    Anytime I've seen a Beware of Dog sign I automatically think it's a not so friendly dog behind the gate or on their property. And I take heed!

      I know of an instance where a police officer reached his hand in the fence and got bit. He said there was a "Beware Of Dog" sign and he should not have reached inside the fence.

      I can see that, but it could also be so the dog doesn’t accidentally get out as you open the gate. Or a deterrent to potential thieves that a dog may be roaming outside or is inside the home and might want to rethink their target.

    She clearly was not in control of her dog. Her dog was pulling her all over. Common sense does demand that she should have not allowed her dog to get right at the fence.

    I believe that when her dog charged at the gate to bark at the gm Shepard, the dog’s paw went under the gate and the Shepard seized that opportunity and grabbed the dog’s paw.

    But how did his dog get a hold of hers? A paw is not like a hand. His dog couldn't grab her dogs paw. In order for her dogs paw to get grabbed, her dog must have put her paw under the gate and his dog chomped down on it! Meaning her dog put it's paw on his property.

    I walk dogs as part of my income. This incident was completely the Plaintiff's fault. She never should've let her dog anywhere near that fence. She's undoubtedly the one that yanked her dog's shoulder out of it's socket when the shepherd grabbed hold of it's paw.

    from what I just saw in that short recording ...common sense tells me her dog went under the fence as opposed to his dog being able to stick its whole mouth under the fence then grab her dog and injure it.

    This case is interesting. Initially, I was on the plaintiff's side, but then I considered how I’d handle the situation with my reactive dog. I would keep a tighter hold on the leash and possibly even walk around if I heard another dog barking as I approached, making sure not to let my dog get anywhere near the gate. My actions would primarily be to help my own dog stay calm. However, I can understand that if your dog isn’t typically reactive, you might not be as cautious, which could lead to more relaxed handling-resulting in a situation like this.

      @@ChasRiaStJohn --'dragged" is to be used for those who went pass grade 5. If you opted out of school and didn't go past grade 5, then you can use 'drug'. So she may have a point.

      @@nom5205 drug is what's called 'common usage' in place of the word dragged. To he completely 'grammatically' correct, as in a court document, thesis is college, dragged would be more acceptable.       Disagree with that assumption. The dogs were walking in front of her, so the GS grabbed the plaintiff’s dog’s paw before she walked past. Then she realized her one dog was in difficulty and started tugging violently on the leash to try to effect the release of her dog.

    The plaintiff was already on notice that the defendant had a guard dog and heard him barking. She admitted she had been walking past his fence/gate and had done that many times before, so she knew she was taking a risk! It baffles me how lawyers who are litigants are so quick to disrespect the judge when the verdict doesn’t go their way!!! Ha ha to her 😂😂😂

    She had no control of her dog. She let her dog pull her to the fence. Her dogs paw went under the fence, the Shepard grabbed the paw (with his teeth) she pulled the lease and because of the awkward position her dog was caught in, that's why her dogs shoulder got hurt. Any logical person would understand this, and she clearly knows it happened that way. She's just being cheap and a lawyer. She'll bully anyone into giving her money.

      @@mymobilebuddy4392I think she was being sneaky. I don’t think she knew there was video footage and most judges can use their eyes and see she had no control of her dog and the dog behind the gate barely had any clearance. This case with all of the evidence looks horrible for her.
      Not to mention this case is older and $5,000 to pop a dog’s elbow back into place would probably be lower than $1,000. Probably would be around $400 max $500. Where she got the $5,000 makes no sense

    I just heard "her dog's ARM" and thought Zootopia EXTREME was suddenly a thing...
    Also, lady, for someone who's a lawyer, you seem a little ignorant about what that sign could've hinted at...
    "Beware of Dog" signs are normally not used as a joke or to be cute - these normally have a larger breed. There are actually ones for specific breeds as well and quite frankly, I'd treat them as seriously if it were a pit bull or a poodle. Any sized dog can be vicious, especially to strangers. It's best to not take that risk, especially if you are also a pet owner.
    Yes, dogs bark as a form of communication, but note that not all are gonna be like 101 Dalmations where it's used to help one another. Some are barking to say "GET BACK! THIS IS MY TERRITORY" and not just "hey, how ya doing?". If you can't see the dog's posture (wagging tail, showing teeth, etc), it's best to treat it as a form of protecting its turf - even if you think it could simply be greeting you.

    There is no way a dog---his dog--can actually reach under that 2.5 inch space and grab another dog that is just walking by. Her dog went to the gate and started fighting through that space. She didn't have control of her dog.
    The "way" is to better train your dog so to have control and it be better disciplined.

    I'm sorry. His gate looked solidly built. I would suspect her dog ran over and stuck it's leg under the fence, and when she was pulling like crazy on the video, she dislocated the dogs shoulder. No bites were involved, and in all my years (way to many) of having and training dogs, I have never seen one use 1 paw to trap and hold another dog's leg... Just sayin'.

    It all boils down to common sense really. If she had taken this route multiple times as she stated, then she knew about this particular dog and the sign on the fence. All the had to do was switch the dogs from her right side to her left so that they wouldn't be near the fence. Simple solution. Her leash was too long and the dogs were walking her not the other way around. This judgement was fair.

    I don’t honestly agree with this verdict. It’s a PUBLIC sidewalk…if the dog behind the fence is able to bite or paw grab behind the fence to the sidewalk then the dog got out! People and animals should be able to be walked on public space without feeling like they will be attacked or have to move! Obviously the defendant put a piece of wood from it happening again so that means his dog was in the wrong and the plaintiff should have won the medical bills.

    I don't agree..the point of the fence is to contain the dog... I would have said I didn't know the paw would come out and grab my dog. You just don't think about that cuz there's a fence. The dog went out of the property...

    Another issue is that the plaintiff is already put on notice that there is a beware of dog sign on the defendant’s gate with a dog that barks every time another dog passes by the fence. She appeared on the video to have plenty of sidewalk to walk her dog further away from the fence, or make sure her dog is on the street side when walking past the defendant’s property.

    I'm surprised the lawyer-plaintiff does not realize she has no case. Her dog pulled toward the fence and engaged a dog barking on its own property. Also her dog should be on her outside away from the fences she is passing as she can see how upsetting it is to fenced-in dogs to have another dog near it's boundary.

    Even if a paw fits in a 2.5 inch gap, it’s unlikely that the snout of a German Shepherd would fit in the same gap and be able to grab the foot of another dog. I have to believe that the Cocker Spaniel’s foot went under the fence.

    I'm not sure about this verdict. My common sense says that a beware of dog sign covers the property containing the dog not the sidewalk beyond that property. I can see this was a difficult call but there should have at the very least been shared responsibility. 👀

    I think it's more likely that her dog ran and put his paw under the gate. Even if the homeowner's dog can put his paw under I don't see how it is that he can grab her dogs paw and pull it under to bite it .

    The judge's decision is WRONG. A fence that has a sign 'beware of dog' to me means that if I enter the property 'BEWARE' but not if I walk in front of the gate. Even if her dog pulled her closer to the fence, her dog isn't going to stick its own paw under the fence, so for the defendant's dog to have bitten her dog's paw means his dog stuck its mouth over the threshold and was now on public property to be able to grab the paw...

    One thing you should never do is put up a "Beware of Dog" sign on your property. As the plaintiff stated, it could be construed in court that the sign indicates a viscous dog is on the property and the owner knew it was viscous. A smarter move would be a sign that just politey stated "Dog on Premises".

I'm only stating that having such a sign could arguably be pitched to a jury that you knew your dog was viscous and you didn't take extraordinary efforts to protect people from it. You never know how a jury might be swayed. Saying "Dog on Premises" does the same thing without admitting the dog's ability to bite their ass off.

      I disagree totally. You should ALWAYS put up a sign if you are afraid of your dog biting someone. You are warning people that you have a dog that may or may not bite. It becomes a liability issue. My friend had a dog that bit a cop when he reached in the fence.. My friend had a beware of dog sign. The cop said, I should not have reached in the fence after I saw the sign.

    The fact that JM didn't point this out had me yelling (in my head) at the screen... it had nothing to do with "pawS" plural, it's the other dog's MOUTH that was the the factor and it would be impossible for it's mouth to get under the fence, let alone grab ahold of another dog. Absolute nonsense.

    I seriously doubt a dog could pull another dog's leg under a gap that small with it's paw and if it was using it's mouth it would have been obvious. It's head would have had to have been sideways and it would be extremely hard to grab the dog's leg. It makes more sense that the dog that was bitten pushed it's leg, even if a little bit, under the gap and it was grabbed at that point.

    I have a small yorkie and live in the country. New neighbors moved in down the road. They have a pitbull and I’m assuming an underground electric fence type setup. A quarter mile the other direction, the same thing with 2 large dogs. My yorkie does not go for walks other than in my yard. She is too precious to me to take that chance.

    Apparently it's impossible for the plaintiff to put themselves between the fence and her dog. She could have moved her dog to her right side away from the fence. And the plaintiff even admitted she wasn't close to the fence but has a long leash

    Their dog was obviously on his property and he was doing his due diligence by having a fence and a sign. What more could he have done? She should keep her dogs on a tighter leash instead of letting them roam into someone else’s yard next to their fence.
