Whether he was using personal phone, on a break, waiting for a surprise, he was at his employment on a working day so any footage is governed by GDPR. There is no excuse and the very manor in which he was holding his phone and pointing it directly at the auditor would make it very difficult to deny that he was recording, no other reasonable excuse to hold a phone like that. If requested with proof of the recordings it is the responsibility of the company to provide copies. How they get them from their employees is their problem and if they don’t provide within, 30 days I believe, then they face substantial fines and penalties. Refusing to give names or contact details of their data handler already breaches GDPR rules and could result in a fine. Now go do your own research and stop asking stupid questions, it’s boring and I have other considerations in Kyiv at this time

So many people completely misunderstand what GDPR and the Data Protection Act 2018 is actually about. It doesn’t legislate on how the data is gathered, such as filming, other than the collection the data is for specific, explicit and legitimate purposes. What GDPR and the DPA is primarily about is the storage, processing and security of the data held by an organisation. I have heard some auditors say that the data collected by them has to be stored for at least 30 days. However in reality the data should be deleted as soon as it is no longer needed for the purpose it was originally collected. The rights of the Data Subject to access the data, ask why and how it has been processed and request it is deleted is found in Section 45 of the Data Protection Act.
Now i was under the impression that employees of all companies that handle data had to be trained in GDPR. Yet these staff of a tech company dont seem to know anything about how it works.

I've seen plenty of videos where ex squaddies (inc officers) have come out to see what's going on. They have invariably been polite. It's part of the training. Next time someone claims to be ex military ask them for their last 3. If they don't know what you mean, they aren't ex military. We *all* know our last 3. Even the Pads brats and Pads missuses, know our fathers and husbands last 3. When I woke up from an operation in BMH Rinteln (British Military Hospital) the nurse made sure I was properly awake by asking "What are your husband's last 3?" Even still doped and befuddled I could croak "769"..............
