      minimum sentence is 25. Likely to serve in the area of 30-35. Meaning he will not be an old man when he gets out (47-52 years old). I would put money he would be arrested again within a year.

      This is Michigan, plea deal was guilty pleas to 2nd Degree Murder, Armed Robbery, and Conspiracy to commit armed robbery, felony weapons charge, and a misdemeanor fleeing charge. Though it is possible that he would only serve the minimum, it is likely he will serve somewhere between the min and max. I guess we can always hope for a good shanking.

      i totally believe marijuana should've been federally legalized long ago & certainly has medical benefits in plenty of cases. But if you've smoked enough grass to convince yourself cannabis just showed up 30-40 years ago, then don't try & convince me it's "harmless".
      That said - the prosecution & incarceration of marijuana users has done far more damage to ppl & their families then the drug itself ever has.

    I have seen numerous contempt sentences of 30-60-90 days, but I have never seen anybody serve more than a day or two.

      After you drink and drive the 1st time it should be a felony. I’ve had 2 drunk drivers ruin my life. The 1st totaled my car. Over 20 years later I still have back issues. The 2nd totaled my parked suv and 2 other cars while I was on chemo and not working. A long sentence is the wake up call they need.

      Pretty much every "major" crime comes with a ton of lesser charges, you just aren't normally privy to them. Investigators file every possible charge as it's not up to them to decide what should go forward or not. Prosecutors decide which go forward, and some get dropped during plea bargaining between both sides, but that's after bond hearings and such so they're still in place when the bond hearing that was seen in the video occured.

      I always feel the contempt rulings are too light. 100 days for threatening a judge twice? Dude should get 2 years. Can only assume the law restricts harsher penalties for contempt. Still too light.

    I drive a school bus with students on it that are… we’ll call them emotionally, socially and legally troubled. The last kid reminds me a LOT of one of the students on my bus. One of the school rules involves proper attire, and that attire being worn properly. The student seems to think that as soon as he is on the bus he is no longer in school and promptly “sags.” He has been removed from the bus more than a dozen times because of this. Last week he thought he found a loop-hole by going to his seat and taking his pants completely off (he was wearing athletic shorts underneath). Needless to say, he won’t be on the bus for the rest of this week. He is also a few more violations from being held back another year, which will also be in direct violation of his probation. I have tried to give him some leeway, but his overall attitude and disregard for rules and authority leave me little choice.
    The biggest problem I have with it is he is a complete coward. He manipulates those around him to actually do the dirty work, and then pleads innocence despite all the video recordings and witnesses. If you confront him directly he cowers and mouths off. Since he is nearly adult age, and has a significant number of previous convictions, if he violates his probation he will not go to another cushy school or even juvenile detention, but will go to the state penitentiary. I mean he should be graduating High School in the next year, but is still in the fifth grade due to expulsion and suspension. I think that because he has effectively “gotten away with it before” he doesn’t think that anything will happen. Unfortunately he is one of those personality types that within 3 months of incarceration either ends up mentally broken for life, or their life is cut short.

    Well from where I come from, you spend 72 hours in suicides or withdraw watch. It's 23.5 hours in your cell a day. I've been there once, some people just can't take it. It gets a lot better after the 72 hours.

    I wholeheartedly agree with respecting the Justice System. However, there are thousands of different definitions for the word respect. Half of these weren't "disrespectful" but actually power tripping judges taking the law into their own hands.

    Judge McBain is awful. This video shows a 4 minute segment of the defendant acting in a particular way, which shouldn't have happened, but it should include some context about who this judge is. He is egregiously and unethically pro-prosecution. The Michigan Supreme Court had to create a new standard to assess judicial impartiality just to address his behavior on the bench, when, during trial, he attempted to undermine a defense witness's testimony and credibility in front of the jury. Literally not his job to do that. In February of last year in another case the MI Supreme Court referred him for judicial misconduct and wrote in their opinion that he needs a different job because he's not suitable for the bench. In that case, he had sentenced a defendant to 70 years in prison for committing a "murder" that the jury acquitted on. She was found guilty of other, lesser charges, and he, I guess feeling the jury got it wrong, gave her a sentence far in excess of the law because he straight up said that he was going to sentence her on the murder charge anyway. When the Supreme Court reversed the sentence and ordered new sentencing that complied with the law, he did it again and Supreme Court had to not only reverse it again, but ordered his removal from the case. He a tyrant and an awful human being.

      Well let's see, according to you a deadly weapon is comparable to a drug which not only has medical benefits but has no adverese or serious health effects, unlike for example alcohol which is legal in all 50 states and will kill you if you drink too much of it, or long term overuse will cause damage to the liver, there's no legitimate argument against legalizing maurijauna use, especially not in regards to emperical data

Its only purpose is to hurt people, either wrongfully or in self defense, but the right to possess it carries the risk of other people’s rights, to life liberty etc being violated. No one on the planet has ever gotten more violent after they smoked weed. That’s like comparing a serial killer getting out of prison to Nelson Mandela getting out of prison.

      That was far more of a civic protest. But the judge also was clear that he just had to do his job and if he didn't like it, go talk to the legislature.
      So, all round no huge deal from either side.

    I don't know how to feel in cases of killing someone while driving and injuring another. I mean sure she should go to prison, but at the same time it doesn't help the victims in any way.
    I am left wondering if it won't be a better sentence to have her work and pay child support for the 5 children until they are 21.

    I'm not an American, what does it mean when a defendant gets a sentence 25 to 52 years? Does that mean that the defendant doesn't have the right to ask for parole until at least 25 years served? Or does that mean that the defendant's sentence is first time reviewed by court automatically after 25 years and then it gets extended up to the maximum of 52 years after which the defendant is completely free?
