I was a passenger in a rear end accident with my care provider she dropped me of at home with her daughter and said they did not call the police. We went to see a chiropracter and signed papers with an legal assistance. I know she got paid for her loss because she received a rental car and did see a check from the insurance in her purse she did not return to work with me nor did she answer any of my calls. The legal assistant did not call me nor return any of my calls. I could not get anyone to speak to me since i thought i signed papers with a lawyer. The insurance company did contact me but i did not speak to them since she said the accident was in january 2023 but it was december 23 2022. I have been researching and want to file against the lawyer and the insurance

After my research I know that there is a stature of limitations which is not disclosed to us but this incident is really bothering me how do I know if the lawyer filed they nevere returned any of my calls, the insurance did contact me and I did call and she did report and included my name to her insurance but when they called me they gave me a different accident date.I know she lied about the location of the accident but I do have a witness that said the police did show up and she did not want to call them I did hit my head really hard on the area where I had a brain tumor removed back in 3/2012 and now disabled. That was my 3rd accident that year. I was knocked down by my own truck on the side of my tumor surgery had to settle did not complete treatment had no transportation to get to my therapy purchased 5 vehicles that year and without no transportation today. do you use prior cases when looking for amount of damages to ask for? Is there a site for average people to research and find summary judgements on their own? thx.
Yes I use prior cases or precedents. There are many sites - Lexis/ Nexis, Westlaw, and Jury Verdict Reporters but they are all paid sites for law firms. For the public I suppose just a google search may yield some cases. We dont look for summary judgments only verdicts & settlements. Summary judgment just means there was no issue of fact for a jury to decide at trial so a judge grants liability to a party as a result of a motion

I suffered a TBI in addition to other orthopedic injuries as a result of a truck crossing the median onto oncoming traffic on I-80 and have a number of severe symptoms including depression, migraines, difficulty in thinking/problem solving, difficulty speaking, insomnia, etc. The insurance defense lawyer said my MRI showed that my brain was normal and initially after the accident, my brain injury was not so obvious and symptoms didn't start right away. I attended a defense IME and their doctor said I'm fine. What evidence should I use to address this? I've been receiving treatment from neuro, speech therapist, pain management doc the last few years and my symptoms aren't improving.
Just use all your treating doctors that say otherwise. And let the jury decide who is telling the truth - a bunch of different treating doctor with no skin in the game or one doctor who was hired by the defense to say you’re fine so they can protect their pocketbook. Also use before and after witness from your life who can tell stories about who you were before the crash and who you are after. With TBI I like to use neurologists and also neuro radiologists with scans like 3T MRI, DTI, SWI, neuro quant and others. You may also get a neuropsych depending on symptoms. Why do lawyers go arbitration route when the defendant liability and causation is clear there liable for injury-The lawyer made it clear we still proceed to trial if arbitration fell?premise liability claim against real estate developers
Sometimes arbitration is the only route like with uninsured motorist. Otherwise i would not do arbs unless I had to. Jury trials always the way to go !!!
