Excuse me ma'am aap ne LILLY WHITE VS. MANNUSWAMY, case me ye bola ki, wo 50% ke liye libal nhi honge, unko 50% se jada amount pe krna hoga, but ma'am mene ak case lo pdha tha jisme bola gya tha ki hm agr kisi mall me kishi shroom me jane se phle apna bag ya fir mobile rkhte he, or agr wo misplaced ho jata he to shroom ke term and condition ke hisab se wi sir 25 Rs pay krege. Or ye case jb court me jata he to court ka gugdment ye hota he ki shroom only 25 Rs hi pay krega.
Terms and conditions are binding in the contract.. lekin law bolta hai, ki seller apne mann se koi bhi condition nahi likh sakta. The conditions have to be reasonable..apke case mein, seller ko ₹25 mein mobile mil jayega.. yeh to unreasonable condition hai.. isliye not valid
Past consideration is VALID PROVIDED it moved at the PREVIOUS REQUEST of the promisor. mam if A provides any service to B without any previous request of B ,,,but after two weeks now B is wants to pay rs5000 to A for his past service. Mam my question is It is compensation for past voluntary service which is the exception to NO CONSIDERATION NO CONTRACT ,, means it is a VALID CONTRACT but mam according to statement stated above in 1st lin Will it be considered as VALID PAST CONSIDERATION??? Please answer Mam
In your doubt, if A provides service at the request of B and then later on B makes a promise to pay for it- it is past consideration However, if A had acted voluntarily then promise to pay made by B will be a promise to pay for past voluntarily service

Partners relation with third party is governed with mutual agency. It means that a partner is principal as well as agent. As an agent he can bind the other partners by his acts and as a principal he is bound by the act of other partners But this rule cannot be applied to all transactions for the purpose of the transactions and dealings between the partners themselves. So if A, B, C and D are partners, A and B promised to pay money to C and if they fail, C cannot recover it from D
No this is not a standing offer. It is an offer which has to be accepted within the specified Time ( 1 week) Sometimes an offer may be of a continuous nature and is known as Standing Offer. A standing offer is in the nature of a tender. An advertisement inviting tenders is not an offer but a mere invitation to offer. It is the person submitting the tender to supply goods or services who is deemed to have made the offer. When a particular tender is accepted or approved, it becomes a standing offer. The acceptance or approval of a tender does not, however, amount to acceptance of the offer. Standing offer is in the nature of tender. It is more like an invitation to offer. Offer is given by the other party which can be accepted by the party inviting tender So ifA wants to buy cement. over a period of 2 years. Various suppliers give their offer to supply cement. A then selects Z’s offer. It is acceptance. Each order placed by A during those 2 years is acceptance of the open offer of Z
