- The season of final registration u/s 12AB of the Income Tax Act for a period of 5 years is going on nowadays and the notices, clarifications, and passing of approval or rejection orders are at its peak. Are you too waiting for the notice or the order against the application filed by you in Form 10AB? I am Ashis Agarwal from Team NGOenabler and today in this video I will be discussing the applicability of filing Form 10AB means when You need to file Form 10AB because still there is a lot of confusion and misconceptions going on regarding this issue. Also, I will cover the questionnaire which is being issued by the department after the Form is filed to seek more information and documents about the organization. So, let's begin.

Any activity, if started, shall come within the meaning of activity !
If One NGO has got provisional 80G Certificate, and it took donations from the donors. Now its final 80G got rejected. Now can the donors (who donated before the rejection of Final 80G) get Tax Benefits?
A bit difficult to ensure that they shall get tax benefits ! But on the basis of principles of natural justice, they should not be denied , for the fault of the organisation
Trust is newly incorporated and has Provisional Registration. Trust has started activities within 6months of incorporation..in Form 10AB in case of audited accounts what should be submitted? As an entire year has not passed and audited accounts are not available.
You can submit a declaration that since the year is not completed, the audited accounts cannot be produced
What if form 10AB filed belatedly? In our case the delay is 1 1/2 Month whether they will condone the delay or directly reject the application?
No specific provision has been laid down in this regards. I think it completely depends on the satisfaction of the CIT about the matter
Is it going to be a permanent 80g /12a registration by this permanent registration like how it was earlier or is it also valid for limited periods
Valid for 5 years ! Permanent registration like earlier is no more available
80G application in form 10AB was rejected on the ground reply not received..
But hearing notice not sent to correct mail id in profile

What we can do
You need to file an appeal and take these things as grounds .
Or alternatively, you can file provisional registration again but the year 22-23 might be without 80G
@@NGOenabler already have provisional registration up to Asst.year 2024-25 in the Rejection letter : As the applicant has failed to fulfil the statutory requirements inspite of
affording reasonable opportunities, its application in Form No. 10AB dated
22.09.2022 seeking approval u/s. 80G(5) of the I.T. Act, 1961 is rejected for noncompliance. However, no adverse inference is drawn against existing and valid approval, if any, as per law u/s. 80G.
Can we resubmit the form 10AB in the same section.....I have tried everything but not able to file it...but a CA in uttrakhand is filing the same...plz suggest any way.
If no donation is recieved but we have some very minor activity, will that also qualify as activity

My trust is already registered and I file form 10A for 12A and 80G but got form 10AC with registration for 5 years.. whether I need to file form 10AB?
No you need to file it before 6 months from the expiry of the certificate because it's already a final registration

Hello sir! Our final 80g got rejected due to delay in filing 10 AB. We surrendered our 10 ac and applied for provisional again which we have got. But now when, we are trying to file 10 ab, and fill section code 14 clause (iii) it is not accepting as it says valid reg exist. Can I apply 10 ab with sub clause b of clause (iv)?
No! There is some technical error. They should accept 14 again ..
@@NGOenabler Sir, our registration we got provisional registration on 01/12/2021 and is valid till AY 2024-25. We have to renew it by 30th sep, 2023 which is 6 months before expiry of provisional registration. Now how can we renew sir. Is there any option to file 10A for the purpose of renewing.
Circular No. 07/2024 have come up today ! You can get the benefit by refiling the forms

We have applied for final registration u/s 80g and 12 AB
However while filing for 12AB the form sub section code was incorrect..this was inadvert mistake and also acknowledged by officer hence our final Registration application got rejected without any adverse inference
We have filed fresh form 12AB
However due to rejection of 12AB , application u/s 80 G also got rejected along with cancellation-of provisional registration u/s 80G
What course of action should be taken for 80g
Do we have to go for appeal or wait for approval of 12AB
Please suggest on urgent basis
As of now there is no specific provision on this matter . In my opinion, appeal is the only option
