    NEWS:
    The Department has provided the MIA the following information regarding Caveat 14 within the CSOL and how it is to be interpreted in its application to occupations to which this caveat applies under the Sc 482 Skills in Demand (SID) visa and the Sc 186 Employer Nomination Scheme (ENS) visa in the Direct Entry stream :
    Caveat 14 states: ‘The position is not provided for under an International Trade Obligation’ this was applied to note that the occupation is provided for on the CSOL due to a commitment under an ITOs.But it is not the intent to restrict Chefs to countries where Australia has an ITO in place which provides access for this occupation.
    The Department understands that when reading the caveat in conjunction with text in the Explanatory Statement it may be strictly interpreted that applications for Chefs are restricted to specific nationalities under ITOs.
    The Department will look to amend the instrument to clarify as a matter of priority, and in the interim will not prevent applications of Chefs being lodged or being granted on the basis of nationality.
    Caveat 14 will continue to apply to Other Sports Coach or Instructor (Wushu Martial Arts Coach or Yoga Instructor Only) as it is a Skill Level 4 occupation which would otherwise not be included on CSOL, and Private Tutors and Teachers nec and Traditional Chinese Medicine Practitioner whose inclusion on CSOL were not supported by labour market or stakeholder feedback to JSA.

    It is, indeed, a mess. They should have just shortened the processing time for visa 190, 491 and 191. The salary required for SID visa - over $72,000 - is just so stupid and arbitrary. P/s: Let's believe together that the 3-year residency requirement for visa 491 will be reduced to 2 years (to be aligned with 482 and SID visas). Faith is powerful! 🔥🔥🔥

    Do you know how this change to SID affects the pending 482 temporary skill shortage visa applications? My application has been pending since October.

      Who has applied for a 482TSS prior December 7th will still be processed and assessed under the previous legislation.We don't know at this stage If the 482TSS visa applicants currently awaiting their outcome, will experience delays. We can only wait and see what happens.

    I’m so lost. I was not fully aware of this , we planned to apply on January 2025, but then Restaurant Manager was excluded. Any other pathway , which has less requirements unlike 494?

    Hi, I have an offer in North Queensland for a Aquatic centre manager but I only have a 3.84 years approved skills assessment as a Swimming Coach could there be a work around this with the labour agreement stream? I can't get a skills assessment for sports centre manager as they ask 5 years without studies I only have 1.

    Thank you for making the video! Question: If your first 482 for instance is 134311 (School Principal) granted 2020 and your next 482 visa is 134499 (Education Managers NEC) granted 2024 with the same employer and you got overall 2 years experience, can you apply for 186 TRT? Same employer, same tasks just different title and the timing of 482 visa is not within three years.

      if you're currently holding a 482 being granted before the new SID visa took place, the changes do not impact you but you still need to meet the criteria to lodge and apply for a 186TRT

    You said either one should have a Bachelor's Degree without any experience or 3 years of experience without the Bachelor's Degree right?

      It doesn’t have to be a Bachelor’s degree; the qualification must match the level required by your ANZSCO code, which could be a certificate or diploma too. And no, the work experience is mandatory.
      **Option 1:** A qualification relevant to the field you’re being sponsored in, plus one year of full-time work experience earned within the last five years.
      **Option 3:** Three years of full-time work experience COULD substitute for a qualification that is not aligned with the position for which you are being sponsored (if applicable)

      Your visa will be processed with the previous 482TSS regulations, you will still be able to apply for 186TRT even if your occupation is not in the CSOL.

      Correct, however your new employer must be an approved sponsor (or become one) and pay all the necessary fees. Also, you should discuss with your new employer your chances to get a 186TRT through them as this means that once visa is approved, you could legally walk away therefore be sure they are aware of all scenarios.
