So remember when Trump declared The emergency declaration for DC on the 11th? Keep in mind that the mayor of DC requested 300 national guard. Instead Trump sent in tens of thousands. Also keep in mind Trump had sole discretion on if to send troops at all and how many to send. Also keep in mind Trump was commander of those troops, followed down the chain to Miller at the DoD. Also FEMA got involved as well. At no point did anybody in congress like Pelosi or even Pence or the mayor of DC have control of those troops.

Now keep this in mind: We also know for a fact there was an active marine division there, supposedly their purpose was looking for NBC threats (nuclear, biological and chemical)

Look at chapter "XI - Military occupation" which starts at page 754. I can't copy and paste all of it since that chapter is very large, however according to it, the emergency procedure in DC was considered by the DoD a legal occupation. This means firstly that no notice needs to be given legally, also it means, and this is the important part, that being legally occupied, the signing in of Biden as President is not considered legally binding:
