I am doing a matter at the high court where plea of the Defendants were taken and on the next adjourned date the prosecution brought in another charge which was filed with a different case no from the one the Defendant took plea without a motion on notice nor even serving us ... They applied for a substitution of the previous charge thinking they were amending it. I objected to the procedure and informed the court that the right procedure is for them to come by way of motion ND the court ruled that that can be done orally off record. The court ordered them to serve me therein. When they were allowed to make the application I objected to the application that the charger they have brought is different from the one the Defendants took plea a date was taken for rulling. Please from this scenario shed more light.
Ordinarily, amendment of charge can be done at anytime before judgment and should be done by way of motion. The ACJA and the ACJL of each state provides for that, please check the appropriate section for the state in which you practice. You should ordinarily object on point of law stating this section of the law regarding the mode of amendment. Plea ought to be taken on the charge before the court so if it is a fresh charge and not a mere amendment plea should be taken again. Plea taking is very crucial and can be a ground for appeal. This is how I view the scenario. Please let me know what is ruled.

As many times as necessary. Remember you will file a motion and affidavit in support convincing the court of the necessity so it has to be absolutely necessary. You can amend any time before judgment as the prosecution.

Correction to sect 411 of the criminal code the punishment is liable to 14yrs imprisonment.
