She's right unless they received a variance after a public hearing then they need to take it down . It doesn't matter how much it cost's . if the plans were approved and later found to violate the code then it has to come down . Many contractors factor this into the overall cost of a project .

joseph bourdeau heres one of this "outstanding lawyers " clientele : sebastian janikowski a rapist.
( Lt. Linda Riley, a spokeswoman for the university police, told the Associated Pressthat a plainclothes officer saw Janikowski and two other men drive into the bar's parking lot and then noticed one of them pouring a small amount of clear liquid into a container.
"After the officer approached the car and identified himself, Janikowski allegedly poured the liquid onto the floor mat of the car," Riley said in a statement released by the university. "A test kit confirmed the substance was (GHB)."
The two men with Janikowski also were arrested, but were not required to post bond. One of them was Jay Hoffman, a former walk-on for the Florida State football team. Stephen Dobson, Janikowski's attorney, said bond was required for Janikowski but not the others because of Janikowski's prior record.)

Especially in a place like Florida that gets battered by hurricanes every year. You follow building codes because they are put into place to ensure that homes built will last through these storms. I don't understand why someone saw waterfront property in Florida and thought "I'm going to move the house CLOSER to the water that floods multiple times a year!"

All you people slamming this woman need to step back. Yeah she has money, but this is part of a larger problem. The fact that she has money shouldn't even be an issue. this is a woman who was smart enough to call out the county for picking and choosing what codes they want to enforce. Don't be a hater because she has money and the wherewithal to argue her issue with intelligence, and call out what appears to be a blatant screw up by the county. Kudos to this couple for standing up for their rights, money or not.........

    • @66mariob
      @66mariob 6 ปีที่แล้ว +5

Allow me to retort. Broke no laws, that is correct. Building codes yes they have. Just follow the rules as they were written, and not pick and choose which ones you want to follow and all would be ok. The county messed up, and they are trying to cover it up...Period... Oh on another note you must be a joy to be around at a party, because you sure do sound miserable...And maybe someday when you grow up you too can have a job that affords you the opportunities these folks have. But until then I now return you to your pitiful existence....Have a nice day

The city where I live in Canada, regarding waterfront property, it is illegal to obstruct a neighbour's view of the water. You can't put trees, fences and certainly not brick walls that will obstruct your neighbour's view of the water. You need a law like that on the books where you live.

Well, in LA most houses have space between houses. Our house was also affected since neighbors built a house with 2nd story AND balcony that overlooks our backyard - kid you not. With that said, there's zero privacy and you get a house to have privacy. McMansions in LA normally block sunlight since they are built in an "apartment style size" next to a single home house. If people can protect their neighborhoods and Santa Barbara can have a law to not build any more properties in the city, then why not and do it?

Sure these guys are super privileged but that does not mean they are not entitled to their rights within the building codes. The building codes is what keeps order in terms of construction so you do not have a mess of structures piled up against each other. Also code serves purpose on environmental and safety issues too, it is in the best interest of everybody to follow it.

Smoogalers! InYourFace depends if it is posted and if there is a fence around the whole thing. Laws are funky :p technically if i can find the proper distance from both houses i can go stick a blind right at the water edge (not likely from arial shots but there is a mabey) and go duck hunting (given proper license and stamps), or if i had writen consent from one owner and stay on their property. Not safe but its a technicality and i wouldn't do it plenty of open land to hunt in around the usa and I perfer deer over duck. So going to a farm and asking a farmer to use their land to hunt works better. (Some might even let you hunt in a fenced in field depending on the state and farmer. "Protect the corn crop lad")

Funny enough, everyone complaining about "million dollar view" would be losing their minds if it was an HOA that allowed that to happen!
it sounds like the lady is fine with a house so long as it followed the rules. problem is that the rules were broken by the city, not the neighbor. and it puts everyone in a bad situation. Neighbors followed the rules on their end. the city didn't do their research before rubber stamping the project. now neither neighbor will be happy because existing homeowner is now out all their lawyer fees and time, and new homeowner is out the cost of their renovation, as well as their idea of what they wanted in their home.

I am surprised at these comments. Imagine you worked hard all your life. You build a nest egg working and working, saving, and investing. You retire and build your dream home. You abide by all the rules of the county commission/ Things you would like to have including getting closer to the water, but hey rules are rules. So after all the years of hard work, one day someone says fuck the rules. Ruins your own property value now because of the crap view. Not even the very commission that you yourself abided to sticks up for you. You are telling me you would not be pissed off? Just meh hell with it its just rich ppls problems pff. I even read some say if it is so important to them they should buy the property next door...... really?Ok number one they should not have to. Number two maybe they spent all they saved and what they have is all they could spend. If we are in McDonalds and you order your burger minding your own business. I come over and grab it and eat it.I can say well just go back to the counter and buy you another one, its no big deal.

gee... check somebodies pockets on that commision. I bet they are fatter than they are supposed to be. This kind of stuff happens all the time and its usually because inspectors and code compliance agencies along with the attorneys got piad to overlook the issues being brought before them. Good luck fixing this issue by trying to fight the laws alone. Start by hiring investigators to check financials of those involved and then let the voting public know and vote them out.

Gary Ko It's basically an extremely large house that gives no fucks about aesthetics, often incorporating needless things, attempting to use aesthetic styles from other places (New Mexican-style roofs in New England, as an example) and just generally being easy to hate. There was a TED Talk about this, so if your comment wasn't just a joke, you can look that up.

Once a building plan is approved by the city engineer, the inspectors really can't force the builders to make major changes, by claiming that the wall is to close to the water front, and moved back 15+ feet would need a new plan drawn to ensure that the rest of the structure would be stable.

In Oregon we have the Land use Board of Appeals where one can appeal a local land use decision. They rule based on the facts and not local politics. I don't know if Florida has such a thing. Gate Keeper below is right; the ones with the most money can badger the Permit department until they give in and then litigate it until someone else can no longer afford it, so they then win.

I'm sorry but code are codes. They dont get to choose when to follow them and when to not. If we have to be held the strongest code then so does everyone's. I dont care if they have money or not. They need to simple sue the county for improper code enforcement.

I looked the address of this house being built and funny thing is it's the same size and almost the same positioning as the house to it's right... I see if it gets right up for violation then the house to it's right should as well. I also noticed the couple complaining built their house crooked at an angle... had they built it straight facing the lake then their view wouldn't have been "blocked" they must have not thought every worse case scenario when designing their home... Why would you angle your home towards tour neighbors yard... yes at the time the house on the property was bloclomg your view but that's what worse case scenarios are for.

Maybe Roxanne Kosarkzycki's dream home appearance is why the new owners built that wall?😅
In all seriousness, it certainly feels the new owners had major connections. I hope by now all has been resolved. Unless there's more to this story, it appears that the new owners were completely insensitive.

To all of the people essentially saying "She's crying about losing a luxury!": How would you feel living as you say, with only the bare essentials of life? You wouldn't like it, common sense can tell you that. She wants to maintain a luxury, that being her house's view. I'm sure you wouldn't want to give up the internet you use to watch YouYube, nor your XBox or your computer.

Guess you should have purchased the property that was closer to your million dollar view! Someone bought the adjoining property, and now your pissed because they reasonably build a house on their property that now obstructs that view. This is non-sense. Even with the 30 foot ordinance, your view is only about 8 foot obstructed. Your problem in reality is the whole rest of the constructed building also obstructs your view. That little 8 foot section has nothing to do with it. After re-watching the video; I noticed if you just slightly turn your head to the right and not towards that part of the wall, there is the whole rest of the Lake that you can see. This video never pans to the right, because they want us to believe that their whole view is blocked! And I'm sure if your are on the 3rd or 4th story of your mega house, this wall has no bearing on your view of the Lake at all. So get into your elevator, ride it up to whatever level is above this wall, and enjoy your million dollar view!
