If you ask me the facial expression Mattel chose for Pete isn't that much of a bad choice because when he freezes into static toy mode, he does not look crafty in the slightest. Also Pete's hat was never even removed in Toy Story 2 so the toy by Mattel not having it as a feature isn't that much of a huge deal if it was never presented in the film anyway.
Additionally, I think only your copy of Pete has loose legs. Mine are tight enough for him to stand well.
