House absolutely HATED working clinic hours on this show. This is actually common, I’ve had doctors who have to work ER shifts to maintain their certifications to work in hospitals. So, part of his job is to do clinic rotations, and he did legit everything he could to get out of it. Being sued means he cannot take patients in the clinic until it’s cleared. He was loving every moment of this and knew from the start being sued meant no clinic hours and he also just enjoyed screwing with people. But yeah this was to escape clinic rotations for a bit lol.

But he’s also incredibly miserable and he’s very very hooked on pain pills because his leg needed to be amputated at one point and he refused so now he’s just trapped in unending agony and can’t really walk. He requires a cane. No matter what he does, he never gets reprimanded very harshly, because the hospital admin doesn’t want to lose the prestige he brings to the hospital. They’re world renowned because of House. He’s crazy and rude and superhumanly brilliant. It makes the show fun to watch. It isn’t realistic. You can’t have a doctor practicing medicine while actively in the throes of a very bad pill add1ction. He even makes his residents break into patient’s homes to do recon because he thinks everyone is a liar. It’s just entertainment.

If they can say it’s intentional done to harass or the like, then it could include sanctions though…who-hoo rofl It can paint the plaintiff in a bad light though to the judges&any potential jurors. High Frequency Litigants is the legalese for it, or commonly known as serial litigants. Vexatious Litigant is one who uses to harass. To avoid getting those labels to reduce the negative impact, one could space them out, make sure they have substance to the claims, &obviously not go with the same claims all the time. Some HFLs are legitimate though&have just been unlucky, the ADA results in some people becoming HFLs because of the Disabilities Act, but of course many of those are also frivolous&seen as a way for financial gain.

As someone who has no idea how it works in America…what are those papers? I keep seeing people being handed “papers” in movies and it’s handed to that specific person, why? Why not a phone call? An email? Why can’t he give him his own papers?

Thinking House will also refuse to treat him, House tells him to stay put and that he will drain the pus and run lab tests to make sure it isn't anything serious. House is dead on - Funsten returns almost immediately to serve a malpractice suit and House isn't surprised. He's also ready for him. He tells Funsten that he has gonorrhea and that House is duty bound to tell the state's medical officer of health. They will tell his wife so she can get tested. House says he would run another test, but he's not going to. He tells Funsten that since they're in litigation, he can't give him the test results, but it should be easy to prove he's clean - he just has to find another doctor to run another test.

Whether he could have it or not, his wife would theoretically not believe him saying it’s a false positive if she’s told by the state and his chances of getting another doctor SOMEWHERE to retest and confirm he doesn’t have it are slim bc he’s sued so many that no one will treat him. So he would have to consider dropping the litigation or call Houses bluff on the test results and hope he can find someone else to retest him so he can get the quick money he wants at the potential cost of his marriage

Also technically even though it's a show, The guy is not legally allowed to serve the papers for court himself he has to have someone else do it it's illegal to serve your own papers.
A lot of times these type of people try to keep the smallest paper trail possible so even though they are willing to sue they first approach with an intent to sue to try and get a quick settlement out of court and without court records. Basically give me money and I will sign that I won't sue you
Depends, I've served my own papers every time I didn't send it registered mail and haven't broken any laws. In my jurisdiction only family law stuff can't be served personally, civil is free game.
I think in most states it's an optional service for a fee to have the sheriff's office serve papers otherwise you do so yourself or have a process server do it.

No matter what he does, he never gets reprimanded very harshly, because the hospital admin doesn’t want to lose the prestige he brings to the hospital. They’re world renowned because of House. He’s crazy and rude and superhumanly brilliant.
It makes the show fun to watch. It isn’t realistic. You can’t have a doctor practicing medicine while actively in the throes of a very bad pill add1ction. He even makes his residents break into patient’s homes to do recon because he thinks everyone is a liar. It’s just entertainment.

It can paint the plaintiff in a bad light though to the judges&any potential jurors. High Frequency Litigants is the legalese for it, or commonly known as serial litigants. Vexatious Litigant is one who uses to harass. To avoid getting those labels to reduce the negative impact, one could space them out, make sure they have substance to the claims, &obviously not go with the same claims all the time. Some HFLs are legitimate though&have just been unlucky, the ADA results in some people becoming HFLs because of the Disabilities Act, but of course many of those are also frivolous&seen as a way for financial gain.
@@alanlvr36 They can actually do this. The courts can issue a Vexatious Litigant Orders, which requires the courts to approve any law suits before they can be filled. It's only issued in extreme cases, after warnings and other sanctions have been issued.

As someone who has no idea how it works in America…what are those papers? I keep seeing people being handed “papers” in movies and it’s handed to that specific person, why? Why not a phone call? An email? Why can’t he give him his own papers?

You can't serve papers in your own case because you the plaintiff have a vested interest in the service being done incorrectly - if you throw the papers on someone's trash can and say "I served the papers by hand delivery to their address", you can get the court to issue a default judgement without the defendant actually being notified of the lawsuit, which would violate the defendant's due process rights. The court may allow methods other than delivery of papers depending on local laws, but the point is that it has to be done fairly to ensure that the defendant is fully aware that they're being sued and has the chance to respond.

House worked out that he had originally had a small pus filled sac, but had decided to try to relieve the pressure with something like a nail file, which only made it worse. Funsten tried to deny it at first, then admitted it. House offered Funsten a Vicodin for the pain which Funsten happily accepted.
House then looked at the patient file and realized that Funsten lived 70 miles away from Princeton. When Funsten didn't have a reason for being in Princeton, House surmised, correctly, that he wasn't allowed to go to any closer hospital, probably because he was in litigation with them. Funsten denied it, or that he wanted to sue House, but House started asking him inappropriate questions because that would help a malpractice case. Thinking House will also refuse to treat him, House tells him to stay put and that he will drain the pus and run lab tests to make sure it isn't anything serious.
House is dead on - Funsten returns almost immediately to serve a malpractice suit and House isn't surprised. He's also ready for him. He tells Funsten that he has gonorrhea and that House is duty bound to tell the state's medical officer of health. They will tell his wife so she can get tested. House says he would run another test, but he's not going to. He tells Funsten that since they're in litigation, he can't give him the test results, but it should be easy to prove he's clean - he just has to find another doctor to run another test.

@@jasonmurdoc9533 they leave it open ended with this little “check mate” moment but I could speculate if it helps you close the chapter in your head: he doesn’t have gonorrhea but since John is an asshole, house wants to humiliate him so says since they’re in litigation he will report that John has it to the state and they’ll call his wife to let her know she’s been exposed. Whether he could have it or not, his wife would theoretically not believe him saying it’s a false positive if she’s told by the state and his chances of getting another doctor SOMEWHERE to retest and confirm he doesn’t have it are slim bc he’s sued so many that no one will treat him. So he would have to consider dropping the litigation or call Houses bluff on the test results and hope he can find someone else to retest him so he can get the quick money he wants at the potential cost of his marriage

Depends, I've served my own papers every time I didn't send it registered mail and haven't broken any laws. In my jurisdiction only family law stuff can't be served personally, civil is free game.
I think in most states it's an optional service for a fee to have the sheriff's office serve papers otherwise you do so yourself or have a process server do it.

So if he sued him, he can give him lab results, ultimately making the court case unwinnable for the jerk. If he ran second test, it would show he has no illness, so the stress would be from house, making him win the case.
