      This is a common misconception. The person in charge of the property gets to set the rules. In Adderley v. Florida people were being convicted of trespassing on public property. The Supreme Court determined that a state has the right to control the use of its own property and that the state, Florida in this case, is no less than the private owner of the jail and its property. According to the Supreme Court, nothing in the U.S. Constitution prevents a state's fair enforcement of its own criminal trespass statute against anyone refusing to obey the sheriff's order. The jail differed from a park or state capitol grounds in that it was an edifice built for security purposes, not for public use.

The door was locked and needed a specific way to open it that wasn't obviously accessible. If there is a specific button or a 4 digit pin that was to be pushed is no different. If you pushed on the door and actuated the mechanism and the door would not regally open then you were restrained from leaving. It is obvious that you had many other violations which occurred in addition to embarrassingly stupid public tyrants who are in inappropriate and even dangerous positions. Keep safe.

    I thought that in most states a public area has to have an exit - there should be a lighted exit sign above the door. Those doors are not supposed to ever be locked so that people can exit if there is a fire or something. That is usually something a fire inspector always checks . The door can locked to enter but it has to be able to open on the way out. Not sure if that would be different for jails - but since that is a public area you would think there has to be egress that is not locked - so you push the bar on the door and it opens - and trying to find a small button at the side of a door does not count because if the room was filled with smoke you would not be able to see it easily or find it. Usually there are regular fire code inspections on public facilities so those reports should be available I would think.

    • @LarryKapp1
      @LarryKapp1 5 ปีที่แล้ว +1

      @slayne2 Still by most fire codes there has to be an exit at any place where people work. Maybe this state is different but most there are lighted exit signs . Might even be osha rules about unlocked exits. In fact I think there was a case in wisconsin where some factory chained up and locked some exit doors and then there was a fire and people couldn't get out - they got in big trouble

    Just read the sign on "releases" ..... Releases take longer because of "their" lunch times.
    THEIR lunch breaks are more important than YOUR freedom. You stay in your cage longer (and probably hungry) while they all go eat.
    UNBELIEVABLE, until you read that sign in plain view.

    • @danfadden
      @danfadden 4 ปีที่แล้ว

      This was the first thing I noticed. I was on the other side years ago, and I would always release someone immediately, even if it was during my lunch or break. Because that’s how I would want to be treated. I never understood the other DO's that would take their time. It never made sense to me. And my actions never made sense to them either. Why? I’m no longer in that business. Thank god. It’s just gotten worse.

    Why don't these law enforcement people know the law?
    Trespassed from an open public area for looking for records that they should produce under law.... how crazy is that...?

  • @Rubyfire76
    @Rubyfire76 5 ปีที่แล้ว +14

    You are not secured in your person when the officers in this vid continued to press you into producing ID when law does not require it. You did nothing wrong yet the sergeant and the officer treated to like a criminal---in fact, your photography is protected under the case law you cited in the vid. Police ignored that, failing to inform the public servants that you had every right to be in a public area with your camera, recording them, but police chose to become actors in a wrongful trespass, having no legal justification other than the public servants did not like to be recorded and wanted your name. The officer, ignorant of the law and having no legal grounds to do so, unlawfully detains you because he wants to investigate--investigate what--that it is a crime to record public servants in public? Then the sergeant deviously attempts to con you out of your 4A rights by equivocating trespass with trespass warning--all the while you being detained and not free to leave the property, and then the sergeant is hasty about kicking you out of the property before you get all names and badge numbers. When judges start awarding millions in damages for this sort of thing and police lose their jobs, they'll unequivocally learn hastily nationwide what the law is.

  • @jhrsjhrs
    @jhrsjhrs 5 ปีที่แล้ว +6

    Ya gotta get those names and badge numbers BEFORE having any further contact or they'll oftentimes play games and refuse to ID.
