask for from them are Philippine Regulation Commission accreditation kapag salesperson po or license kapag real estate broker + certification/registration nila sa Department of Human Settlement and Urban Development (DHSUD), requirement po iyan kapag property ng real estate developer ang binebenta. Naniniwala po ako na kapag hindi makapag-comply sa legal requirements yung agent, paano siya mapagkakatiwalaan ng kliyente kung sa simpleng bagay hindi makasunod. At palagi po dapat documented bawat perang ilalabas. Hoping nakatulong po ito 🙂

      Hindi po. Void ang contract kapag hindi licensed real estate broker ang agent. At kapag hindi legal ang gumamit, pwede pang magamit na ebidensiya dahil violation ng R.A. 9646. Pwede mag-bayad ng at least P 200,000 fine and/or makulong ng hindi bababa ng 4 years.

    Mam ask q lang po. mron po bang ATS na ksma dun ung pangalan ng agent. pangalan nung mga ksama ng agent na ordinary na tao lang na ktulong pra mpag deal ung magkabilang panig ng seller at buyer. tas ilalagay din daw sa ATS ung halaga na mtatanggap ng bawat envolve sa bentahan.
    hlimbawa sa seller anim na tao. ksma na ung mga legal at ordinaryong tao. at gnun din sa buyer.
    meron bang gnun na ATS pra hindi po daw mabaliwala ang isang ksamahan na tmulong pra magkaroon ugnayan ang seller at buyer.

      Wala po kasi void na gamitin ng mga hindi real estate service practitioner ang ATS. For example, hindi sila nabigyan ng parte ng commission tapos ginamit nila yun para magfile ng complaint, hindi legally binding kasi hindi po sila legal. Pwede pang gamiting ebidensiya laban sa kanila sa violation ng R.A. 9646 po. At sa transaction po, yung ibang nakisali, most likely hindi talaga magtatrabaho, nakikisali lang kasi kakilala nila yung seller o buyer at gusto makakuha ng kickback.
      Kung gagawa po ng kasulatan, yung agent at yung mga ibang nakikisali sa transaction lang andun. Pwedeng po sigurong isulat na finder’s fee or real estate referral fee kasi wala pa naman po akong na-encounter na batas na illegal iyon sa Philippines 😊 Hindi ko lang alam kung tatanggapin din po iyon sa court.

    anung gagawin mo if u already give time, money, effort, pressure tapos may hot buyer kana.. all of the sudden the owner says na hindi na itutuloy ang transaction kasi nagbago isip niya na e benta ang Property niya ?? is there any hassle fee na makukuha mo sa seller sa effort mo,. lalo na pag nag ads kana sa Property?

      It depends if you specified it in your contract po. At times, I specify it since I’m aware that the seller might change his mind po. Other times, I just let it go and just help my buyer look for another property 😊

      All parties in the agreement should have legal capacity so minimum age is 18 years old and there is no maximum age 😊
