Jack Smith wasn’t nominated nor confirmed. Jack Smith is nothing but a citizen who is a lawyer and known to be a rabid partisan who has destroyed political careers in the past. In Washington DC Judge Cannon’s decision does not carry any weight. Florida and Washington DC operate in different circuit courts therefore DC and Judge in DC isn’t bound by Cannon’s decision to invalidate Jack Smith’s roll as Special Counsel.
That decision was in a different circuit -- Florida -- and doesn't apply automatically in D.C. Trump will file the same argument in D.C. eventually if Smith keeps going.
