    Typical case of a deadbeat dad who gets a girlfriend who pressures him to get custody for control and financial reasons. Gross.

    A parent should avoid living with or pursuing a relationship when you're trying to gain custody of a child as that never seems to end well.

      She already had primary physical custody while she was with that long-term boyfriend; she wasn't fighting for custody. Now she is fighting, but it appears she's not in a relationship. Dad's married, so that will probably work to his advantage, whether or not it should, considering he must have been dating this woman at some time while he had his custodial time as well. Funny how history can be rewritten. Single people date and single parents use babysitters; but walk into family court and watch it be portrayed as irresponsible or unstable.

      @@catherineeckstein2705 You're right, that should be the case, but it's not when it comes to a custody case. When you get family court involved, everything's their business, and by extension, the opposing parent. Dad dons the cloak of the respectable husband while mom's made to look unstable because she dares to date or live with someone or use a trusted babysitter. Just look at some comments here; too many people fall for this narrative -- half of them have probably been single parents themselves, dated, used babysitters, and don't have a totally clean past. It's amazing how people forget their own past and struggles while they judge others in comments sections. :)

      @@catherineeckstein2705 legally speaking, it is when a child is involved. Because that child will be around whoever is in the moms life. This is why the court can make a ruling that no one of the opposite sex that is not a relative or married be allowed around that child. Not sure if you’ve ever dealt with child custody… but this is a common thing and for a good reason. What if the mom was being abused in front of the daughter?? Or worse, the daughter being abused by the moms boyfriend?? It most definitely is his business. And the same goes for her if the shoes were reversed

    Bigen, it's really surprising that Dad's attorney and the Judge felt they had to ask the Mom if she minded Dad's current wife was in the room listening to the hearing .. she is going to be a testifying witness, and should be sequestered from listening to the hearing until after she testifies. This is already starting out ridiculously. If nothing else, the Judge should know better; he should be the one enforcing the law, not questioning it.

      True, but if she's a good step-parent and a good advocate for the child, then she deserves respect for that, too.
      My son's Stepmom helped us raise him, whether I liked it or not. When she gor pregnant, I shut down any and all animosity, and we *all* got along for YEARS. Seriously, my son's little brother never knew that we *brawled* in the streets like trash, back in the day!
      He just installed my new bathroom sink, in fact. I told him, "See? My evil plan worked! I was NICE to you, and now that I'm OLD you're totally taking care of me, bwah ha haaah!"
      But MAN did I used to *despise* his Mother. Made her sit in the car for 3 years at drop offs! I should've had her in for coffee, talked about my son, COMMUNICATED, and most of all I should have *thanked* her for being SO damned *good* to my kid, regardless of his Dad and I's horrible animosity.
      Now THEY'RE divorced, Stepmom is on a spiritual awakening in India, and the Ex just completed their gender reassignment surgery,. NOW, THEY want me to hate the Stepmom for "abandoning" her.

    So far, even with the police record, I’m leaning towards the mother’s side. She’s handling cross exam very well…not getting angry, only making a few remarks. None of the situations the lawyer described should keep her away from her child. There is no parent who has emergency daycare 100% worked out. People figure this stuff out on the fly, and it doesn’t mean you are a bad parent. On the other hand, some of the father’s lawyer questions to her are pretty inflammatory.

    My only quibble with the attorney's opening statement was his seeming dislike that the mom had the person she's staying with take the kid to school. Mom ensured the kid got to school. I don't think it matters if she took her or had a friend do it. She got the kid to school. As long as the kid was on time, I don't see a problem

    • @lulujac9196

      So you wouldn’t mind a man you don’t know taking your 12 yr old daughter to school???

    • @Mewse1203
      @Mewse1203 ปีที่แล้ว +4

      @Lulu Jac does your ex not knowing your friend mean your friend can't take your kid to school?
      Would I let someone I don't know take my kid? Not if I had my kid in my possession. Would I be upset if my ex tried to tell me someone I knew and they didn't couldn't take my kid to school? Yes, because that's an unreasonable request. Do I know everyone my ex knows? Do they know everyome I know? No... and therefore I don't get to dictate who they have around my kid, generally. Specifically, there are obvious exceptions, but just because I don't know a person doesn't mean my child's other parent doesn't know them as well. If they know the person and I don't, which is the situation here, unless there's a specific issue, one parent doesn't get to dictate who the other parent has in their kid's life.
      I'll give you an example of why this is BS:
      Mom has a kid with her ex. Mom's sister is married, and sister's husband, the child's uncle, has been around the kid 8 of the 9 years she's been alive.
      Mom's husband gets sick and has to go to the hospital. Mom asks her brother in law, the uncle, to watch her kids while she takes her husband to the hospital.
      Dad doesn't know the uncle because they don't intermingle. Is it reasonable for Dad to be upset?

    • @leslie974
      @leslie974 2 หลายเดือนก่อน

      @lulujac9196 exactly. When a child lives with someone who isn't directly related to the child it puts that child extensively higher risk for abuse. No male should be driving her to school that isn't directly related meaning father, full brother, grandparents.

    • @Mewse1203
      @Mewse1203 2 หลายเดือนก่อน

      @leslie974 risk =/= actual abuse. By your definition, I shouldn't be able to be around the step kids I raised since they were 2 and 5 even though they are now 13 and 16.
      New people, absolutely. But this entire position is completely unreasonable for people, you know. You can't just go around assuming everyone is an abuser. Most people aren't.
      You take reasonable precautions in the beginning and then apportion your allowance to the trust you have in that person based on evidence.
      And people are abused by their parents more than any other group of people....

    • @leslie974
      @leslie974 หลายเดือนก่อน

      @Mewse1203 well even though I was raised with a stepmother and brother from a very young age. I don't remeber them not being around. I was still abused by both. So it doesn't change the statistics that anyone that is not directly related to the child, statistically raises the chance of being abused for the child. Now as to my statement that no one should be driving the child...that was referring to the circumstances in this video alone.

There has been no question of the safety of any other person in the child's life connected to Mom... just whining that mom doesn't drop child off herself. It doesn't friken matter who drops the child off so long as the people that are around her are safe and dad never questioned that. He is just being petty and controlling and thinks he has the smoking gun with that issue and he doesn't. It's OK for stepmom to drop child off to school but man if I insist mom do it personally I can screw with her employment and if as a result her employment doesn't work out I can then further demonize her using the employment issue.

    Say what??? She makes $21 an hour at Tyson Foods with a criminal record??? Geeez!!! Hotel housekeeping and maintenance staff who work their butts off only get paid about $12 an hour!!! No hotel could be in business without these workers ... they should get paid $20 an hour. Anything less than that, is not a livable wage!!! Also, when it's a slow season, their hours get cut in half!!! Guess, Tyson is at least taking care of "their" staff!!!

    Ooooo this is was a cliffhanger cuz I can’t decide. I think the judge should just do 50/50 custody and use family wizard to coparent what’s the best thing for the child.
    Ok I have thoughts about moms jail term. Here’s what I think happened:
    Mom sounds like she had a bad break up with her live in bf. They lived together and they broke up…
    but she was still living in the house with the exbf and even tho they were broken up she still treated things no different than before, as if they were together, like he was supporting her financially. and then BAM he reported she used the card without permission.
    The moral of this story is if u break up with your partner do not expect continued use of their credit cards without permission. That’s my hypothesis on the jail situation.
    That’s what I think happened
    On to part 2

    This attorney is asking such irrelevant questions and questions that are not easily answered. She JUST moved into her spot and what does it matter if she has her own place or rents from someone else. Or if anyone helps her financially?? It's a cheaper situation for her. What does that have to do with her ability of being a mother. Theres a reason theres a mother and father create a family because they work TOGETHER. Then all of a sudden after a breakup a single parent has to do everything alone. That's ridiculous to expect anyone to bounce back when they've been a stay at home parent. This is nutty. She doesn't even have to answer any of his questions about her convictions unless her child was with her. Also the fact that the father withholds information about the daughter's school from the mother is so petty! Like he wants the mom to fail, but what these "parents" don't get is that it hurts their child. Actual loving caring parents do what's best for their child not their personal preferences about the other parent.

    I think Dad is very much like his name dodgy. Mom is telling the truth ...she's just not in a very good situation right now and that's probably going to count against her. I'm guessing at this point the judge is probably going to make her find more stable living situation get daycare established prove up everything before he gives her custody or joint custody because it goes by wasn't the best interest or child and unstable living situation (basements are not good as apartments...no easy access exit in case of a fire...it's a code thing here) is not best for the child.

    I don’t think she should have weekend visit’s, the people she lives with are strangers, the child is a little girl and shouldn’t be subject to men even the other so called boyfriend was a stranger. She should get a place for herself then request custody, get three jobs if you need to. Given that this is part 1 I don’t see her getting custody of her daughter.

    Any parent who has been absent for any amount of time and/or doesn’t fully utilize their court ordered parenting time shouldn’t be able to judge and grill the other parent about how things were done. If you don’t get along there’s many apps you can use to keep in full contact and coparent peacefully. Yes she’s not been perfect but dang his attorney (and I agree with her about the child support being behind that much but can pay an attorney??) really went over the privacy line with the questions. Just my opinion. I fully agree with the cohabitation not happening but even being married doesn’t make the possibility of something bad happening by non bio person any less unfortunately.

    Obviously subject to change, but it sounds like a tale as old as time (or at least the mid-80s).
    Couple get married, have a child, Mom takes care of the child and Dad provides for the household. Dad leaves. Mom has to figure out how to make it on her own after never having been in/a decade or more since being in the workforce. Dad has reasonable visitation and child support, but is sporadic in visitation and payment.
    Dad gets a new wife.
    Now, Mom is "withholding" the child, who "thrives" with him and New Wife. And how can Mom care for the child anyway, with her work schedule and sub-par housing? Don't worry! New Wife stays home with the kids in a lovely home Dad and New Wife own, so New Wife can take care of _all_ of those needs.
    My only real criticism is that *no boyfriend/girlfriend should be living in the same house as an unrelated child.* The risk of abuse jumps up enough when an adult married to the parent of an unrelated child moves in. It _soars_ when an adult who is _unmarried_ to the parent of an unrelated child lives with them. Just don't do it.
