We have configured SPAM emails to be quarantined and then notify the user daily. is their a way to allow the user to only review but not release the email? kinda defeats the purpose of quarantining and it would be bad practice to give control to a user to be able to release a potentially nefarious email..

All the features of Office 365 ATP will get enabled on complete tenant as Microsoft don't enforce for individual users license, However you will not be legally compliant to licensing policy if you apply policies to more users than no. of licenses purchased. Feature like ATP Safe attachments, Safe links, Anti User Impersonation etc will work on users on which these policies are targeted.

Yes, they do it now. At the time of recording they didn't have this default policy concept for Anti Phishing.
