Relevant Legal Points for Florida: Traffic Stop Justification: If Hill was speeding, the officer had legal grounds to pull him over. In Florida, speeding is a clear traffic violation, and once an officer initiates a stop, they can also address other infractions (such as not wearing a seatbelt, which is mandatory in Florida under Florida Statutes Section 316.614). Request to Exit the Vehicle: According to Florida law and the precedent set by Pennsylvania v. Mimms, officers have the right to ask a driver to exit the vehicle during any lawful stop. This is generally allowed for officer safety, especially if visibility inside the car is obstructed by things like dark tinting. Use of Force: The Florida Department of Law Enforcement's policies on use of force require that any force used be reasonable and necessary. If Hill refused to roll down his window or comply with the officer’s request, the officer might have felt justified in escalating the situation. However, the key question becomes whether pulling him from the vehicle and using force was proportionate to the risk posed by the situation. Tinted Windows: Florida law also regulates window tinting under Florida Statutes Section 316.2953. If the windows were too dark to see through, this could add to the officer’s safety concerns, though the legality of the tint itself would need to be assessed based on specific measurements. Lawyer’s Perspective on Justification: Prosecution might argue that Hill’s non-compliance (e.g., refusing to roll down the window) could have reasonably led the officer to feel unsafe, justifying the decision to order Hill out of the car. Officers are given latitude in ensuring their safety during stops. Defense attorneys could argue that, unless there was a clear and present danger, the level of force used-such as pulling Hill out of the car-was excessive, particularly if Hill wasn’t being physically aggressive or posing a threat. In Florida, these kinds of incidents are often subject to review by the department’s internal affairs or civilian review boards, especially if force was used. The bodycam footage, which is under review by the Miami-Dade Police Department, will play a central role in determining whether the officer's actions were reasonable and justified under Florida law【9】【10】.

From seeing the officers body cam, tyreek was driving recklessly. He then didn’t follow lawful orders, was an officer safety risk from not following orders, was disrespectful to the officers and tried to control the situation. Then all his football player buddies started getting involved which escalated the situation. Take responsibility Tyreek.
How do you know that someone is driving recklessly because there are a lot of cars passing in the area. Which order he didn’t follow, 1) the camera showed that the police asked him to move over after he got pulled, 2) when he knocked the window and asked for his license he gave it to him. The only thing he did wrong was telling him not to knock the window like that. There’s no reason for things getting escalated like that. What about the other friend who was detained what was his offense?
@@annecelestin8534Hill escalated the situation immediately with the whole knocking on the window thing. Two things can be true at the same time. Cops were aggressive but Hill was trying to throw orders around at cops after breaking the law.
Incorrect. An officer safety risk from not following orders is the new buzzword. You are a cop with a gun. The current majority public sentiments towards police officers, which was earned by their own behavior historically, is not the responsibility of the citizen. You took the job. And your training, Intel, and acuity for discerning civilian interactions that YOU initiated, are your responsibility. We do not pay taxes for you to conflate a civilian traffic stop with a sudden AD HOC bs threat assessment. If you do not have the mental acuity to discern the difference between disrespectful free speech and/or lethargic disobedience (neither of which are illegal) from a legal suspicion of a crime (which is the requirement for which you can detain someone), then you don't deserve the badge and the mental acuity that is required for it. Cop wanted to bully somebody. Period. Put your feelings to the side, access the situation with some professional critical thought, and stop being a girl because the guy said "hurry up and give me a ticket", and you don't like being told what to do. He knew it was a traffic ticket, the cop knew it was a traffic ticket. Write it and go home before you accidentally shoot somebody over your small PDF file.

Dont try to defend the dude !Tell him to not drive like a fool and to roll his damn window down when a cop is trying to get his information ! Don't be an arrogant prick !
The issue is proportionality. When the car has stopped driving, it isn't necessary to use force to stop him from driving recklessly. When he won't roll down his window, the police officer can give him a ticket for that, but why drag him out of the car with violence? You need to keep in mind that the police is there to intervene in active situations, determining guilt or innocence and sentencing is up to a judge. The cops may feel he is being disrespectful or whatever, but it's not their job to teach the driver a lesson. Which seems to be what is happening here.
I guess if you speed 60 in a 45, you must keep window down with cops, while fans are trying to snap video of you getting pulled over, and should be subject to immediate yanking from your car and knee in the back handcuffing if you decide to roll your window up after providing the needed documentation. It's totally uncool of Tyreek to not follow society laws. His driving and swerving in and out of traffic at high speed is very dangerous. And when the officer lawfully pulled him over and knocked on his window Tyreek was extremely rude, disrespectful and uncooperative. The police have a job and that's to enforce the law, not give white glove service to a dangerous felon who feels entitled to treat officers like dirt. Tyreek got exactly what was deserved. I can find whole TH-cam pages dedicated to people who willingly do things like open carry assault rifles, recording random police officers, and just doing suspicious stuff to get cops attention, then refuse to identify themselves and start talking about it their rights. These people don’t get handcuffed or a knee in the back while in handcuffs for “not complying”. I don’t care how combative or “uncooperative” he was, a 20 mph over traffic ticket should be just that. No one needs to get out of the car or put into handcuffs unless for a traffic ticket regardless what is being said in the interaction. Bottom line.
Wrong, you must get out of your car if an officer orders it. It is very straightforward, there is NEVER a situation where you don’t have to get out of your car if an officer orders it.
@@nsh1980 I’ve been driving since 16 and I’m 36 now. I’ve NEVER been asked to step out of the car for none of the traffic tickets that I’ve encountered. For a traffic stop, unless he was under the influence (he’s about to play football so no) it should have been a ticket and “have a nice day”. The cop escalated that by telling him to get out of the car. I can’t assume a valid reason to pull someone out of the car for a speeding ticket besides substance abuse.
@@nsh1980 When he was ordered out of the car, he said okay. Then they reached in and snatched him out of the car, and (Hand Cuffed) him. How is that okay for a moving violation, now if he had refused to give his id? i would see your point, but he immediately handed it to the officer.
Well , bodycam released and as imagined he didn’t follow orders and by not putting the window down he was putting the cops in a defensive situation. Cop 101 training of taking all precautions. He was told clearly why he was being stopped and refused to obey orders with a defiant attitude. The cops followed the book and did the right thing. Relevant Legal Points for Florida:
Traffic Stop Justification: If Hill was speeding, the officer had legal grounds to pull him over.
Lawyer’s Perspective on Justification:
Prosecution might argue that Hill’s non-compliance (e.g., refusing to roll down the window) could have reasonably led the officer to feel unsafe, justifying the decision to order Hill out of the car.
To use the law in defense of your ego is why there are tyrant police. He asked him to exit fit his ego not his safety and you know it. Stop hiding behind laws

Bodycam released no surprise Tyreek lied about everything
@@superduty4556 allegedly - cops aren't the law. no radar, no speeding. recklessness was not shown in the videos they released.

He did everything he was required to do by LAW! Cop was power tripping.
