The Supreme Court has decided to examine if a divorced Muslim woman is entitled to a claim of maintenance under Section 125 of the Criminal Procedure Code (CrPC) against her former husband - reigniting the debate on whether secular laws should be given precedence over distinct personal laws. On February 19, a bench comprising Justices BV Nagarathna and Augustine George Masih reserved its verdict in the case.The dispute arose after a Muslim man challenged a Telangana High Court direction to pay ₹10,000 interim maintenance to his former wife. He contended that maintenance in this case will instead be governed by the provisions of the Muslim Women (Protection of Rights on Divorce) Act, 1986 (1986 Act). Earlier, the court had appointed senior advocate Gaurav Agrawal as amicus curiae to assist in the matter. Section 125 of the Code of Criminal Procedure (CrPC) is a provision in Indian law that deals with the maintenance of wives, children, and parents. It is a measure of social justice aimed at providing financial support to those who are unable to support themselves. Here is all you need to know about Section 125 CrPC.Maintenance during the Iddat: The divorced woman is entitled to a reasonable and fair amount of maintenance for herself during the ‘Iddat’ period from her former husband. Maintenance after the Iddat: The divorced woman who remains unmarried after the Iddat, and is unable to maintain herself, is entitled to get maintenance from her such relatives who would inherit her properties upon her death. In the absence of any such relatives or, where they have no sufficient means, then ultimately the liability to maintain her is cast upon the Waqf Board of the state in which she resides. The Muslim Women (Protection of Rights on Divorce) Act,1986 has now made the operation of Section 125-128, of the Criminal Procedure Code, 1973 optional in respect of Muslim woman.
