  • The plaintiff says he hired the defendant to replace the shutters on his house and paid him in full, but then he only completed half the job. He’s suing him for what he’s owed. The defendant says the plaintiff ordered shutters that were the wrong size and wanted the defendant to rehire all his workers and go back a second time to install them for free.

      ​@@ccrow86 I think Curt Chaplin is the narrators voice-over... he is the younger of the two who do the exit interviews along with the original 'court reporter' Doug Llewelyn (I believe that if Curt Chaplin is on screen, it indicates the clip is pre-2016). Harvey is the 'legal reporter' and the only one of the three who's passed the bar.

      The plaintiff looks prosperous, owns a bigass house and is suing for $150. How miserly can you get? He was even too cheap to pay for the contractor's trip to Lowe's to pick up materials. The richer some people get, the piggier they get.

    Fair ruling by JM. The plaintiff would have saved everyone involved the trouble had he just used that money to buy the correct ladder. Plus, had the situation been switched he would have wanted the same as the defendant for his time. Sometimes its important to imagine yourself in the other persons shoes. Self reflection is something we seldom use enough of and usually from my own experiences it saves me from letting my emotions rule over what’s right and what’s right here is the men being paid for their time.

    Completely fair ruling, if the customer messes up then that's their fault and not the fault of the contractor. To be honest, if it was me, I would have actually given the guys a tip for my mistakes and for being understanding and willing to come back out.

    7:55 A lot of people think it's just time on the job site... That is not the case. It takes time to pick up the parts at the warehouse, it takes time to drive to the site, and It takes time to load and unload materials.
    I did a job that I quoted $50.00 to install a glass shower door. It should've taken less than an hour to complete, but with the missing parts and the specialty tools I had to purchase, that $50.00 job cost me 150.00 with travel time, materials, and part runs. That was on me for thinking It would be a simple install. I wasn't told it was a new shower door setup!

    This defendant is just lucky enough to be alive looking at his disposition here after having a heart attack more than anything else. Men take care of yourselves first and foremost. I cannot state that any more emphatically. Milian's ruling was more than fair here.

    Sorry but working in the construction field, the contractor has to pay his workers while on site regardless of what they do on site. It was the Plaintiff's fault for having the incorrect shutters, he should pay him for his extra time. He already went through the bidded 2 hours.

    Never had anything to do with shutters in my life nor am I trained in any kind of construction work or woodworking whatsoever.
    Just looking at the photo even a complete amateur like me, can SEE that the lower shutters are quite a bit longer than the upper ones…!
    Besides that, still being that uneducated amateur that I am, I would think that whenever someone’s going to do a project like that, they would ALWAYS measure each window before ordering new shutters!
    Anyone who chooses to stay on the ground and simply trying to ‘eye’ the sizes from there, is just plain LAZY!
    What a goon…!

    It sounds like the defendant had been very reasonable with the plaintiff during the job. The defendant went to Lowes and got the shutters. He drove the distance to get there and to this clowns house. The plaintiff is absolutely ridiculous.

    The plaintiff is crazy azell if he thinks he can make a mistake, and then these guys have to come back to correct HIS mistake, for free. Even if the defendant had agreed to that, he has someone working with him, who I’m sure he has to pay also. The time that he wasted could have been used on another job. And him harping on that dang drill bit was just plain annoying. So what you “let” them use yours. It was to benefit you anyway. It’s a stinkin’ bit, what do you want…a cookie? 🙄

    customers who don't think your time is worth anything aren't your customer base.
    So many people seem to think it's only worth the cost of the actual labor without regard to what it takes to run a business, have employees, have insurance, have a license, have workman's comp, have equipment ... basically do the things they can't, but they only want to pay the company for the labor time and what they think it's worth are the bane of every small business owner.
    To expect them to run your errands when you've made a mistake in ordering, pick up and deliver the correct item, eat the gas, labor cost and time and then come back and finish the job with the correct items for no additional cost ... pfft, no.
    Business owners, especially small business owners need to do better where it comes to picking their client base and say "sorry, can't help you" to people like this man. He was trying to get everything done as cheap as possible and is willing to cheat someone to do it.

    Americans have become a new level of entitled. As a business owner mysel (gem dealer and jeweler), I deal with this type of thing all the time. I have clients who think I should make them designs for free (or additional different designs) or give them 1hr consultations for free or will have me write them an invoice and then along the way they will make several major changes and think the price shouldn't change.

    Seems many people are hiring unlicensed handymen to do jobs on the cheap, then eventually end up paying what they would have paid a professional in the first place. The jobs are either incomplete, not done correctly, or there is a dispute over the SOW. Seems people are allergic to contracts.

    I don’t agree at all. The plaintiff should have paid for gas and mileage for the return trip but to pay a total of $600 for a $300 job is BS. Also, it shouldn’t take an hour to load tools and a ladder. I feel bad that he had a stroke but the client shouldn’t have to pay just because it takes him longer.

      He was going to finish the job for $150, not another $300. That covers the worker. And if he had a stroke and is doing the packing himself then yeah it takes time. He wasn’t charging hourly he was just saying that it’s not a quick drive over like the plaintiff was claiming.

    Ehh, now I've seen her many times make the contractor give back the $$ if the job wasn't done. The plaintiff should have received some money back. I know damn good and well he didn't pay his worker no 150 for the 2 hours of work 😒.

      What in the world are you going on about. He spent the same time maybe more on the client's mistakes as he would have doing the job. His worker needs to be paid for his time regardless and the business has a right to make a profit. If the job wasn't done because of a delay in traffic or the contractors truck broke down that's a differ scenario.
