To a lot of people the idea of a person leaving money in their will to a pet instead of a charity or, you know, their own family or friends, seems something only an eccentric wealthy person would do. In reality, a pet trust is not only a surprisingly common arrangement, but one most legal experts recommend for any pet owner who cares for their animal. But how do you go about accomplishing this and how do you make sure your wishes are followed?

I’d imagine if you add a clause that the turtle must die of natural causes, or live it’s entire life span for the family to actually get the money, heck you could even make it that the pet needs to meet certain standards of care, have someone to examine it etc for the family to be eligible for said money. Should they mess up in any way all funds should go to a charity or something similar. It really would be ingenious, provided that you account for all possibilities.

When my friend and her husband updated their wills a few years ago, she asked me if I'd be okay with them leaving their pets (and some funds for their care) to me. I've been pet-sitting for them for nearly 20 years, and my friend said I'm the only person they trust to take care of their pets as well as they would. Of course I agreed. I recall a story where someone died and left everything to their dogs, with the butler acting as the caretaker, and the butler was to get everything after the dogs died
People were constantly asking him if he wanted them to kill the dogs for him, his response was always no, because he already lived in the mansion and had access to the car, and still got his paycheck in the interim, he also managed the money, so in practice he already had everything and just got some dogs in the process

My aunt had taken care of the surviving dogs of an elderly woman for about 10 years. The woman only had one surviving family member, a son, who had repeatedly broken into his mother's home and robbed her.
A trust had been set up to cover care of the dogs and the house. My aunt paid a measly $200 rent on the house while the dogs were alive with preference to buy the house when the dogs died.

This is sounds so complicated and expensive.
If one does not have a trustworthy friend or family member to leave the pet to (hopefully someone not even needing to be reimbursed), perhaps leaving a good sum to a no-kill shelter with the specification that your pet be given special attention in finding a suitable home would be much more reliable.
    Just a thought.

      @jannepeltonen2036 5 ปีที่แล้ว

Yeah. I mean, from a purely intellectual standpoint, I can see the fascination in trying to prepare for all possible scenarios, but as an actual human being, I would think finding someone - if not an individual, then an organization - you can actually trust to look after the pet would be the best thing to do. As opposed to maniacally trying to control everything from beyond the grave, with your money.

I have a beloved bird from the Amazon Rain Forest that I've had for 32yrs. I have often thought of my plan for him but haven't done so although I know I should. Leave money for his rest of life care and of course also money for the care-taker. Then I assumed he would be taken care of. But of course I know he will as I chose my eldest to care for him. They get along greatly. If he croaks before me I always wanted to have him stuffed by the Taxidermis in his stance with his wings spread showing all his colors along with his talons grabbing the branch and his tail spread in colors and his eyes in bright orange color which is how he turns them when he does grab the branch with the talons, spread his wings, flap and stretch with his beautiful tail spread. He is a rescue from the mid-80's when smuggling was prevelant amongst exotic animals and many many birds perished because so many were stuffed into a small space. His wings were chopped beyond what we call 'the quick' of our nails and bloody. He screamed if you got within 5ft of him. Over time he has learned to trust me and others. I never could just abandon him when I pass. He's a medium size parrot for cripes sake and has come along way from surviving being smuggled into this country battered and abused to living a good loving and caring life. On that note I would advize to anyone considering getting a pet exotic or dometic: If YOU cannot commit the next 25yrs of or more of ur life to that animal (I've seen both dogs and cats live to 27yrs) then please do not get it! You got that animal and it depends on you. Just because your life may not be going right, for cripes sake don't abandon them.

      Reality:
If you don't KNOW someone who will POSITIVELY care for the bird... don;t leave your money for the bird's care. Give it to an animal rescue. (NOT SPCA OR PETA!... PETA shelters have the highest kill rate as % of pets "rescued" of all shelters in the USA, SPCA is #2)
An appointed guardian for the bird will rape the money allotted for the bird's care, then claim the bird is sick and have it put down (or just wring its neck and claim it flew into a window)

I was a neonatal foster carer for the RSPCA Queensland (in Australia) for a while (which means that we raised orphaned kittens from birth to adoptable age) and I know that the RSPCA had a system whereby if people were concerned about who would take care of their pets after their death, they could ask the RSPCA to take custody of them. There was a fee involved (sorry, I don't know how much exactly), and the RSPCA would either place the animals in permanent foster (Retaining ownership so they could ensure proper care) or re-home them, depending on the wishes of the owner.
I know there were two very elderly cats whose owner had passed away who were left in the care of the RSPCA, with the stipulation that they were to be kept together. These cats were about 18 and 20 years of age, and when they came into the RSPCA's care, the foster-care office hung on to them for a week or two to assess their health (under the watch of the vets there), but it was decided that the cats needed monitoring by the vets so they became the 'mascots' of the foster-care office and live there. The carpenter at the RSPCA made them ramps so they could climb up onto the desks without jumping, and made them a scratching post and bed system up against the large windows in the quite roomy office. Last time I was there (over a year ago now, as I have moved out of the area), they had been at the RSPCA for over a year and everyone in the office loved them and came to sit with them and cuddle. I think their owner would have been quite pleased.

People who dont like animals, dont understand this, they always have some 'good' ideas about who to spend the money on, but it has to be what the petowner want for his animal friend or friends, so at the end of the day, dont make wishes for other peoples money, even they should burn them all in the garden.....

This is a serious problem and one more people should think about. My dog who I just adopted a few months ago was left abandoned after his female owner died and her husband was forced to go into a nursing home. He and several other dogs were left to run with neighbors feeding them every few days. People need to plan for this kind of thing, especially older people. I know not everyone can spend a lot of money on a trust, but they should at least have a plan.

large/deep ponds very rarely freeze all the way through , the fish just move deeper into the water. But with small ponds/pools, some fish may be able to hibernate in the pond until it thaws out in the spring.
Other than that, they just freeze to death and die.

    • @CalliopePony
      @CalliopePony 7 ปีที่แล้ว +5

I live near a lake. Most winters the fish survive just fine. They swim in the deeper waters, and the middle part of the lake usually thaws and refreezes a few times over the course of the winter. A few years ago we had a really harsh winter. The entire lake froze really thick, and there weren't any thaws. In the spring there were a lot of dead fish because the water had gotten too low in oxygen. Without any thaws or flowing movement the oxygen supply couldn't replenish.

I am going to request some... Interesting things in my will.
1- any pet that I have is to be given to a close relative and said relative will receive a financial reward from this. At some point before the pet dies, they must make it a bed out of dollar bills, appropriate to the size of the pet. Even if said pet could never use the bed, due to being aquatic or otherwise. Unless the request is fulfilled, the caretaker will not receive the reward.
2- I will pick two relatives that have a burning hatred for each other, and let them have my house on the condition that they live together. Even if they don't move into my house and instead sell it, they must live together for at the very least, however long it takes to sell the house. If they do not complete this task, the house will be given to another one of my relatives.
3- My body shall be taken to an open field, and blown up. 5000$ worth of dynamite is to be used. I guess this counts as a cremation?

I am so glad I'm in a family I can trust. If I wanted a pet cared for after my death, all I would have to put in my will is something along the lines of "I want my sister to take care of my cat." Maybe with a letter attached if there are special care requirements, like medical conditions, or if the cat is a picky eatter. Of course, I'm not rich, and my family wouldn't be fighting over whatever I have to leave after I go, so that may be a factor.

  • @GranRey-0

It would be cool if you could set it up in the beginning with the animal going to a No Kill shelter, and have some good person who wants the animal to start. And have the funds distributed from a trust account, that allows them to purchase food and veterinary care for the animal. Since Shelters check up on your living conditions and how you care for them more than Child Services.
    Kind of like:
Adopter - "I'd like to adopt this dog."
Shelter - "Okay; no problem, this dog also comes with a life time supply of food, vet bills, and accessories. Please use this card at the following retailers, and get the Veterinarian to call this number on the back."

There is also the possibility of losing the ability to care for the pets before your death. A few yeas ago a good friend asked me to fly from my home in Oregon to care for her mother, who was being put into a nursing home. She had 4 dogs and 3 cats, all of whom needed new homes. One of the dogs actually belonged to a friend of hers, so that was easy. Another dog went to the woman's sister, but the third dog and the cats were another issue. The woman had Alzheimer's and was no longer able (or willing) to make these decisions for herself. Fortunately she had a lot of people around her who cared and were honest enough to do the right things for her. It was a really sad and stressful thing. I could not imagine what would have happened had she only had who two older children (both drug addicts -one already dead by that time) to get her through this.
I only met my friends next older sibling, the other two I never met face to face, but from what I've gathered they are/were both quite selfish and dishonest.

    Let me simplify things:
Leave your money with a pet lover you trust, especially if they're family. For example...my brother is a dog owner and loves dogs of course. I can comfortably leave all money and dog with him, should anything occur to me.
However I also have a good friend that loves all animals, but only owns a Parrot. So i know he would take care of whatever animal I leave him.

These comments are disgusting. Animals are like your own children, and if you don't see them as such then don't get one. They deserve nothing less than being cared for to the best of your ability, just as you would for a child. Honestly I don't understand people who don't see animals as family. And I mean FAMILY, not just a "family member" who's lower on the hierarchy than the others. I can't wait until people's perspectives shift to seeing them the way they should be seen.

Making a Living Will and or Foundation + Estate and Trust for a pet, can also be used to work around sibling squables (if any) and or the person might genienly be conflicted what they want done with their stuff including money. So they'll name a pet as the person that gets it all. California has had several cases of all of those.

Maybe in extreme cases, but I assume its mostly used to make sure your pet isn't pounded or put down when you die and actually gets treated well.

People love their animals and want to make sure they are cared for! There is nothing selfish about that.

This is probably what I'll have to do for Nibbles, my African Spurred Tortoise. They can live to 150 years old tops and Nibbles is only 5 years old.

Maybe the lawyer thinks "If I don't comply with their ridiculous demand they will move on to another lawyer." Although lawyers shouldn't plant that thought in their clients head in the first place if the client demands it and threatens to change lawyer then I suppose they have no choice.

      Dr Fibbles
If youre friends with someone purely based on the hopes that he/she will give you money at his death then you are 1st a piece of shit and 2nd not their friend.

So all i all it is a bit complicated. It is best to find someone you trust. Other than that I see nothing wrong with wanting your pet to have a good life after your dead.
