    One of the most haunting things was the absolute dismissive treatment of Misha’s claims simply because she’s not ‘pretty’ there used to be so many tweets putting Ali’s wife and Misha side by side and saying why would he harass someone who looked like this (misha) when he had such a beautiful wife.
    Just baffling.

      Also his interview on Ary to Mubasir lucman that I didn’t harass Katrina why would I harass Meesha. I was like dude try karta tau pata lagta tumhy. Udhar tau professionalism dheakni te na. Image jo bana na ta. Ali Zafar is cheap and oh my Lord his wife is living in denial.

      Quarantineedits 2020 💯 the absolute misunderstanding of the #metoo movement in Pakistan is a complete mess. Men really live in denial of the reality that most women face everyday. Initially I was ambivalent about Ali Zafar but his counter arguments and counter actions have made seem so guilty and I’m sorry I’ve lost all respect for him forever

      I don't think a girl, specially an actress, singer, would be taken seriously in our courts, in a case of harassment. In an environment where the judges have the mentality of making a girl marry her rapist and the lawyers, turning rape into zina, how would the girl prove that she was harassed. The argument can easily be diverted to her career, which in taken in a negative manner, specially for girls.In Meesha's case, the pics she has with Ali Zafar, show her consent, which would be enough to not only dismiss her charges but brand her as the bad woman, according to islam. Charges would be dropped and the man would go Scott free. A win win situation for men. As Amna said many women face harassment in the industry but do not speak up, as they know, they would be further tortured, with no hope of justice. This encourages men and hence we see more and more attacks on women.

      In this patriarchal society all costs are to be born by the women whether they are right or wrong
      Ali Zafar’s response even if he didn’t harass meesha was to the extreme and purposefully obstructed any safe space the both of them should’ve had for meaningful dialogue. Furthermore he purposely mislead public opinion that he WON a case which has yet to be heard

    These are two completely different cases - civil and criminal - which need not be linked to each other. As much as you been saying "technical aspects", these are exactly what as lawyers one look for. All laws are bound to have these loops which any counsel looks into. Now as much as it feels unfair Meesha did not have a fair hearing by Provincial Ombudsman, the point is that it does not have jurisdiction to hear this case, verdict which the High Court also supported. Now the Supreme Court is called to decide on whether it has jurisdiction or not.
    Social media trial is not even logical because most people are reacting on emotions or loyalty to the public figures. You may not have referred to anyone, but you have made out of the woman in this context is that of a poor, miserable person. Which she is not, mainly because she is not stopping her fight. Media trial is all about emotional push and who manages to gather more sympathy or who is more likely to convince majority. This is not how the justice system should work. Ever.
    The actual case. Which you have referred to at several instances, as someone who does deal with cases daily, I assure you technical issues are damn important. Something extreme as example to put my point forward, we can argue that a complaint of say a burglary can be said to be time barred because it is beyond a certain time. That does not mean that the story does not hold but the law needs some boundaries. Imagine after twenty years, someone pops up and say X robbed my ancestral house, which they may have but after twenty years no.
    Yet again, I understand the enthousiasme and interest in this case. However, the question which was rightly asked, what is the right route for women to take? Who do we approach if we want to report a sexual harassment at the workplace? Does the law about sexual harassment at the workplace need amendments to make it more accessible and broader than what it is at the moment?

    • @samraz6958
      @samraz6958 4 ปีที่แล้ว +4

      So if the sexual harassment is not at a place of employment or work related let’s say by a friend then what legal recourse does a woman have?

      I have nothing to do with Ali Zafar case, but I do want to share something. I live in the USA and was only trying to help poor people in Pakistan by connecting my employer donations with through AZ Foundation . In return, I was threatened by Meesha Shafi’s team claiming that I was using my employer credentials wrongfully and they started tweeting it by hashtagging my employer etc. My employer donated to AZ foubdation to help poor people, but these fake people could not let any good thing happen as they are so blinded by their egoes and personal battles! Allah ko jawaab nahi dena inho nay.
      As a lawyer, can you please tell me Is this a way to fight ur battle by using false accounts and wrongful claims against innocent citizens? If they can go after someone who has nothing to do with the case then I can only imagine to what extent they can go with their enemies.

    Today’s topic is very serious and sensitive. I do not expect any outcome of this case. We will never know who was guilty and who was innocent. Might is right in our country.
    Turkish actors are taking full advantage of their popularity in Pakistan and making money. 😊
    On a lighter note I want to talk about the trend of heavy, deep meaning dialogues written by some writers. They not only look unreal but get indigestible at times, like, in drama Mushq," ujla , chamakta, geira, sufaad jhoot". As Amma of Amma and TV, rightly put "ye jhoot hai ya washing powder ka add".🤣🤣🤣
    It seems Imran Ashraf at times, goes over board trying to impress viewers with his command on the language. Using too many adjectives does not add to a writing . In fact it makes it confusing.
    Someone shared a dialogue from Zebaish, “aap garam phulka kha le warna phulka meray se shikayat karay ga ke mehmaan ko thanda khila dia”. 🤣🤣🤣What is this. Can someone please explain the philosophy behind this dialogue.

      They are impressed by Khalil ur Rehman Qamar but he is a pro writer. If you are trying to make a washing powder ad or trying to use philosophy in Making tortilla then you are trying really hard to get attention of the viewers. KRQ's dramas' initial 5 to 6 episodes don't really have many dialogues. You have to lay the ground work first

    Thank you Hassan that was a very methodical and clear explanation of the Ali Meesha conflict. You are absolutely right all the dismissals have been on the technical ground that it was not work place harassment hence courts will not hear the case. No body said Ali Zafar is innocent. You hit the nail on the head by raising the question that a woman who has been harassed has no legal recourse and place to go. Honestly speaking Meesha is very brave and crazy to take up a fight which is so hard to win. And that too with the likes of Ali Zafar who is so well connected and with mass popularity. Meesha probably also did it because her Canadian immigration had come through and she knew she had a safety net. As Amna rightly pointed out other prudent women in the industry have just kept quite about the harassment they have faced because they know what an uphill and excruciating battle this is. It is clear that Ali is guilty as charged. How big a crime that is, is open for interpretation.

      @salsbeelshaukat2407 4 ปีที่แล้ว +1

      Ali is not guilty as charged do some research on the defamation case and see facts presented there, he presented 13 witnesses from the alleged jam session two of which are women and they all testified against her even meesha's school frnd testified against her and the former manager said she has a history of blackmailing people.

    • @samraz6958
      @samraz6958 4 ปีที่แล้ว

      I know harassment cases are very difficult to prove especially against a powerful well loved figure. But being a woman in Pakistan who has been physically harassed in public places and have just brushed it aside like countless women do everyday I find it very easy to believe Meesha Shafi. I am a fan of Ali Zafar’s work but I know he’s no angel or pious man and squeezing a woman he has easy access to is not something I’ll put past him. I’ve never been a Meesha Shafi fan but in this case I know she spoke the truth. I am of course no court of law and this is my personal opinion.

    • @salsbeelshaukat2407
      @salsbeelshaukat2407 4 ปีที่แล้ว

      @@samraz6958 If she spoke the truth why is she hiding from the court. The defamation cases are supposed to end in 3 months(90 days) but it has been prolonged by the delaying tactics of meesha's lawyers she even got find 10000 for unnecessary delaying to submit the reply and she
      had an hearing on 28th of this month for being cross-examined but she didn't show up despite being in the country for work and neither of her witnesses. Not everyone has real story some use it for personal grudges to settle the score and its quite evident in this case if u care know the facts rather than being an emotional judge citing to your own experience.

    Finally for the first time some talk show talking about case merits and technicality without any biased ness. The provincial ombudsman rejected the case on the merits of employers and employees situation as the 2010 sexual harassment act doesn't include this merit. So it was technically not taken in account not that Meesha lost as Ali Zafar claims.
    And I can prove my claim
    If you watch Ahsan khan show where Ali continuously said he "won" the case. Which is a false claim and can also be taken in court like he keeps pushing Meesha for defamation cases.
    I think Amna it wasn't the workplace issue it was rejected on the basis of employer employe situation.

    Given our social context, we kind of think that since women in the media industry have such a different life style in terms of socialization with men that they should not be complaining. However, the question is that of consent. Meesha may let one friend kiss/hug her but not let another do the same. The fact that meesha hugged one male does not mean that all other men are allowed to touch her. Maybe Meesha is not telling the truth but the fact that she wears scanty clothes should not make her allegation any weaker.

Also r u a child, if u haven’t seen or experienced it, it doesn’t exist or happen to women who also prescribe to all Islamic teachings. Islam it self is open to many interpretations so who’s to say Islamic teachings are strictly those you set forth? News channels should educate people about all of these legal official places that one can go to for there problems.
