Depends, the second one is obviously looks illegal, the first one not that much, you can invest money into R&D which is more beneficial than paying straight-out tax but you are not evading the tax, because money is being spent on something else. The evasion probably refers to rerouting money sources to an offshore account / tax haven to pay as little to non tax and take the whole money out. If you are legally bound to pay taxes in your country for "x" amount of % and wire money to some other country or state just to pay less tax, then you know what that means but theoretically to some degree yea they might be very similar
