    nice explained. I have question , my employer added 49000 covenance+LTA in salary structure monthly. My salary is 25.6 lpa . Offcourse I can't able to spend this much, so as per tax slab is this higher LTA beneficial ??

    Hi Labour Law Advisor,
    I am a salaried employee and also a "Sanskari Balak" living with my parents, I want to get tax benefits through HRA component of my salary. I have Following questions.
    1. Can I pay rent to either of my parents or only the one who is actual owner of the property.
    2. Can I pay rent more than the general rent of the locality (Given my HRA limit allows it).
    3. I haven't been transferring the rent amount to my parent's account since a couple of months can I transfer the arear at once (Will that be admissible).

      1. You can pay rent to either parent
      2. Yes you can pay any rent( as long as your parents are showing it their ITR)
      3. Yes you can transfer the arear at once

    I've changed home in between year. (1) From April to August, Ive paid 9K * 5 Month= 45000.
    (2) From September to March, I've paid 13000 * 7 Month = 91000
    So Total I am paying 1,36,000. So MY QUESTION IS... DO I NEED TO GIVE PAN CARD OF BOTH LANDLORD EVEN IF BOTH ARE GETTING RENTAL AMOUNT LESS THAN 1,00,000.??????

    Respected sir, in my form 16 b , HRA under section 10(13A) is .00 but I paid rent in year but my employer did not included in HRA section but company give me HRA is rupees 25200 per annum. What should do sir. Please suggest.

    Here's my question.
    I am doing WFH and living with my parents.
    The house owner is my father can I make a rental agreement between us and claim HRA?
    In the above case my father would have to pay more tax as the amount I'll pay to him will add to his income.
    Can I create a rental agreement btw me and my mom(she is not the owner ) and pay her the rent and claim HRA?

    @Labour Law Advisor: Can an Employee claims rent up to max limit of HRA given by employer when that person lives with his parents and working remotely. by remotely means that the base location of employment and the residential address of employee is in different cities?
    For Example: Ravi works in a MNC and base location of employment is Bangalore but Ravi lives with his parents in Mumbai because he is working from home.
    Lets assume that Ravi receives HRA of 3,00,000 RS.
    So the question is can Ravi give the entire 3,00,000 RS to his parents as Rent?

    Thank you sir for the info but I need to know one thing. For Salaried doctors DA is calculated on Basic + NPA. HRA is calculated on basic only. So how do we calculate HRA exemption? If HRA doesn't include NPA but DA includes NPA, so is it justified to do the calculation including NPA?

    Sir my company provides me either hra or quarter lease.
    1. If I have availed quater lease then my company will pay rent.
    Can I claim exemption of this rent.
    2. If my actual rent is above than what my company is paying as ceiling for qurter rent then can I claim exemption for rent paid above the ceiling from my pocket.

    When you said rent has to exceed 10% of salary in order to get exemptions, did you mean the total salary or the basic+DA?

    Sir but the code on wages doc which is shared by you ,they have not mentioned that 50% will be the all allowance while make salary break up . They have only mentioned that HRA will not be the part of basic wages . I have official gazzate too. Plz do clear.

    Sir, my landlord is not ready to share PAN card, and as per new policy even if you give declaration against Landlord's PAN, we must provide Landlord's Aadhar. That is also not possible. In that scenario can I give rent to my parents and make a rent agreement against it?

    I have taken a home loan with my mother. The property owner is my mother and I pay the loan. She is a homemaker. In section 24 I claimed X amount and Can I take the deduction in HRA for the same property.
    -> For X property loan is taken and for same property Can I claim HRA and Home loan interest on same property.

    What if employer giving reimbursement of rent inlieu of quarters partly based on designation like in RBI,NABARD, OTHER Public Sector Banks, PSUs.
    Some times Net payable rent to landlord is 8k and employer sanctioned rent for 6K. Can I claim this differential rent we have to pay is 2*2,000=24,000.00 per year and .
    CASE2 if we and parents living far away due to job Nature and we are paying rent for parents/family rented house.
    Example my parents rent is 4,000.00 per month in my village totally 48,000.00 per year.
    Case1+Case2=24000+48000=72,000.00 rent paid by us.
    Can we claim this rent For ITR

    Is there any way to take this matter this tax department, as in other cities having HRA rate (8%), employee paying equal rent (which he received) have to bear tax out of his pocket..

    Mera Mankan Malik Kiraya Rs.10,000 Cash me leta hai batao HRA kese claim karu. Kuch bhi nahi de raha hai wo na Pan card, Na Rent Agreement (Rs.100 ka rent agreement banwaya hai), na hi rent receipt Kuch bhi nahi deta hai total black money.
    Kya kare any suggestion help me in this case.

    kya brother ko bhi rent pay karke exemption le sakte hai? jabki brother khud rented hai and me uske saath rahta hu? non salaried case me.

    I have a situation can anyone clarify.
    Let's say I am living with my parents and the home is owned jointly. My father is an employee and falls in a heavy tax bracket but my mother is a housewife i.e zero income. Can I transfer the rent only to my mother and file tax of rental income only for my mother and not show it on my father's ITR.

    Sir, If I do not have bank statement proof to claim hra exemption, I did payment in cash will it work, but I have rent agreement and rent receipt

    Sir hum sabhi bhai o ki documents me Father Name ek jeyse hai. (School certificate School marksheet me bhi ).
    Par pitaji ka voter id me name or surname ka spelling dusra hai. Pitaji ab Duniya Mein Nahin Raha ab Hamen kya karna chahie. Nrc list mein Naam Aaye iske liye kya karna chahiye

    sir form 16 me HRA coloumn main koi amount nahi dikh rahi he , aur Rent paid 180000 kiya he us finanacial year main . toh ITR main 180000 kaha dalna hain usper tax benefit kaise milega
