He was charged for illegally recording a different person. I believe the DA refused to charge Jeremy with recording Jennifer because she stated she knows he always records people and lies about it. Thus, she is in a way informed and warned that she can always be recorded whenever he talks to her.
That's not how it works. Wiretapping applies to recording or listening in on a phone or communication device, hence, "wire and then tapping it or listening". State courts have ruled that you have a right to privacy on a closed circuit phone. If I have my phone out or in Jeremy's case clipped like it's a body cam, it is YOUR DUTY to protect your privacy. Jeremy was charged for the phone conversation because the guy was on a phone in a call he meant for Jeremy, so recording requires consent. Jeremy, trying to be slick recorded the call with his other phone thinking it was a loophole to wiretapping. When I call you on the phone, I'm calling you specifically which means I have shown no intent, risk or understaning that it will be made public. I called you, therefore the call is meant for you, not public consumption. Also, I have no way of knowing or having a strong indication that you might record our telephone conversation, when I called a number meant just for you and I cannot see you. Now he could be charged with eavesdropping if either he or she said or asked "hey do you have your phone on you, do you mind turning it off?" Another way eavesdropping could be applied is 3rd party. Say for instance we are at a party, I come to you and say "hey mind if I have a word with you?" And then I lead you to another room away from people and then someone comes to the door and listens or puts a recording device against the door to record the two of us. In this day and age it is common knowledge that people have phones and phones can record conversations, therefore, it is not eavesdropping. Now, if you take steps to protect yourself and had Burton asked "okay is your phone off?" Even then, it's a big if. Some states even with two party consent courts have ruled it is not a crime to lie or record in public and we only have a "reasonable expectation of privacy" therefore, you should know that speaking candidly to someone knowing they have a phone or recording device in their possession, you took the risk and they, the other party has no duty to inform you or ensure your privacy. Now if it was in her house, bedroom or bathroom, that's something different. She is in Dewitte's car and phones are visible, so if she didn't want private things getting out, she should have taken drastic steps to show she did not want to be recorded or risk it.

He was charged for illegally recording a different person. I believe the DA refused to charge Jeremy with recording Jennifer because she stated she knows he always records people and lies about it. Thus, she is in a way informed and warned that she can always be recorded whenever he talks to her.

That's not how it works. Wiretapping applies to recording or listening in on a phone or communication device, hence, "wire and then tapping it or listening". State courts have ruled that you have a right to privacy on a closed circuit phone. If I have my phone out or in Jeremy's case clipped like it's a body cam, it is YOUR DUTY to protect your privacy.
Jeremy was charged for the phone conversation because the guy was on a phone in a call he meant for Jeremy, so recording requires consent. Jeremy, trying to be slick recorded the call with his other phone thinking it was a loophole to wiretapping. When I call you on the phone, I'm calling you specifically which means I have shown no intent, risk or understaning that it will be made public. I called you, therefore the call is meant for you, not public consumption. Also, I have no way of knowing or having a strong indication that you might record our telephone conversation, when I called a number meant just for you and I cannot see you.
Now he could be charged with eavesdropping if either he or she said or asked "hey do you have your phone on you, do you mind turning it off?" Another way eavesdropping could be applied is 3rd party. Say for instance we are at a party, I come to you and say "hey mind if I have a word with you?" And then I lead you to another room away from people and then someone comes to the door and listens or puts a recording device against the door to record the two of us.
In this day and age it is common knowledge that people have phones and phones can record conversations, therefore, it is not eavesdropping. Now, if you take steps to protect yourself and had Burton asked "okay is your phone off?" Even then, it's a big if. Some states even with two party consent courts have ruled it is not a crime to lie or record in public and we only have a "reasonable expectation of privacy" therefore, you should know that speaking candidly to someone knowing they have a phone or recording device in their possession, you took the risk and they, the other party has no duty to inform you or ensure your privacy. Now if it was in her house, bedroom or bathroom, that's something different. She is in Dewitte's car and phones are visible, so if she didn't want private things getting out, she should have taken drastic steps to show she did not want to be recorded or risk it.
