Squatters could loose their rights, what rights.. the owner has rights, not trespassers.

Due process is a legal loophole?

Unfortunately, yes it is. Since in most states, it is illegal to forcibly remove a squatter, throw out their stuff or change the locks, homeowners have to go through the long and agonizingly slow process of formally warning the squatter, getting a court hearing and an eviction notice. That can take weeks, months or even years to do. And there's a huge backlog of cases. And if a squatter can stay long enough, he can even legally take possession of your property.
In Florida, there's an anti-squatter law that allows cops to arrest squatters if they cannot produce any legal document for them to stay. In Georgia, evicting a squatter can be done in 7 days or less. Right now, in Texas, if you can prove that the squatter's documents are fake, the police will no longer see the case as a civil matter. Fraud or forgery of documents is a felony, and the squatter will be seen as a trespasser. The new Texas legislation would make the eviction process easier.

What about renters with horrible landlords (ours is a big corporation) have always paid my rent, landlord refuses to fix anything, masterbath toilet has been broke 18 months, (other toilet doesn’t work properly) kitchen lights also haven’t worked for 18 months, exploding ceiling fan not replaced (lots of other problems) No lawyers want to help because there’s not enough money in it for them, I’m a disabled former firefighter, can’t afford to move, where’s the help for people like us???

Sounds like a lawsuit you would win for sure if you kept all the documents proving that

@@amolochitis30 you could say the same about the squatting issue now. Just walk down to the JP court, file a claim and the sheriff evicts. Don;'t even need an attorney. But now we're gonna see flocks of landlords making this a renters problem, and that's a suit you will need an attorney for.

That's the problem. Without Due Process, Landlords could kick out renters without notice because they found somebody to pay $1 more.

Squatters don't have a rental agreement signed

@@amolochitis30 You don't need a written rental agreement. Verbal contract are Legal Contracts! The question is, who's lying? And COPS can't decide that, only the Judge. If we decide to give COPS the power to interpret Legal Contract without Due Process, that's going to be a big problem!
