Happened to me. That's the first thing running through my mind. They can't get away with it. Their property can be put on lien or they can serve time. No consequence is unacceptable
They are punished in Oregon with hefty fines, license suspension for 1 year, and the only option to drive again is if the uninsured party can provided proof [of only a few particular types] of hardship, then they are allowed to apply for ssr2 that grants a license after proof of auto insurance, and ssr2 license restricts when and where they can drive between 1-3 years. Unless they've changed the laws since 2010, basically they're allowed to drive during the daytime only for a job or school, and any other use means they are stripped of the inch they were given, bigger fines, and possibly jail time.

Keep in mind Flordia is the only state in the country that you can opt off Bodily injury for their insurance. It is still required though to maintain property damage liability.
It's so easy for the police and motor traffic enforcement to find out who the uninsured drivers are now. They have special plate cameras that can run your plates and find out if you are uninsured on a central database. The police waste no time catching up to you to make a traffic stop to verify if you lack proper insurance. Then you get your car immediately impounded and slapped with a $10,000 fine. No need for so many uninsured drivers on our roads unchecked.
that will not work this country urban design is backwards that you have to drive a car to get simple mundane stuff and being force to drive a car everywhere means that you have people that cannot afford to drive a car if you want to completely stop people from driving uninsured the United States need to invest in walkable urban design and public transportation.
They don’t get a $10,000 charge. Just had some shmuck do this to me the other day and they didn’t even ticket her and she totaled my BMW. These people wouldn’t do it if they actually paid $10k
One thing I would like to add on to make sure if you have liability insurance to add on uninsured motorist property damage. In this situation that coverage will be extended over to you. Normally deductible for this coverage anywhere 1k to $0. Most common is $250
Thanks for this video. My daughter was just hit by an uninsured and no drivers license young person with passengers in his car. My insurance Co. had my car towed to dealer for estimate and claim is underway. No police report released yet. Car looks totaled, but if not, I’ll be out 1k for deductible. I do have underinsured and uninsured coverage with collision. This is a perfect example of “life’s unfair” and the victim being punished for the unaccountability’s of others. I was hit by a uninsured driver on 03/25. The next day I found out he was excluded from the insurance policy. The vehicle seems to belong to a relative. I don't feel I should be liable for the insurance deductible..

@LawFull I Bought a beautiful used Toyota tundra with all the options I wanted, low milage, one owner, and taken care of just as I would have. Less than two months later, an uninsured, unlicensed driver ran a stop sign, and I did everything I could but not stop in time. I had many witnesses back up my story with the police, and I have the completed report on my side. I filed with my insurance, but I will still be out my deductible, and I've missed a weeks worth of work with out a vehicle, as well as make general running of errands hard, with one less vehicle for me and my family. Can I still sue the other driver, even though I've also filed on my insurance for uninsured motorist, for for lost wages and to cover my deductible? Or at the very least, make sure the other driver does not get licensed any time soon? I still don't know if my truck will be totaled or not, and this all just has me steaming mad at this lady.
Sorry to hear this. Sure you can sue her but for what? If she doesn't have insurance chances are she doesn't have any assets or the money to pay you. So you will probably be wasting your time. Your insurance may go after her for reimbursement too.... Really sorry you're dealing with this b.s. Uninsured drivers are such a hazard.

I am in Chicago. I stopped, for less than a minute to check on my baby and continue driving, when I backed up from the car infront of me to get myself back into traffic, I looked down to put my car into drive, I heard someone slap my car. I got out and saw an older gentleman getting up. He said that he was fine but still wanted to get checked out so he was taken to the hospital. My husband was buying insurance that day as we had changed our work and car insurance 2 weeks ago and so technically, I didn't have insurance coverage at the time of the accident until about half an hour later when my new insurance kicked in. There was a camera above me and I am certain I did not make him fall because I backed up very slowly. Should I get an attorney?

Hey so an uninsured drive hit me after blowing a stop sign and totalled my car when I was driving straight down a busy street. He wasnt insured and was driving straight. He was driving his aunts car who was insured. The police report didnt mention the fact that he rolled a stop sign but it's clear that it's his fault. His insurance is charging me 40% liability saying it was my fault too for not driving cautiously when I clearly was driving the speed limit and hit my breaks the instance I saw him. My insurance is 1 sided and his aunts insurance is unique insurance and they are trying to scam me. What do I do?

Always file the claim with your insurance company and have them fight the other insurance company - it’s what you pay them for as part of your collision coverage
Hi Daryl, well, most people who don't have auto insurance don't have much in the way of assets. However, if your damages are modest, you could sue him or her in small claims court and see what you can recover. But I'm skeptical it would be very successful... Sorry you're going through this.
An insured motorist backed into my driver side door causing a huge dent, and my door doesn’t shut properly. Well, if he does not have insurance, you can 1. file a lawsuit against him 2. file with your own insurance to get your damages covered. There aren't many other options unfortunately I'm sorry to say.
Recently I was hit , another guy in a pick up truck hit me head on and my insurance told me my car is a total loss , I called the other drivers insurance to see if he filed a report and he didn't a day later I find out his insurance was canceled months ago... he gave the police false information about insurance on his truck when the accident accured . I don't know what to do at this point he has no insurance... not sure if its worth the matter to take him to court for my medcial bills ,my car damage , and injuries... Most states won’t allow that to be written - it is only a benefit from some insurance companies depending on the claim history and longevity of policy. It is not an actual part of the stated policy. You can try to have the lowest deductibles possible - some states will still allow a $0 comprehensive deductible to be written.

Hi, you can but in reality if he has no insurance he probably has no assets to go after...... So you should see if you have uninsured motorist coverage and go after your own insurance for compensation/reimbursement.
I'm in IL too, someone with minimum coverages hit a car, who got pushed into another car, and it chained to 4 cars! My sons car got damaged and we only had liability so who knows if we'll even get the repairs paid for.

I was recently rear ended by an uninsured, unlicensed driver with no license plates in the state of New York. His car got towed at the scene. I am in the process of filing. I was rear ended pretty bad by an uninsured motorist. My vehicle is totaled. The police came and did the report, the other driver had already left. The police ran his license and the license plate and told me that the guy who hit me is not listed as the owner and the owner is a dealership. Hi Mark, sure you can. But I wouldn't. I'd file through your insurance. Since you both have the same insurance, your insurance company might waive the deductible. Then let your insurance go after the guy for reimbursement. You chasing the guy for the money will be a big aggravation and not worth it. In my opinion at least.

Got in an accident yesterday while sitting in the drive thru lane waiting to pay and got rammed in my rear. Long story short they didn't have insurance at the time but did decide to pay for the insurance 30 minutes after the accident. But now I'm stuck paying my deductible, and rental as well. Yes - file with your own ins co. If they are trying to pay after an accident occurred, chances are the ins co will figure it out and may deny the claim. So sounds like you're doing the right thing....
You should report it to your insurance company. Hopefully you have coverage for it. It could cause rates to go up and it could cause you to pay your deductible but thats better than paying for the damage out of pocket I assume.
I recently got rear-ended by an uninsured motorist. I took down the VIN and License plate info. She failed to show me her insurance. My insurance company said they are going to approve the repairs on my car. Once my claim is done, am I still able to go after the uninsured driver? Hi, if you're just talking about property damage - then I'd have your insurance make the repairs to your vehicle. Then, let your insurance go after the other driver. Why would you want to? Nothing but aggravation, will likely result in nothing and be a waste of your time. Let your insurance company attempt to get reimbursement from them. In my opinion at least.
i was recently hit by another driver, they are completely at fault. they admitted it verbally. however i filed a claim against their insurance. and the adjuster has said there is a issue with the coverage. they will not state what the issue is. i assume the driver was not on the insurance since the insurance card had the registered owners name on it. whom was not the driver at the time. in addition i cannot file a claim through my insurance as i only have liability so my insurance wont handle any claim processing. i have made a letter of demand. demanding a written explanation of the insurance company’s reasons for claiming there is no coverage (Coverage Issue), including references to the specific policy provisions that limit coverage. Is there anything else i can do well waiting for their response? Should I rush to file suit against the possibly uninsured motorist? i do believe they have the funds to pay if sued.
You will be provided with a formal written explanation when the claim is denied - in that letter the claimants insurance company will state specifically why there is no coverage for the claim. Many times in cases like this it is because the claimant (the other guy) has a non-standard insurance policy because they are high-risk, on a work visa or other temporary immigration status that provides no driving history, unable to find standard coverage because of a DUI etc, there are quite a lot of reasons and almost none of them good for why their policy may not provide coverage but it is usual that non-standard policies only cover the named driver in the named vehicle and no one and no car else unlike a standard policy from companies like AllState, State Farm etc Expect a letter from their insurance company stating formally that the claim is denied. Also, and this happened to me in the state of IL, expect their insurance company to also notify the state as this will be a violation and can usually be criminal. This is why if someone hits you and they have Progressive, Geico, General, you should be scared - those are companies for bad drivers and financially irresponsible people
Morning - did you file a claim against their insurance to get compensated for your damages? Some states like CA may restrict your rights to recover. I would strongly recommend you consult with a local attorney about this matter. They'd be in a much better place to consult with you than I would.

I was rear ended by an uninsured motorist so my uninsured motorist portion of my policy determine the car was totaled. Here is where I'm taking a loss, a month prior to the accident I just had the vehicle's paint and body work restored for about $5000. The value of the car is only roughly $6000. Of course my intent for restoring the car was not to add value since I just wanted a forever car to look nice and new. My insurance of course will only pay out up to the value of the vehicle minus my deductible. My question is how likely would a court side with me if I sue the uninsured motorist for the recent repair cost to recoup my loss or am I just SOL and have to just accept the market value of my car?

My truck was parked and some unlicensed and uninsured driver destroyed my truck and she is declining to pay. What do I do? She gave the police a expired insure information so we didnt file a police report thinking it was all good until we called their insurance the next morning. Hi, two choices: 1. file a claim under your own insurance company. They then may go after the defendant for reimbursement. 2. If you don't have collision coverage, you may have to file a lawsuit against her. Problem is, I don't know any "property damage" attorneys who would file a lawsuit in a property damage only case. Thanks problem is that if I file a lawsuit the person is not obliged to attend because she doesnt have a driver's license. Also she is refusing to return calls regarding coming to an agreement. I was told that I may have to cover my own damages.

I live in an apartment building 1 block away from 2 well known local bars (small town). Both of my vehicles were parked out front with several others in our parking spaces for the apartment building. A drunk as piss local woman (who works at one of the bars & is a local police officers daughter) drove drunk down my street and crashed into both of my vehicles and totaled them. She than left the scene in her car and crossed a bridge where an officer followed (he has passed the scene about 2m after it happened but did not see accident) and pulled her over and arrested her. She got charged and released due to covid. cops are keeping the whole thing out of the papers. she had no ins or drivers license, was prob speeding, was drunk as all hell, treating cop like crap. idk what happened to her car impound or not. i didnt have uninsured motorists coverage but i did have regular insurance on my other two vehicles. i dont know what to do. im self employed and my vehicle is how i get to my jobs. everything that ive read of or heard basically says im screwed - and looks like because of covid she isnt even going to go to jail for this. because there were no ppl in my cars the police are acting like it was a nonviolent crime.
Hi, it would not be uninsured motorist per se that you would use. Do you have collision/comprehensive coverage on the vehicles? That's what you need to check. If you do not and you've tried to tap into all your different insurances, then your only option would be to file a lawsuit against her directly. An uninsured driver hit my mom and i and she was injured and the car was totaled, we do have uninsured motorist coverage but we are lost. The police didnt verify his insurance at the time of the accident and we got a formal letter from the insurance saying he was uninsured. This really is a free country huh. no punishment for him at all

If you have UM insurance, I would consult and your mom suffered significant injuries, I would consult with a local attorney about the claim... Your own ins co will end up not treating you any better than the 3d party's ins co in this situation.

Okay so I got a letter in the mail today from my now former lawyer saying that they will no longer continue to represent me to recover damages of an accident that wasn't my fault. Some lady didn't wait to yield and turned right in front of me as soon as I crossed the intersection and caused a bad accident involving a third party as well. I was left with a permanent thumb injury , I wasn't able to get surgery because I couldn't afford it and i didn't really have medical insurance. I was forced to pay $1000 of what was owed to my vehicle, insurance only covered like $4000 I had to pay the rest out of pocket and it really affected my credit score when it was doing so great. It affected my credit score -55 because I paid it off the car early but it wasn't even my intention, you get me? Now I'm left with plenty of debt from medical bills and I still have a lot of pain in my thumb. I am extremely frustrated to hear that my attorney can no longer represent me because the other party who caused the accident doesn't have insurance and I unfortunately don't have "uninsured motorist coverage" like i didn't even know that was a thing. Like it's going be a year on July 24. And my injury still feels pretty bad, I had to stop working one of my two jobs because of this accident. And I don't know if I can just go back to working a regular job with the hand injury. I struggled for a while because I was without a car. Hi Giovanni, I'm so sorry to hear this. But I don't have any good news for you..... If neither side has insurance, there isn't any attorney I know who would get involved. Unless, and this is a major stretch - the other driver has huge assets like a house, stocks etc etc. But if they had no insurance I'm skeptical whether they have any assets to compensate you. I'm really sorry you're having to go through this. The only thing you can do is to make sure you have insurance to protect yourself. Including liability, collision etc but always UM and UIM. Agreed with Barry - also remember your insurance company will subrogante against the other party and then reimburse you your deductible if they are successful. Yes, having to pay your deductible seems like punishment but you selected that deductible knowing in the worst case it would be money you lose in the event of a claim. If the amount is too high you need to consider losing your destructible or always have that amount in emergency savings.
Texas- Recently had an accident with an uninsured driver. I am well insured and the total loss, and car rental are being covered. I did get checked at the ER, and there was no concussion, which I was concerned about. My left leg was in a lot of pain. Im currently waiting on results of an ultrasound to see if there are any blood clots. I lost 1½ weeks of work, and I still experience pain, especially at night ehich causes me to be restless and not sleep well. My insurance company automatically offered me $2k for pain + hospital bills. I feel bad that my own insurance has to pay anything, but I have paid my policy for years to cover me for a moment like this. Do I accept the $2k, or are they low balling me? 🤔 Thank you.

Hello sir I had a quick question what about a company vehicle that is not insured I was hit by an Amazon delivery vehicle. It's a third party company but the owner is not cooperative and refused to help at all I found out their insurance defaulted on December 17th. Good morning, if you were injured there's likely an attorney who would be interested in your case. If its only property damage, you may want to consider going ahead and filing a lawsuit in small claims court (assuming the dollar amounts work - check your county court website to learn more about filing in small claims court).
Another question: According to my teen- son not being on my policy (never thought I needed to put him on?) and since he got in an accident rear-ending another car, my Insurance refuses to pay for the damages on both my, and the persons car he hit. SO, .. do teens with driver licenses have to have "car insurance" even if they don't have a car? My car has Full Coverage required by the bank we got the loan from. But when you say: "Uninsured Driver" do you mean every driver who gets a license, even before they can buy a car have to get car insurance?
Odon Sabo if he’s going to be a primary driver (drive the car more frequently than once every so often in an emergency) yes... he has to be a listed driver on your policy.
Uninsured is a definite problem but underinsured is almost as bad. Many states only only call for $25,000 and when it comes to a new car that's not enough. In the case where more than one car is involved $25,000 runs out quick leaving the people at no cause to either taking the cause to court and even if you get the right decision in court if the guy don't have the money to pay. States need to raise the claim amount to meet the price of a new car.
Alight so i have a long story for you... I was selling a truck of mine that sat for the winter, i posted it on craigslist & a guy came out to check it out. I told him it didn't have insurance on it, he asked he could take it around the block just to see how it drives. Like a dumb ass i thought that was reasonable so i let him drive it around the block with me as passenger. We get into an accident he claims the breaks went who knows for sure. Am i reasonable for the damages? It was my vehicle & im worried about getting sued from the other driver or even there insurance company. The other guy did have insurance, there insurance company contacted me asking that they "just wanted to know my side" i of course have not replied. Am i going to be sued?
My family is dealing with the following problem: A minor (17 years old) collided with my wife's car, he was found at fault by the Police; His insurance company is denying the claim because he was an excluded driver under the car's policy; therefore, we have to file the claims under our Uninsured Motorist policy; unfortunately, our UM coverage is only $25K and the first medical bill we received from the hospital is already $21K, so I'm very afraid that just the medical bills are going to be above the $25K limit from our policy and this is not even counting with the lost wages and my wife's pain and suffering. The vehicle that hit our car belonged (totalled) to the kid's uncle, the mother had the insurance under her name and she excluded her son probably for issues that happened before; my question is the following: Can I pursue a claim under the Uncle's insurance from another car since he is the legal owner of the vehicle that hit my wife? I think the mother and the uncle should be responsible for being negligent and allowing the kid to drive the car when they were fully aware the insurance will not cover anyone if any accidents that were his fault were to happen. Hi i was in an accident while at a stop light. A teenager was speeding and lost control and hit and damaged a loaner from my dealer ship. The teenager admitted to being at fault. He had no insurance and no driver's license. I admittedly call the police to file a police report. I explained to the teenagers father that i will have to get an estimate and we can settle this maybe out of court. When i showed up with the estimate the son and father are now saying that they did not hit my vehicle. I explained that this was a loaner from my dealer ship and was inspected with no dents or damages. Should i take them to claims court or have my insurance take care of the 3500.00 worth of damges. Happens a lot. People are dishonest. If it were me, I'd use my insurance. But you may have no problem going through the court system. Just takes a long time and is aggravating.

Credit score!? HAHA! Look lady, if your son wasn't responsible enough to drive with insurance, what makes you think hes going to be responsible with money? His credit score will not be immediately affected, however, when he starts getting served (sued) left and right from the accident (usually happens 2-3 years afterwards) you better believe they coming after your son for some money. If he cant afford the 100-200 per month for an insurance policy for his vehicle, what makes you think hes going to be able to pay for the lawsuit? You're actually worrying about the wrong thing here. I'd be worried about that nice fat lawsuit that's coming his way.

@LawFull I have full coverage by Allstate here in Phoenix area AZ. My 19 year old son got in an accident and rear ended a car, my adjuster won't return my calls, and my Agent (over 20 years) says my car is not covered since we never put him on our policy. I thought that was a given, that my kids can borrow the car, which is why we have full coverage to make sure my children are protected always, both before and after they get their license? What I am being told is that "everyone", including the neighbors kids, or their friends borrowing the car are protected, and should they borrow the car and get in an accident, and total the car, my car would be covered. But Because he is my 'son' who caused the accident, and living with us (well duh, .. should I kick him out? He's going to school) my full-coverage means NOTHING. I was told by my agent that not only am I responsible for the damages to my car, but also the car he rear-ended, including medical expenses the other drivers might incur! Is this how "No Fault" where we all must have car insurance works, .. that my kids living in the same house all their lives are the only ones can Void the full coverage insurance? It's bad enough Social Security took almost a $1,000 a month because they turned 18 even though they were both still in school, now we are facing the greatest dilemma of loosing everything, even though we been paying the high full coverage all these years! I had the same crap with allstate. The bitch that hit me had no insurance, no driver's lic. and she had an out of state lic. plate from Okc. The sheriff's dept in polk county could care less. I’m a 16 year old driver in Texas with a valid license who made a major mistake of driving with no insurance to my early morning soccer practice, I got into an accident, it happened so fast and I truly can’t recall who was at fault. I was turning right at a red light on a protected right turn lane, the car going my direction on a green turned into my lane about 2 seconds into when I got in the lane and my front left bumper damaged his rear, between the door and the side panel, looked like a couple hundred dollars in damage, nothing happened that would stop the car from it’s full function or performance. Just exterior damage. My car took a huge dent but I fixed it at the scene by hand. The man got out didn’t seem hurt at all and left after about 5 minutes when the police took his information. I however got ticketed and have to appear in court. What should I expect in terms of fines???? I’ve been working at a fast food restaurant and on the street doing jobs right after school till dark in expectation of having to pay a major fee! Am I over reacting or should I expect a heavy load.

So in short, you're uninsured and hit someone in someone else's car who is also uninsured? If so, then the injured driver will most likely make a claim against his or her own uninsured motorist coverage.....

Now, you might here from a company trying to get reimbursed for whatever money their insurance company had to put out on their insured's behalf. . . So be ware of that.

If I had a client whose case was worth more than the policy limits, I would only go after the defendant personally IF the person had assets in an amount to compensate my client. Otherwise, what normally happens is you go after the person individually and they then declare bankruptcy and you're out of luck anyways....
I was hit by a suburban....I had the right away....it was posted on the accident report...when i called their insurance....they said that they didn't pay it so they had no insurance ( they just gave a insurance card to the cop at the time of the accident that wasn't paid... Hi, I am sorry to hear about this. Unfortunately you're right the only thing that you can do really is file a lawsuit against them and try to recover. The problem is if they don't have insurance a good chance that they don't have access to go after either. But if the damage to your vehicle isn't that bad perhaps they'll just pay up.
Hi I live in the stare of Michigan ( yeah i know, don't laugh). An uninsured driver hit my legally parked car. It's an older car, 2009 Mariner, so I don't keep full coverage on it but I do have uninsured coverage, which I thought would cover my car if hit by an uninsured driver. My insurance company, Liberty Mutual, said it does not cover my car just bodily damage. Other than suing the person responsible is there any other way to get compensated for my loss? Can you help me out. Just questions on how I should handle something. So I was hit, T-boned in a heavy traffic intersection and was turning left. I was uninsured at the time n the other driver was but it wasnt their car. I went to court no one showed up, no witnesses other than me and the other driver, the cop never showed up either. Case was dismissed in Illinois. I felt it was both our fault anyways since the other driver had plenty of time to react to me but for some reason just slammed into me. Now they want me to pay damages. Small court. I was told to get an SR22 and that was it for me. N a ticket for no insurance. Hi, suing him for your lost wages is probably a waste of time. The question is can you seek reimbursement for lost wages from your own insurance policy. You need to ask your adjuster and check your policy for the answer to that.

Those numbers are definitely off. Many people have licenses, but don’t actually own a car. Additionally, thanks to all the insurance companies ripping people off we have a lot of people that own cars under somebody else’s name therefore, the calculation is way off.

Hi, not much for you to do until he does something. And even then, there's not much for you to do. It would be a waste for him to sue you unless you have the assets to pay him back. He needs to go after his own insurance to use his collision coverage to pay for his property damage and his UM coverage if he has any injuries..

I would do it under the guise of asking for his auto insurance information. If he does not have any, then you can either 1. file with your own insurance (which you should probably do anyways) or 2. File suit against him/her in small claims court (assuming the damage is minimal.)
End of last month (May) I was headed home with my family- boyfriend and small child. A driver who was behind me decided to pass me in a no passing zone. On her way to come back over in front of me she side swiped my car. Then took off! I thought she was going to pull over but nope! Followed her the best I could, bf called police, got license plate number, and almost wrecked by going too fast around a turn and I was able to catch up to her. A cop in the next town pulled her over because she was driving at a high rate of speed. First denied hitting us and said we were just following her. Then said she wanted to apologize (apologize for what if you “didn’t hit” us) anyways. Neither insurance company can get ahold of the mother. The driver is 17. It’s almost been a month and idk what to do. Didn’t have full coverage.
Also, damage to my car. Not much.. but her green paint, tire marks and dents and scrapes. I went out to eat today for dinner. And wouldn’t you know if, the driver works there. So I looked in the parking lot to see if her car was out there. It was. I got pictures of the scrape on her car where she swiped us.

Hi. My situation was like this: I made a left turn, the other driver drove straight and hit me. By law, I would be at fault because I didn't have the right of way. I was insured, and my insurance company was able to pay for my total lost car. After the accident, with the information that we exchanged at the scene, my insurance company investigated and learned that the other driver was uninsured. They also found out that the uninsured driver was driving over speed limit. Hence, they said that I was not at fault. Odd. So with no injury, hes probably thinking ha ing a lawyer write you a letter will get you to pay. If you dont pay, he could file suit against you in small claims court. You would then turn it over to your insurance company to represent you

You’d better answer that civil summons because if you don’t, you’ll get a default judgment and in Florida, that’s never good. Florida is the WORST STATE to not reply and defend accusations
Here's a fun story. I was in a crash with a lady 40+ days ago. Long story short, despite her essentially screaming it was my fault, it was her fault. Anyhow, after her avoiding my phone calls she finally texts me her insurance info (we crashed in front of her workplace so i thought id be nice). She tells me to send someone from my insurance company to look at her car (she hasnt filed a claim even when i gave her all my info) After that brain cell killing conversation a few things happend: 1 she apparently has coverage issues (my local agent says its most likely she isnt paying) 2 she was called by both insurance companies acknowledging a crash did indeed happen 3 around 20+ days ago my insurance has stated im covered under my uninsured motorist... "clause"? and will happily act upon it as soon as her insurance drops her and/or she finnally pays up 4 she had been avoiding contact with her or my insurance companies ever since #1-3 happened 5 ive been waiting for her insurance to drop her ever since Since its the 40th day since i field my claim i will have to file a complaint with the California Department of Insurance since its my right to have my claim resolved somehow barring a substantial reason, in 40 days. A lady not picking up her phone = not substantial. edit i filed an uninsured claim first because she avoided my calls for 2-3 days. as for the accident. it was a T intersection in a parking lot. there were parking spaces on the side of the straightaway. I was going down the straightaway and she ran in front of me trying to park at that T intersection. my insurance found her at fault of course.

I had an accident (also 100% not my fault) a year before this one and insurance didnt go up. I currently dont have car insurance since i have no car but the agent said if i got another car my premium would stay the same. only rate increase i ever got was when i moved to my current residence (was paying ~$400 every 6m before) After 2 accidents i can finally understand why that happened

They are punished in Oregon with hefty fines, license suspension for 1 year, and the only option to drive again is if the uninsured party can provided proof [of only a few particular types] of hardship, then they are allowed to apply for ssr2 that grants a license after proof of auto insurance, and ssr2 license restricts when and where they can drive between 1-3 years. Unless they've changed the laws since 2010, basically they're allowed to drive during the daytime only for a job or school, and any other use means they are stripped of the inch they were given, bigger fines, and possibly jail time.
My sister filed a lawsuit in small claims court for the driver who damaged her car, won the case but couldn’t collect anything since the defendant had no money.

Keep in mind Flordia is the only state in the country that you can opt off Bodily injury for their insurance. It is still required though to maintain property damage liability.
It's so easy for the police and motor traffic enforcement to find out who the uninsured drivers are now. They have special plate cameras that can run your plates and find out if you are uninsured on a central database. The police waste no time catching up to you to make a traffic stop to verify if you lack proper insurance. Then you get your car immediately impounded and slapped with a $10,000 fine. No need for so many uninsured drivers on our roads unchecked.
that will not work this country urban design is backwards that you have to drive a car to get simple mundane stuff and being force to drive a car everywhere means that you have people that cannot afford to drive a car if you want to completely stop people from driving uninsured the United States need to invest in walkable urban design and public transportation.

One thing I would like to add on to make sure if you have liability insurance to add on uninsured motorist property damage. In this situation that coverage will be extended over to you. Normally deductible for this coverage anywhere 1k to $0. Most common is $250

My insurance Co. had my car towed to dealer for estimate and claim is underway. No police report released yet. Car looks totaled, but if not, I’ll be out 1k for deductible. I do have underinsured and uninsured coverage with collision. This is a perfect example of “life’s unfair” and the victim being punished for the unaccountability’s of others. I was hit by a uninsured driver on 03/25. The next day I found out he was excluded from the insurance policy. The vehicle seems to belong to a relative. I don't feel I should be liable for the insurance deductible..

@LawFull I Bought a beautiful used Toyota tundra with all the options I wanted, low milage, one owner, and taken care of just as I would have. Less than two months later, an uninsured, unlicensed driver ran a stop sign, and I did everything I could but not stop in time. I had many witnesses back up my story with the police, and I have the completed report on my side. I filed with my insurance, but I will still be out my deductible, and I've missed a weeks worth of work with out a vehicle, as well as make general running of errands hard, with one less vehicle for me and my family. Can I still sue the other driver, even though I've also filed on my insurance for uninsured motorist, for for lost wages and to cover my deductible? Or at the very least, make sure the other driver does not get licensed any time soon? I still don't know if my truck will be totaled or not, and this all just has me steaming mad at this lady.
Sorry to hear this. Sure you can sue her but for what? If she doesn't have insurance chances are she doesn't have any assets or the money to pay you. So you will probably be wasting your time. Your insurance may go after her for reimbursement too.... Really sorry you're dealing with this b.s. Uninsured drivers are such a hazard.

I stopped, for less than a minute to check on my baby and continue driving, when I backed up from the car infront of me to get myself back into traffic, I looked down to put my car into drive, I heard someone slap my car. I got out and saw an older gentleman getting up. He said that he was fine but still wanted to get checked out so he was taken to the hospital. Always file the claim with your insurance company and have them fight the other insurance company - it’s what you pay them for as part of your collision coverage

Hi Daryl, well, most people who don't have auto insurance don't have much in the way of assets. However, if your damages are modest, you could sue him or her in small claims court and see what you can recover. But I'm skeptical it would be very successful... Sorry you're going through this.
An insured motorist backed into my driver side door causing a huge dent, and my door doesn’t shut properly. Recently I was hit , another guy in a pick up truck hit me head on and my insurance told me my car is a total loss , I called the other drivers insurance to see if he filed a report and he didn't a day later I find out his insurance was canceled months ago... he gave the police false information about insurance on his truck when the accident accured . Most states won’t allow that to be written - it is only a benefit from some insurance companies depending on the claim history and longevity of policy. It is not an actual part of the stated policy.
You can try to have the lowest deductibles possible - some states will still allow a $0 comprehensive deductible to be written.

Hi, you can but in reality if he has no insurance he probably has no assets to go after...... So you should see if you have uninsured motorist coverage and go after your own insurance for compensation/reimbursement.
I'm in IL too, someone with minimum coverages hit a car, who got pushed into another car, and it chained to 4 cars! My sons car got damaged and we only had liability so who knows if we'll even get the repairs paid for.

I am in the process of filing. I was rear ended pretty bad by an uninsured motorist. My vehicle is totaled. The police came and did the report, the other driver had already left. The police ran his license and the license plate and told me that the guy who hit me is not listed as the owner and the owner is a dealership. Hi Mark, sure you can. But I wouldn't. I'd file through your insurance. Since you both have the same insurance, your insurance company might waive the deductible. Then let your insurance go after the guy for reimbursement. You chasing the guy for the money will be a big aggravation and not worth it. In my opinion at least.

Got in an accident yesterday while sitting in the drive thru lane waiting to pay and got rammed in my rear.
Long story short they didn't have insurance at the time but did decide to pay for the insurance 30 minutes after the accident.

Yes - file with your own ins co. If they are trying to pay after an accident occurred, chances are the ins co will figure it out and may deny the claim. So sounds like you're doing the right thing....

You should report it to your insurance company. Hopefully you have coverage for it. It could cause rates to go up and it could cause you to pay your deductible but thats better than paying for the damage out of pocket I assume.

Hi, if you're just talking about property damage - then I'd have your insurance make the repairs to your vehicle. Then, let your insurance go after the other driver. Why would you want to? Nothing but aggravation, will likely result in nothing and be a waste of your time. Let your insurance company attempt to get reimbursement from them. In my opinion at least.
i was recently hit by another driver, they are completely at fault. they admitted it verbally. however i filed a claim against their insurance. and the adjuster has said there is a issue with the coverage. they will not state what the issue is. i assume the driver was not on the insurance since the insurance card had the registered owners name on it. whom was not the driver at the time. in addition i cannot file a claim through my insurance as i only have liability so my insurance wont handle any claim processing. i have made a letter of demand. demanding a written explanation of the insurance company’s reasons for claiming there is no coverage (Coverage Issue), including references to the specific policy provisions that limit coverage. Is there anything else i can do well waiting for their response? Should I rush to file suit against the possibly uninsured motorist? i do believe they have the funds to pay if sued.

You will be provided with a formal written explanation when the claim is denied - in that letter the claimants insurance company will state specifically why there is no coverage for the claim. Many times in cases like this it is because the claimant (the other guy) has a non-standard insurance policy because they are high-risk, on a work visa or other temporary immigration status that provides no driving history, unable to find standard coverage because of a DUI etc, there are quite a lot of reasons and almost none of them good for why their policy may not provide coverage but it is usual that non-standard policies only cover the named driver in the named vehicle and no one and no car else unlike a standard policy from companies like AllState, State Farm etc
Expect a letter from their insurance company stating formally that the claim is denied. Also, and this happened to me in the state of IL, expect their insurance company to also notify the state as this will be a violation and can usually be criminal.
This is why if someone hits you and they have Progressive, Geico, General, you should be scared - those are companies for bad drivers and financially irresponsible people

I was rear ended by an uninsured motorist so my uninsured motorist portion of my policy determine the car was totaled. Here is where I'm taking a loss, a month prior to the accident I just had the vehicle's paint and body work restored for about $5000. The value of the car is only roughly $6000. Of course my intent for restoring the car was not to add value since I just wanted a forever car to look nice and new. My insurance of course will only pay out up to the value of the vehicle minus my deductible. My question is how likely would a court side with me if I sue the uninsured motorist for the recent repair cost to recoup my loss or am I just SOL and have to just accept the market value of my car?

My truck was parked and some unlicensed and uninsured driver destroyed my truck and she is declining to pay. What do I do? Hi, two choices: 1. file a claim under your own insurance company. They then may go after the defendant for reimbursement. 2. If you don't have collision coverage, you may have to file a lawsuit against her. Problem is, I don't know any "property damage" attorneys who would file a lawsuit in a property damage only case. Thanks problem is that if I file a lawsuit the person is not obliged to attend because she doesnt have a driver's license. Also she is refusing to return calls regarding coming to an agreement. I was told that I may have to cover my own damages.

I live in an apartment building 1 block away from 2 well known local bars (small town). Both of my vehicles were parked out front with several others in our parking spaces for the apartment building.
A drunk as piss local woman (who works at one of the bars & is a local police officers daughter) drove drunk down my street and crashed into both of my vehicles and totaled them. She than left the scene in her car and crossed a bridge where an officer followed (he has passed the scene about 2m after it happened but did not see accident) and pulled her over and arrested her. She got charged and released due to covid. cops are keeping the whole thing out of the papers. she had no ins or drivers license, was prob speeding, was drunk as all hell, treating cop like crap. idk what happened to her car impound or not. i didnt have uninsured motorists coverage but i did have regular insurance on my other two vehicles. i dont know what to do. im self employed and my vehicle is how i get to my jobs. everything that ive read of or heard basically says im screwed - and looks like because of covid she isnt even going to go to jail for this. because there were no ppl in my cars the police are acting like it was a nonviolent crime.
Hi, it would not be uninsured motorist per se that you would use. Do you have collision/comprehensive coverage on the vehicles? That's what you need to check. If you do not and you've tried to tap into all your different insurances, then your only option would be to file a lawsuit against her directly. An uninsured driver hit my mom and i and she was injured and the car was totaled, we do have uninsured motorist coverage but we are lost. The police didnt verify his insurance at the time of the accident and we got a formal letter from the insurance saying he was uninsured. If you have UM insurance, I would consult and your mom suffered significant injuries, I would consult with a local attorney about the claim... Okay so I got a letter in the mail today from my now former lawyer saying that they will no longer continue to represent me to recover damages of an accident that wasn't my fault. Some lady didn't wait to yield and turned right in front of me as soon as I crossed the intersection and caused a bad accident involving a third party as well. I was left with a permanent thumb injury , I wasn't able to get surgery because I couldn't afford it and i didn't really have medical insurance. I was forced to pay $1000 of what was owed to my vehicle, insurance only covered like $4000 I had to pay the rest out of pocket and it really affected my credit score when it was doing so great. It affected my credit score -55 because I paid it off the car early but it wasn't even my intention, you get me? Now I'm left with plenty of debt from medical bills and I still have a lot of pain in my thumb. I am extremely frustrated to hear that my attorney can no longer represent me because the other party who caused the accident doesn't have insurance and I unfortunately don't have "uninsured motorist coverage" like i didn't even know that was a thing. Hi Giovanni, I'm so sorry to hear this. But I don't have any good news for you..... If neither side has insurance, there isn't any attorney I know who would get involved. Unless, and this is a major stretch - the other driver has huge assets like a house, stocks etc etc. But if they had no insurance I'm skeptical whether they have any assets to compensate you. I'm really sorry you're having to go through this. The only thing you can do is to make sure you have insurance to protect yourself. Including liability, collision etc but always UM and UIM. Agreed with Barry - also remember your insurance company will subrogante against the other party and then reimburse you your deductible if they are successful. Yes, having to pay your deductible seems like punishment but you selected that deductible knowing in the worst case it would be money you lose in the event of a claim. If the amount is too high you need to consider losing your destructible or always have that amount in emergency savings.
Texas- Recently had an accident with an uninsured driver. I am well insured and the total loss, and car rental are being covered. I did get checked at the ER, and there was no concussion, which I was concerned about. My left leg was in a lot of pain. Im currently waiting on results of an ultrasound to see if there are any blood clots. I lost 1½ weeks of work, and I still experience pain, especially at night ehich causes me to be restless and not sleep well. My insurance company automatically offered me $2k for pain + hospital bills. It's a third party company but the owner is not cooperative and refused to help at all I found out their insurance defaulted on December 17th. If its only property damage, you may want to consider going ahead and filing a lawsuit in small claims court (assuming the dollar amounts work - check your county court website to learn more about filing in small claims court).

According to my teen- son not being on my policy (never thought I needed to put him on?) and since he got in an accident rear-ending another car, my Insurance refuses to pay for the damages on both my, and the persons car he hit. SO, .. do teens with driver licenses have to have "car insurance" even if they don't have a car? My car has Full Coverage required by the bank we got the loan from. Odon Sabo if he’s going to be a primary driver (drive the car more frequently than once every so often in an emergency) yes... he has to be a listed driver on your policy.
Uninsured is a definite problem but underinsured is almost as bad. Many states only only call for $25,000 and when it comes to a new car that's not enough. In the case where more than one car is involved $25,000 runs out quick leaving the people at no cause to either taking the cause to court and even if you get the right decision in court if the guy don't have the money to pay. States need to raise the claim amount to meet the price of a new car.

Alight so i have a long story for you... I was selling a truck of mine that sat for the winter, i posted it on craigslist & a guy came out to check it out. I told him it didn't have insurance on it, he asked he could take it around the block just to see how it drives. Like a dumb ass i thought that was reasonable so i let him drive it around the block with me as passenger. We get into an accident he claims the breaks went who knows for sure. Am i reasonable for the damages? It was my vehicle & im worried about getting sued from the other driver or even there insurance company. The other guy did have insurance, there insurance company contacted me asking that they "just wanted to know my side" i of course have not replied. Am i going to be sued?
My family is dealing with the following problem: A minor (17 years old) collided with my wife's car, he was found at fault by the Police; His insurance company is denying the claim because he was an excluded driver under the car's policy; therefore, we have to file the claims under our Uninsured Motorist policy; unfortunately, our UM coverage is only $25K and the first medical bill we received from the hospital is already $21K, so I'm very afraid that just the medical bills are going to be above the $25K limit from our policy and this is not even counting with the lost wages and my wife's pain and suffering. The vehicle that hit our car belonged (totalled) to the kid's uncle, the mother had the insurance under her name and she excluded her son probably for issues that happened before; my question is the following: Can I pursue a claim under the Uncle's insurance from another car since he is the legal owner of the vehicle that hit my wife? I think the mother and the uncle should be responsible for being negligent and allowing the kid to drive the car when they were fully aware the insurance will not cover anyone if any accidents that were his fault were to happen.

Hi i was in an accident while at a stop light. A teenager was speeding and lost control and hit and damaged a loaner from my dealer ship. The teenager admitted to being at fault. He had no insurance and no driver's license. I admittedly call the police to file a police report. I explained to the teenagers father that i will have to get an estimate and we can settle this maybe out of court. When i showed up with the estimate the son and father are now saying that they did not hit my vehicle. I explained that this was a loaner from my dealer ship and was inspected with no dents or damages. Should i take them to claims court or have my insurance take care of the 3500.00 worth of damges. Happens a lot. People are dishonest. If it were me, I'd use my insurance. But you may have no problem going through the court system. Just takes a long time and is aggravating.

His credit score will not be immediately affected, however, when he starts getting served (sued) left and right from the accident (usually happens 2-3 years afterwards) you better believe they coming after your son for some money.

I have full coverage by Allstate here in Phoenix area AZ. My 19 year old son got in an accident and rear ended a car, my adjuster won't return my calls, and my Agent (over 20 years) says my car is not covered since we never put him on our policy.
I thought that was a given, that my kids can borrow the car, which is why we have full coverage to make sure my children are protected always, both before and after they get their license?
What I am being told is that "everyone", including the neighbors kids, or their friends borrowing the car are protected, and should they borrow the car and get in an accident, and total the car, my car would be covered.

I had the same crap with allstate. The bitch that hit me had no insurance, no driver's lic. and she had an out of state lic. plate from Okc. The sheriff's dept in polk county could care less. As far as allshit goes watch out for the middle finger. I am presently filing a joint law suite for damages and missed time from work agaaint her and the state of Okc . I’m a 16 year old driver in Texas with a valid license who made a major mistake of driving with no insurance to my early morning soccer practice, I got into an accident, it happened so fast and I truly can’t recall who was at fault. I was turning right at a red light on a protected right turn lane, the car going my direction on a green turned into my lane about 2 seconds into when I got in the lane and my front left bumper damaged his rear, between the door and the side panel, looked like a couple hundred dollars in damage, nothing happened that would stop the car from it’s full function or performance. Just exterior damage.
My car took a huge dent but I fixed it at the scene by hand.
The man got out didn’t seem hurt at all and left after about 5 minutes when the police took his information.
I however got ticketed and have to appear in court.
What should I expect in terms of fines???? I’ve been working at a fast food restaurant and on the street doing jobs right after school till dark in expectation of having to pay a major fee! Am I over reacting or should I expect a heavy load.

So in short, you're uninsured and hit someone in someone else's car who is also uninsured? If so, then the injured driver will most likely make a claim against his or her own uninsured motorist coverage.....

If I had a client whose case was worth more than the policy limits, I would only go after the defendant personally IF the person had assets in an amount to compensate my client. Otherwise, what normally happens is you go after the person individually and they then declare bankruptcy and you're out of luck anyways....

I was hit by a suburban....I had the right away....it was posted on the accident report...when i called their insurance....they said that they didn't pay it so they had no insurance ( they just gave a insurance card to the cop at the time of the accident that wasn't paid...

Hi, I am sorry to hear about this. Unfortunately you're right the only thing that you can do really is file a lawsuit against them and try to recover. The problem is if they don't have insurance a good chance that they don't have access to go after either. But if the damage to your vehicle isn't that bad perhaps they'll just pay up.

Hi I live in the stare of Michigan ( yeah i know, don't laugh). An uninsured driver hit my legally parked car. It's an older car, 2009 Mariner, so I don't keep full coverage on it but I do have uninsured coverage, which I thought would cover my car if hit by an uninsured driver. My insurance company, Liberty Mutual, said it does not cover my car just bodily damage. Other than suing the person responsible is there any other way to get compensated for my loss? About $1500.00 worth of damage. And does it help if I inform the officer that took the report about the uninsured driver? Thank you for your response.

Also, the statute of limitations in your state might have expired. In Illinois, we have a 2 year statute - though for strictly a property damage case it might actually be different. Can you help me out. Just questions on how I should handle something. So I was hit, T-boned in a heavy traffic intersection and was turning left. I was uninsured at the time n the other driver was but it wasnt their car. I went to court no one showed up, no witnesses other than me and the other driver, the cop never showed up either. Hi, suing him for your lost wages is probably a waste of time. The question is can you seek reimbursement for lost wages from your own insurance policy. You need to ask your adjuster and check your policy for the answer to that.

Those numbers are definitely off. Many people have licenses, but don’t actually own a car. Additionally, thanks to all the insurance companies ripping people off we have a lot of people that own cars under somebody else’s name therefore, the calculation is way off.
Hi there , i recently purchased a vehicle from a private party and had not yet put insurance on it and I was involved in an accident . Hi, not much for you to do until he does something. And even then, there's not much for you to do. It would be a waste for him to sue you unless you have the assets to pay him back. He needs to go after his own insurance to use his collision coverage to pay for his property damage and his UM coverage if he has any injuries..

I got hit by motorists who I think doesn't have car insurance...Should I confront him to give me money to fix my car?
I would do it under the guise of asking for his auto insurance information. If he does not have any, then you can either 1. file with your own insurance (which you should probably do anyways) or 2. File suit against him/her in small claims court (assuming the damage is minimal.)
End of last month (May) I was headed home with my family- boyfriend and small child. A driver who was behind me decided to pass me in a no passing zone. On her way to come back over in front of me she side swiped my car. Then took off! I thought she was going to pull over but nope! Followed her the best I could, bf called police, got license plate number, and almost wrecked by going too fast around a turn and I was able to catch up to her. A cop in the next town pulled her over because she was driving at a high rate of speed. First denied hitting us and said we were just following her. Then said she wanted to apologize (apologize for what if you “didn’t hit” us) anyways. Neither insurance company can get ahold of the mother. The driver is 17. It’s almost been a month and idk what to do. Didn’t have full coverage.
Also, damage to my car. Not much.. but her green paint, tire marks and dents and scrapes. I went out to eat today for dinner. And wouldn’t you know if, the driver works there. So I looked in the parking lot to see if her car was out there. It was. I got pictures of the scrape on her car where she swiped us.
When you say you dont have full coverage, you mean you dont have coverage property damage?
Your only choice may be to file a small claims lawsuit. Once served they will contact their insurance company

Hi. My situation was like this: I made a left turn, the other driver drove straight and hit me. By law, I would be at fault because I didn't have the right of way. I was insured, and my insurance company was able to pay for my total lost car. After the accident, with the information that we exchanged at the scene, my insurance company investigated and learned that the other driver was uninsured. They also found out that the uninsured driver was driving over speed limit. Hence, they said that I was not at fault. Odd. So with no injury, hes probably thinking ha ing a lawyer write you a letter will get you to pay. If you dont pay, he could file suit against you in small claims court. You would then turn it over to your insurance company to represent you

You’d better answer that civil summons because if you don’t, you’ll get a default judgment and in Florida, that’s never good. Florida is the WORST STATE to not reply and defend accusations
Here's a fun story. I was in a crash with a lady 40+ days ago. Long story short, despite her essentially screaming it was my fault, it was her fault. Anyhow, after her avoiding my phone calls she finally texts me her insurance info (we crashed in front of her workplace so i thought id be nice). She tells me to send someone from my insurance company to look at her car (she hasnt filed a claim even when i gave her all my info) After that brain cell killing conversation a few things happend:
1 she apparently has coverage issues (my local agent says its most likely she isnt paying)
2 she was called by both insurance companies acknowledging a crash did indeed happen
3 around 20+ days ago my insurance has stated im covered under my uninsured motorist... "clause"? and will happily act upon it as soon as her insurance drops her and/or she finnally pays up
4 she had been avoiding contact with her or my insurance companies ever since #1-3 happened
5 ive been waiting for her insurance to drop her ever since
Since its the 40th day since i field my claim i will have to file a complaint with the California Department of Insurance since its my right to have my claim resolved somehow barring a substantial reason, in 40 days. A lady not picking up her phone = not substantial.
edit i filed an uninsured claim first because she avoided my calls for 2-3 days. as for the accident. it was a T intersection in a parking lot. there were parking spaces on the side of the straightaway. I was going down the straightaway and she ran in front of me trying to park at that T intersection. my insurance found her at fault of course.

If you got a license plate number they can find the driver. Hopefully you have coverage for the property damage....
