    Alito is demonstrating his total ignorance of medicine. If the fetus is sufficiently developed to survive outside the womb, and the pregnancy is threatening the health/life of the woman, they induce labor and the newborn goes to the NICU for treatment. If the fetus is not sufficiently developed to survive, and the woman's health/life is threatened, then yeah, she's going to have to have an abortion to keep her alive and perhaps able to try again. This happens all the time. But Alito's so ignorant he just wants to try to find some legal hairsplitting to outlaw abortion under all circumstances.

    What does an old man know about pregnancy.
    During my 8th month, I started spotting blood. I was hospitalized in the base hospital on Nellis AFB Las Vegas. When I went to the bathroom, my water broke, and it was 7 weeks early.
    The Base Hospital was not set up for premeture babies.
    I was transferred to a downtown hospital and placed under a neonatal specialist.
    My son was breech and had not decided on the birth canal.
    He was at risk of infection and they worried that his lungs were not developed enough for him to breathe on his own. I was at risk for infection because of my son.
    For five days I was pumped full of steroids to mature my sons lungs.
    I had a C section.
    We were lucky there were babies in the NICU that had not been so lucky.
    And mothers who had not been.
    Men should not have a say in situations that they can't be exposed to themselves.

      Bluntly it’s because we’ve been living by patriarchal dominant society/constitution. Look at all the issues from women’s rights, lgbtq, immigrants, racism, gun violence. It’s all looted to me like this conservative judge that will never truly emphasize because he is viewing it from his preservative and portion position. The other problem is that too many women end up falling into their husband’s patriarchal demands. Anti-abortion/anti-women’s rights is taught mostly by parent and church. No one is born that vigilant about someone else’s rights to their body And medical choices. That invasive approach has always been conservative aka CONSERVE dominance and outdated monopolies .

    Alito's proposition is absurd. If the woman dies because the doctor cannot safely decide whether the the mother's life is of greater legal "worth" than that of the foetus, then the foetus will die anyway. How does Alito suggest the foetus be kept viable after the mother dies?

      I think he follows: it's just that he has an absurd position and CAN'T acknowledge it. "Sending it to the states" was supposedly going to be so great for the country -- yet, each of these ridiculous state laws is showing how flawed sending it to the states was. The same thing happened with the Voting Rights Act. They voted that racism was over and that provisions of the Voting Rights Act were no longer necessary. What followed was chaos, with (Southern) states rushing to gerrymander and set up restrictive laws to disenfranchise black people. They will never admit that they were wrong: they'll just pretend they don't see all the problems their rulings have caused.

      It goes back to male property. That fetus is half the man’s property and by extension gets all the rights and privileges of the father. It’s why they give these babies so much protections, superseding the woman, even though there are already laws that protect the medical autonomy of a person with respect to their organs.

      There is no such thing as "zero limits," first of all. There are limits. It's illegal to abort healthy babies at 9 months. What you're referring to is late term abortions. That only happens when the baby is dead or dying in the womb or the baby is too malformed to sustain life or the life of the mother is at risk.

    I live in northern idaho. The laws are so messed up now there are no OBGYN doctors in my out small town. Doctors are afraid of lawsuits because all the legislation is so unclear. It’s a sad day for women and their health+

    It's actually so embarrassing to hear this line of argumentation from Alito. Not only is he absolutely clueless about the medical intricacies of this problem, but he's also clearly misinterpreting the intention of the statute discussed, either deliberately or ignorantly. Either way, it's not a good look for a justice of the highest court in the land.

    I live in Texas. There have been many cases here where the Attorney General has overridden a judge, who heard arguments and viewed the medical evidence and expert opinion, by threatening every single doctor in the state with the maximum fine and jail time if they provided this woman with the medical care she needed. This same fear of being prosecuted by the state resulted in a woman who had been trying desperately to get pregnant, but the fetus became non-viable. And, here is where I believe she has an excellent lawsuit if she wants it, not that a lawsuit will allow her to become pregnant again (too much damage was done because of the insanity of all this abortion dilemma), she was sent home and told to come back when she started cramping (to expel the non-viable fetus) or when she developed a high fever, essentially became septic. The very minimum that should have been done for this woman was admitting her and starting antibiotics to avoid her developing sepsis and multi-organ failure. Since that wasn’t done, she was almost dead when her husband found her and brought her to the hospital. They removed the object (the dead fetus) which was causing her sepsis and she was sent to the ICU because her sepsis had become so bad. She almost died. Twice! And, there was so much damage done to her because of fear of the sanctions that a man, with no medical training or expertise, threatened all of the doctors in the state. As if she hadn’t already had a hard time getting pregnant. As if that child was just an unwanted mistake (it wasn’t). This state and many others are dictating medical practice, without consulting medical experts for what exceptions might be seen, without allowing the people of the state a chance to vote on the issue! Nope. The Governor and the state’s Attorney General just dictated what their “religious beliefs” say that everyone MUST believe and made their law! In my opinion, beyond even the fact that according to the U.S. Constitution, they have no right to force THEIR RELIGIOUS BELIEFS on every person in the state. PERIOD. END OF DISCUSSION! Beyond all of that, I believe that they are practicing medicine without a license by taking away the ability of the person with the medical training and expertise and the pregnant lady’s right to determine what is medically necessary and follow through as appropriate.

      Some clarifications:
      1. The Governor and Attorney General are not practising medicine.
      i) They aren't board certified or registered as legitimate licensed practitioners
      ii) They have not entered into doctor-patient relationship with the woman you cited
      ->confidentiality, duty of care, fiduciary responsibility, professionalism
      These are profesional considerations worldwide that apply so that patients are protected from being manipulated, defrauded and ultimately trust in the profession. If enough doctors do not take this seriously, nobody would trust doctors.
      iii) They are presuming they have a better ethical understanding than the decisionmaking of trained doctors and seeking to induce Texas doctors to directly harm patients.
      This is absolutely something that ACLU should be challenging your AG on. Unfortunately you have religious authoritarians in the arms of goverment(judicial, prosecutorial and Supreme Court) all of whom pretend they aren't going to harm women.

      Yes I too am very confused by what he is actually trying to argue....that the fetus trumps the mother's health? Well no b/c he makes that statement no one is saying the mother should be denied life saving treatment. He seems to be saying both should be given life saving treatment. Well DUH!!! but that is not always possible and in cases where the fetus is non-viable/already dead, doctors in states with these restrictions are delaying medically required treatment to the mothers until they are in severe distress/risk of death....b/c of fear of legal reprisals if they perform the abortion to save her before she's about to die.

    While my mother was 4 1/2 months pregnant with me, she needed emergency gallbladder surgery. My father told the Surgeon that my mother's life was to be saved above all. Not that he didn't love/want me, but that the 3 children at home needed her and their lives wouldn't be the same without her. It took me awhile but I understood his reasoning and concur. Fortunately we both made it through the fantastic skills of the doctor.

    This is the typical problem with the complete and utter antithetical argument that Alito makes. He assumes, the ability of the medical doctor to make a decision that he himself is unable to make but only argues chicken and egg law circles. Alito, alone, shows in his argument that fallacy of his stance. How can a doctor make a judgment when the supreme justice of the nation cannot decide who has priority. The alive woman citizen is in every single case the primary and uttermost holder of ALL rights to life. There can be no doubt that any decision no matter how small or faulty that saves the alive citizen's life is just. It is without any recourse or of any issue of any other action by a medical team. The medical team in a decision here is considered totally infallible and can never be questioned or otherwise legally doubted. Stop Legal Mobo Jumbo and side stepping the protection of the alive woman!
