- A German ships sinks in the Bay of Biscay, all seamen die. The tragedy has not been investigated , because it sailed under the flag of MALTA. The captain had no licence, the ship had a big hole, the stability documents were falsified. Ships under flags of convenience frequently are scenes of crime.
This is appalling. The indifference of the Commission, the company itself, the casual, smug intentional dismissal of critical information is disgusting. Every last one of them demonstrate a complete lack of conscience. Corporate psychopaths.

The same thing happened 200 - 300 years ago. Over-insure the ship. If it survived, profit from the cargo; if it perished, profit from the insurance. Seamen? What concern are they of ours?
At the time of Scantrader loss I was working in a ship's agency in Le Havre (France) and the vessel called our port shortly prior to the sinking. I did not go on the ship myself for that particular call, my colleague was in charge. I learned about the loss of the vessel from the charterer in London, who was appointing us as agent, I guess we were on the phone talking about usual business when he asked me he I had learnt about the accident and I replied no. Very sad to hear years later that nothing was made to fully investigate that accident as it should have been. The quantity of cargo loaded was without no doubt mentioned on the bill of lading which is among other things a receipt for the cargo delivered on board and this document can also be used for selling the cargo. So for sure the actual cargo weight was indicated on the B/L. In Le Havre for every single call of cement carriers for which we were the agent for the same charterer a cargo surveyor was appointed to check and validate the figures mentioned on the bill of lading. Respects to the crew and families of those lost in this tragedy.

Welcome, shore dwellers, to the reality behind your cheap foreign imports. Crews that are overworked, underpaid if they are lucky, and easily sacrificed by the company for profits. Almost every shipping company is like this.

It's the same thing the world over. He who has the money controls the law. The real criminals walk away as though nothing had ever happened. The best "justice" money can buy!
I could not believe that the vessel filmed at the cement company dock was allowed to set out when there was no freeboard and the deck was virtually awash on the vessel that was bought from a salvage company!
The vessel was unseaworthy, irrespective of what it's inspection certificates indicate.
As Crew, if you allow yourself to be so mistreated and you go to sea on a vessel which you know is wholly unseaworthy, you are literally contributing to your own death!
That such vessels are not impounded and and the companies prosecuted is utterly shameful.
Beutler got a suspened sentence of 8 months and had to pay 20,000 DM. Considering every overloading brought him 10,000 DM I don't think this hurt him much

In 2019, him, his son, and their manager are in court on reinforced charges related to the Scantrader.
Never should a ship be able to be registered in a country like Malta that does not have a Maritime Investigation Unit. A ship registered is such a country should not be allowed into another country’s waters.
If an Airline company does not adhere to safety and maintenance then the airline is banned and so it should be. This should be the same for shipping. No ships don’t drop out of the sky, but lives are lost, cargos are potentially very damaging.
not only that, but sometimes such ships can sink at harbor entrances, in docks, or close offshore where they become a hazard to navigation and a pollution problem
Thankfully there are still those who demand accountability and justice for the innocent victims.

The world feels cold and cruel enough as it is, but hearing how people were treated by the law and their employer etc in this video is just horrible.
Its a shame that even cruise lines even flying flags of Convience. One of these days a ship will sink and kill hundreds under a flag of Convience and lines will have no choice to act up. But I have my doubts they will learn.
I've been naive to think the American MBA ethos is to blame for exploitative and immoral business practices. It's clear businesses worldwide have arranged circumstances to maximize profit while obscuring responsibility for dangerous practices. How can we do this ourselves? Such a species is destined for extinction.
Geez...think about it. America is a young country, founded by immigrants, populated by immigrants who brought their OWN ways with them. I suspect insurance fraud! They did this on purpose without the complicity of the crew. Way overloaded them with a destination through rough waters then forced the capt to sail with bad information or against policy ensuring it would sink
This has been the story with shipping companies since the the 1500 hundreds , the phrase " you have a deadline " could not be more apt . What I find extraordinary is the fact that the polish load master was in complete ignorance of the ballast requirements for this ship .

At no point did this documentary address what part the insurance companies play in this. One would think if a ship is overloaded past the Plimsoll marks or other defects are known, there must be some method to report it to the insurance company or some known entity which would report it to the proper company. Certainly, there must be a pool of insurance inspectors available at ports which would look into something like this. When there are millions of dollars of liability in something, they must be interested. In fact, I would think there would be a fee paid to someone by the companies reporting unsafe situations. If a captain is being pressured to do something, he would be protected if an insurance inspector receives an anonymous tip.
Agreed. It's very strange. The insurance company was said to have paid out 100,000 Dm for each crew member which was nearly 1million Dm alone. Then there was the (over)value of the ship and also its cargo. Knowingly overloading your vessel and failing to maintain it would both surely invalidate the insurance. They certainly do on leisure craft. You'd think an investigator would've gone through the paperwork and testimonies with a fine-toothed comb in order to get out of any liability. What kind of insurance company just coughs up millions without so much as a by-your-leave in the third millennium? They'd go bust in no time.

Seriously, you'd think there was some kind of clause of what the insurance policy covered and one of them not being over loaded. Insurance companies don't want to pay out money for a claim %99.99 of the time.
The Classification Society seems to be very much at fault,ie Lloyds,ABS,they inspect ships for their seaworthiness and will arrest a ship if it was in that condition.However they all use a flag of convenience which may allow to them to select a classification society that can be bought off.I have sailed on many different tupes of vessels,some as a Chief Engineer,others as 2nd.Eng,,they run to very fine schedules,For example,a cruise ship,passangers have read the brochure maybe 6 months to a year in advance,so if the itinery says the vessel with be in this port at 0600 hours on this date,,,it will be there,I have seen exhaust fires because of this.A cargo vessel is under other types of pressure but it is all time,you may have perishable cargo,penalty deadliness etc,,hence Captains taking risks.Anyway,the insurance company would have had a copy of the Classification Societys document of seaworthiness,which would ,by the looks of the vessel would have been false.The insurance company would not have set foot onboard,the cargo was probably worth more than the ship,and that would have been insured,for the permitted weight,not the actual weight.The owner was an ex-captain,he would have known the extra weight could not be classed as ballast and was a potential hazzard.This is happening now,every day.

That's mind blowing just look at 31:02 and 31:25, it shows how extremely overloaded that ship is, it's crazy the deck is almost even with the water. If that ship encounters a bigger storm it will sink instantly. What the hell are these greedy companies thinking, especially after the tragedy that just happened because of overloading. They overwork their employees while stealing their money, that they worked extremely hard to earn. I swear this just pisses me off.
Agreed. I'd sooner beg in the street than sail on that bucket. The maritime business is one of the last unregulated disgraces throughout the world. Even the rich western nations are complicit. They're no more scrupulous than people traffickers. On average, a thousand merchant sailors have lost their lives each year for the last decade. It's feudalism on the ocean.

The trucking industry and commercial flying work the same way, blame the one on scene, Pilot, driver, who ever is at the bottom gets to accept the heat. Truck drivers have always been held responsible for overweight tickets no matter the reason. I have drivers get fired for not accepting a load for good cause.
Pay your staff!!!!!!! Don't overload your vessels so they sit way too low in the water. [without ballast?!!] Maintain your vessels..it ain't rocket science.

My Daddy owned a trucking company in east KY for several decades back years ago. When I was a child I was aware that there was an accidental death. A coal truck had the truck bed (back) up for some reason. The mechanic was attempting to put some engine oil in it. What no one knew was that the top of the truck bed was touching power lines. He was killed when he placed the oil on the truck. We knew, justifiably so, that there would be a lawsuit. Years later I went on to marry that unfortunate man's nephew. My Daddy asked my husband if anyone ever got the insurance money. Therefore I have never heard of an insurance company giving compensation for a death to any company directly. This makes absolutely no sense to me. Whomever screwed over that poor family from India...well if they do not pay on Earth, they will be held accountable in the hereafter. This makes me so sad and angry at the same time. Anyway, have a great day/night guys and gals.
Why not? It all has to do with who the beneficiary is listed as. Companies sometimes buy life insurance on key personnel. I'm pretty sure you can buy life insurance on anyone as long as you can prove their death would impact you financially in a negative way (ie- like one of your key employees dying).

What needs to happen is each country ban entry to there ports for any ship that is flying a flag that is not the flag of the country where the ship is owned.
you couldn't do that. You'd almost completely eliminate commerce. What you could do though, is refuse entry to ships flagged in a country without a maritime court of inquiry (or who's court was essentially "kangaroo")
If the engineer was scared, he should have reported the ship, and shouldn’t have sailed.

I highly doubt it, beutler just wanted to keep most of the profit instead of actually repairing his fleet or care about his crews.
The ships captain is responsible for the vessel and the cargo. Flags of convenience act as a get out of jail free card and allow vessels to operate under lower standards and therefore higher profits.
Only good thing accomplished was the charges for murder. Bravo to all who investigated, produced this documentary and brought about the outcome showing negligence.

Somebody chartered that ship to carry the cargo, which was in excess of what the ship was permitted to carry. Were they aware of this? A charterer, too, is part of the picture in cases like this.
