      Nick Nitro - not to rain on you, but there is a difference between an anonymous call and a credible witness who was identified as the reporting party... one carries little weight, the other carries a lot more legally... hence why its important to determine if the reporting party willfully identified to dispatch when making the call, or if they were coaxed into giving information which may not be accurate thus different levels of response must be taken as a result of the lack of credible information... and later in court all that weighs too... its why in so many of these videos we need to determine exactly who called, and if they were merely an anonymous complaint to show the officers actions were unwarranted since there was no CREDIBLE witness making a complaint and merely an anonymous call which may not match the facts presented and requires due care to not over react... aka, swatting on homes, folks getting detained for trespassing without someone being a credible witness, etc etc... from big to small scale...

      @@Harpazo_to_Yeshua Liberty and Justice - absolutely "anyone" can call, hence my statements about what makes a reporting party CREDIBLE or not and what caution officers should use based on knowing if there is a credible party or not reporting the information... for legal reasons this is critical for officers especially, because the actions they are legally allowed to take change, and yes there have been instances where people have called in false information to get officers to react a certain way towards someone, but if officers acted that way without following the legal requirements to make that person CREDIBLE such as identifying them without any angst or refusal then its a whole other game in the court room... I did not say they can blindly go arrest someone based on words on the phone either, so please don't inject that as my statement, but it changes the legal ability to detain to investigate or merely make it a consensual encounter where they cannot detain until they witness direct actions...
      lets use a common encounter auditors have as an example...
      in many videos we hear companies claim the person is trespassing despite being on a sidewalk the whole time... if a CREDIBLE witness called and gave their information while making that statement, believe it or not the officer CAN legally detain that person based on the credible witness making the accusation, giving the officers their qualified immunity and placing legal blame on the reporting party for any lawsuits for false and misleading information... BUT if the reporting party is NOT credible meaning they refused to give their information or the dispatcher never solicited it and its just a call for service to come check that out, then the officer has no legal justification to detain the person based on that call because there is no credible witness to place the legal blame on and its hearsay, hence what the original topic of this thread was referring to in essence, so now the officer can ONLY have a consensual encounter legally, absent them witnessing directly any criminal action...
      you see how subtle but critical this changes the legalities as well as party to blame? this is why its so important for auditors to get the 911 calls, get the dispatcher information, to see who in the chain of that information is legally liable based on the actions taken place over the entire event... in many cases it will not be the officers believe it or not, it will in fact be the legal liability of the company and employee who called in the false claim through their own ignorance that caused the officers to take legally allowed actions in detaining someone for example... most auditors don't think this through and its a giant problem when they claim its an unlawful detention under the assumption it is, without being able to validate that, and thats why several auditors despite breaking no laws still got arrested and convicted, because of this subtle and important difference in legal standing given to the officer as a result of what was considered a credible witness...
      the legal dance in court is a very difficult one, the last thing folks want to do is make assumptions about whats been reported to an officer and what he legally can do, because as I have found getting transcripts of calls and information many of them were legally detained, and the fault is solely based on the reporting parties incorrect legal knowledge, so the department is free and clear and the lawsuit belongs with the jackass who doesn't like being photographed from a sidewalk and made a false call about trespassing...
      P.S. and everything I have said applies to other more serious scenarios, like reports of someone with a gun or shots fired etc etc, it changes the force and legal protection officers have when thats a credible witness versus an anonymous person, thats why dispatchers try to get the names and information of ANYONE who calls because of how critical that applies to the actions an officer can legally take on scene without witnessing it direct...

      @@nicknitro4420 Mick Nitro - do you not comprehend what I am stating, I'll be more than happy to demonstrate how what I say IS the reasonable suspicion criteria we all demand, it hinges what I seemingly have to keep repeating, a CREDIBLE witness, someone making an accusation, is identified by name willingly, and thus can be held accountable for actions officers take as a result of that information... the articulation and objective facts you want are the CREDIBLE witness making the claims a criminal action has occurred, its literally the same thing officers act on if I call and say my house is being broken into and they act upon that when approaching the home that its being broken into based on my statements, an officer doesn't have to witness the person breaking into my home, nor witness a person trespassing, they merely need a CREDIBLE witness who makes the accusation and then they act within the scope of the law allowing them to detain someone to investigate these actions... this is how officers get qualified immunity, by passing that blame to the CREDIBLE witness who now becomes legally liable for the officers actions should they turn out to be unlawful because the person made false claims...
      in most of these instances, officers have qualified immunity because others made false claims, and for that auditors would have to sue the party making the false claims not the police... however the actions an officer can take during this detention when legally justified, is limited, crossing those lines despite a credible party making an accusation, now are the fault of the police and not the reporting party... you see how we can have multiple parties to blame for the officers actions, in one scenario the officers can be at fault legally, in another the reporting party can be at fault legally, but most auditors and folks who respond in these comment sections act as if police are always guilty and at fault, based on their limited knowledge of what they saw in the video without taking a moment to pause and reflect the officers might have received falsified information which does not make them guilty but the party calling is who you need to sue...
      but to wrap it all up, it all goes back to that call for service, and if the person is CREDIBLE or not, if officers take actions on an anonymous person they can get in big trouble REAL quick, but if they have a credible person making a criminal accusation, they have a lot of leeway in their permitted actions to hold you now...
      so when you say they need reasonable suspicion nobody is arguing they don't, however I am pointing out they damn well might have it and you might be unaware because we know no crime has been committed, however someone HAS indeed alleged there was a crime, thats the party who is at fault, and who you sue... but auditors and the fans need to pause and reflect on all this, the officers very well MAY have what we all demand, despite us all watching the video and knowing no crime has been committed, the officers may have a legal right and not be the problem in this scenario... nobody EVER seems to consider that though...

      Hull was pretty decent, and honestly Chief Kilpatrick was pretty reasonable. He was wrong to threaten to arrest him for arguing, but it appears he was trying to prevent a possible immanent escalation between two people whose stories he didn't know yet, and backed down nearly immediately allowing Hull to step in and calm the situation. He then offered information about the call and assistance. I hate to defend any cops under any circumstances, but these guys, at least as far as can be told by this video acted as reasonably as could be expected under the circumstances.

    The only other call that WTPD received that day was to help a kitten stuck up a tree. You see how excited the Chief was to finally (after many years) use his policing 101 techniques. Now that the "disturbance" crime is solved WTPD can go back to snorting donuts and waiting for the next call from dispatch on kittens. WTPD = 🐷🍩
