The damage he sustained is from being nailed by a skier hitting him and the force did sever damage to him. This did not come from skiing down together and falling together she hit him and hit him hard and he had SIGNIFICANT damage so much he was carried out. And he has NEVER been the same

I have been in many ski accidents, they are accidents........you take that on when you go down the hill. If everyone that was knocked over on the ski hill sued people the sport would not exist. I was hit in the middle back about 100 yards off the lift, she didn’t even holler, just hit me with both her hands straight out.
It knocked off my gloves, hat, skis, goggles, glasses and anything that would come off. I was thrown up in the air about 10’, (accord to several witnesses).
So lucky, I was NOT INJURED!
Sore yes, hit hard yes, but I was ok.
I did not sue the girl or her parents. By the time 6 ski patrols were there, some giving the girls parents and her a tongue lashing, letting them know, THEY WERE LIABLE FOR MY INJURIES, ETC ETC.
I felt that was punishment enough.
If it was Paltrow ‘s fault, WAS HE HURT OR IS IT ABOUT THE MONEY??

Unfortunately, there are far too many people who drive with no insurance and no forfeiture assets. When they are involved in accidents it increases the rates for everyone.
The ski slope operator, like the auto manufacturer, and many other businesses, provide a space, and or equipment for you to engage in risky behavior - if you are poor at assessing your risk, it’s illogical to think the business owner should be held responsible for your inability to evaluate and think critically, hence the hold harmless waver.

The plaintiff, broke his ribs by falling on the tangled skiis. He had a helmet on, GP had a helmet on. I don't believe the plaintiff or his witness or his daughter in any of their testimony. Witness claims the plaintiff was unresponsive, with face planted in the snow for five minutes while he did nothing. Who does that. What kind of person does nothing but asks "are you OK"? Actually count down 5 minutes, while the person on the ground does not respond. It is a long time. That testimony sounds made up.
I don't believe the witness, either, who claims to remember that one of the actor's children called out, "watch me!" and she turned to look....who would believe something so inconsequential? It is all made up.
you can paint the same narrative about GPs defense, ''im actually the victim i was the one who got hurt, even though im a millionaire and my back/knee were banged up i decided to not get checked out by a professional so theres no medical records'' meanwhile she has no eye witnesses to back up her story, even her own kids arent testifying on her behalf, all the witnesses say GP was at fault, not a single person to say otherwise on stand other Gp saying ''oh that didnt happen im the victim actually'' its literally her only defense and u guys are forgetting actors are trained to lie for a living.

The injuries he sustained don't jive with her version at all. She would have reported an "assault" like that to DVR, or at least mentioned the weird details to EC, of which there is no record or testimony until the trial.

Its incredibly sad that anything like this should come to court. Accidents are accidents. End of. I was a passenger in a terrible car accident back in 2014. My spine T12 was fractured and I walked out of the car and said to paramedics that I was fine. A week later ... walking around with a broken back I was taken to hospital to have surgery and have a titanium plate inserted. My family advised me to sue him. Thankfully I said no. Even though I was more injured it was never intentional on his part. We spoke a few times afterwards and he has since then died. Both of us did not go down the blaming route thank God..
I have been in all kinds of accidents and even fist fights, that is life. Suing somebody over something like this is ridiculous! This is not a real man! Broken ribs! Are you kidding me? That is nothing! I have had broken ribs at least five times as I can remember. Everything from biking, fall accidents, and jujitsu practice. I can only imagine what a little rat I would feel if I sued someone for colliding in the ski slope.

Broken ribs also implies the surrounding tissue is damaged, possibly torn. these were NOT minor injuries

Kristen, the Plaintiff's legal counsel, is so starstruck by Gweneth its cringeworthy. Have some professionalism woman. Her repeated height comments and attempts to schmooze the Defendant do not help her client's case. A body that has slammed into the back of you, from an uphill position, is going to feel big, regardless of what the plaintiff's height was (in 2016). Furthermore, what dodgy doctor would claim that you can only break your ribs when hit from behind. That is BS. Ribs are narrower at the front of the body (anterior) than at the rear (posterior). The Plaintiff's broken ribs only further support Gweneth's case that he skied into her.
At least she asked if she could call her Ms paltrow, while Paltrow said, "what's your name again, oh, is it Kristin?" and used her first name.
Are you a doctor? You've seen instances where two people are moving in the same direction, and the one in the rear of the collision has broken ribs as a result? Remember, Paltrow said they weren't going fast at all.
@@MattB787 Gweneth did not say they weren't going fast at all, she said that *she* wasn't going fast. Now if she is skiing slowly and someone skiing fast hits her from behind the force would be significant. It's basic science. The purview of engineering, not medicine.
@@beatricet5682 I heard 'we' in other testimony - and you would describe being hit by a fast skier as 'I felt pressure', like she said on the stand? Or are you going to tell me she didn't say that either? If you've ever skied before, you would know that any collision would not result in the two 'spooning' on the ground. Don't forget the grunting either, she heard that from behind
Several years ago I was plowed into from behind by another skier. We both went flying, skis came off, the whole bit. He was mad at me because he said I "turned right" and he wasn't expecting it. He had 200 years on either side of me where he could've gone, but had to be so close to me that one minor direction change and we were both face first in the snow. However, he never sued me. Guess I wasn't rich and famous enough. Seriously, it seems like GP should be the one suing HIM, not vice versa. He's got a lot of nerve.

If a person rear ends you in a car, and injures their back in the process, it wouldn't be your fault, because they ran into you. I'm not entirely sure what to think of her leaving the scene without personally giving her information though. That's a bit more tricky. It sounds like he hit her, she was pissed tf off, screamed at him, and skied away before actually getting a good look at him. Which is really shitty, I'm just not sure if she's liable just from that.

See, what you describe is how skiing collisions happen - they are fast and violent, people go 'flying'. There is no 'grunting' when someone hits you, and when you fall to the ground, you are not 'spooning' with the other person. Hilarious. Listen to the eyewitness testimony - his version of events on the collision is how they happen when you hit or are hit on a ski hill

The girly small talk attempts of his lawyer were cringeworthy and several of her questions/observations were beyond embarrassing. Must have gotten her out of the bargain bin. 😬 I'm not a fan of Gwyneth Paltrow but I saw nothing in her testimony to indicate it was anything but the truth.

The witness already testified he could not distinguish between the color of the ski outfits. His testimony already is on record that his color blind statis, he was unable to tell once on the ground the two people were unidentifilable from each other. Who was on top, other that he said GP scooted forward and got up.

I was thoroughly convinced that Gwyneth was lying and I was angry with her until I watched the case and I believe Gwyneth and I also believe the fact that she’s putting her children up there makes her look even more innocent because I don’t believe there’s a woman on this planet that wants to do that to their kids (well except for Amber Turd) so actually I’m really sorry I didn’t believe you at first Gwyneth.

As a long time skier (with 1 son and 4 grandchildren) I can completely relate to the skiing accident described as I had few similar instances being hit from behind (by both male and female) and I believe Gwynet's report is genuine (I am not her fan). My observation is that she is doing big dis-service to herself with her mouth and face mimics - projecting discomfort, impatience and even superficiality - but it could be that she is genuinely nervous and annoyed that she has to go through the whole process even though she was not the perpetrator causing the accident.
So far into the case, I believe that the accuser and his family and his witness have colluded to extort money from the famous actress as she seems an easy target. Not withstanding sympathy for the accuser's suffering after the accident he caused, I hope the judge will rule in Gwynet's favour.

Throw this case out of court! The pursuant is required to sue the skiing facility, not a skier on the slope. If the pursuant is accusing Ms Paltrow of an accident, then he is at least equally as guilty of injuring her as well.
She most certainly did not intentionally injure him, it was not premeditated, and he was the one that rammed into her. Obviously the pursuant wants to exploit and extort money out of a wealthy celebrity.

@@MattB787 Oh no, I didn’t mean the color blindness, but if you have a severe astigmatism or are nearsighted then 40 feet is far. I can only see shapes up to 5 feet in front of me, after that it’s just a massive blur. Even with my glasses my vision isn’t great & I wouldn’t be able to definitively say what I saw in the distance. No the color blindness has nothing to do with it unless she was wearing a certain color he couldn’t see but that didn’t seem to be established from what I heard (only that she probably has a more expensive ski suit than others by the lawyer’s weird commentary.)
