- Balwin Properties has come under fire for its new rules at the Blyde Riverwalk Estate in Pretoria. But, it now seems there are new rules controlling access to the lagoon that saw protests from short-term lease holders a few days ago. Its like staying at a hotel you can't invite your whole family and friends to visit for FREE.....
Some tenants abuse the visiting rights.. they say 2 but then 5 to 10 arrive and want to use the facilities......
And why is that a problem ?its their property ..they pay for it

my only question though - "is striking the best approach?" Why not get a lawyer to deal with this matter because I am sure these short term tenants can afford to hire a lawyer if they clubbed in together?
No, it won't be south Africa if you don't protest at a drop of a hat. They probably know that the lawyer will refer them to their lease agreements.

Actually when you book an Airbnb there is a limit on the amount of people allowed to stay. Eg 1 bedroom limit is 2 adults and an infant under 2. Meaning the difference between a the number of residents that would occupy that is not much different to guests. Baldwin know that their hotel cannot complete with Airbnb prices ( My stay was 650 a night for a 1 bed apartment for two adults all amenities included) so they are eliminating the competition, which is sneaky considering that they attracted investors on the premise of allowing short term letting and now they changing the rules on them because they can see the profitability of the apartments.
Nice lie there chief.. the Arke app allows you to send a code to 1 person to enter. What always happens is that it will be 1 person in a vehicle with 10 others. The HOA have every right to clamp down on these people. They dont even live in the estate so how can they understand what permanent residents put up with. Thanks to these greedy owners who are protesting aimlessly, this estate is more like a student res or even a zoo now with all the noise and dirt and lack of consideration these tenants bring. Peoples property value will go down so Balwin are doing what they have to in order to maintain the estate. Nobody cares whether you cant let it out on bnb now. The people you let out your apartments to are uncivilised and unruly, you abuse the estate this is what you get in return
That's the same issue arising at the Parks Lifestyle Apartments in Riversands. Especially from Friday to Sunday. There's people who invite their visitors, they party, drink, braai, make noise until late hours and leave the place looking like a mess and for those of us who stay here, waking up to the aftermath the next morning isn't ideal and don't even get me started on the fact that we are still in a pandemic and there's barely any social distancing in those social gatherings.
Black people - lets just band together and build our own urban estates.

You already have built your own urban estate in several parts of the country. Each unit is tin-roof style and every tenant can live without contributing anything. Electricity, water, levies, rates, taxes all for free. No food money needed for the estates in kzn and gauteng. Theres annual looting so as a resident in these estates you can restock on all your essentials for the next 12 months too.

That won't solve everything. I have shares in a company that owns units for short term letting. I'm one of hundreds of thousands. They had set rules set at the beginning. That's why short term letters bought units. They can't just solve anything by doing what you suggested.

Baldwin was happy to sell units to these investors by attracting them with STL and now they are flipping the script on them. That is not good business practice.

Some people are very inconsiderate and rules like these protects the most of residents of these estates. You pay for the privilege to have all this, then it turns into Durban main beach with sould systems and no security for your children at the same time. If you don't like the rules, move.
By short-term rentals are you speaking about Airbnb? It is crucial to note that at a hotel you still do not have a right to invite more guests to use the facilities. Usage needs to be paid for. Simply look at Sun City as an example of what day visitors have to pay to use the facilities.
But at suncity, the short term renters doesn't pay to access the valley of waves, short term renters are technically also residents and shouldn't be charged to access the lagoon. Only their visitors should be charged as well as guests of home owners residing in the estate.

@@theapparelreportpodcasthos2274 well the new rules introduced requires short term renters (classified as guests) to pay to access the lagoon. That on top of airbnb owners being required to pay double rates so where is the fairness? Seems to me that the new rules are just designed to drive out short-term renters business and thus putting investors who bought multiple units will the lagoon being the main attractive feature for short term business at a disadvantage.
I agree that visitors shouldn't be allowed access to the lagoon, the estate has 1100 units and is already crowded on its own. The place is a residential area, allowing visitors to pay with create more issues like high noise levels because well they paid for access.

What is this short term letting, and why do you have to bring in the whole village if you a short term tenant, if you book in at a hotel ,a room for two, does it mean I now have to bring in a whole taxi full of my friends to come chill with me by the pool side.

This is a problem where people live in complexes or on an estate! Rules need to be followed to ensure that security and peace prevails. There cannot be rules to suit individuals unfortunately. Lodge complaints or your needs ahead of the meeting to be heard.

Totally agree. This is happening with other complexes that are owned by the same people and on board and the tenants have no say in the constant changes that they rented the place for the existing conditions. It is shameful and a disgrace as they are the ones paying their (or towards) mortgage bonds. The tenants are literally left out in the cold in all their decisions. I many cases so are some of the owners that also have purchased.
