The bill passed and now HOA's can't foreclose on a home unless its more than $1000. Also the maximum amount of violation can't more more than $100 per violation and can't exceed more than $1000. Which really eliminates liens and foreclosures.
@ZEEZombino The problem is there are a lot of incentives for new construction to be in an HOA from a builder's perspective, so chances are that tiny home you want to buy is also in an HOA. If you want a home not in an HOA they tend to either be rural homes (because they were not built in large development projects), or very old homes, which tend to be traditional size (not tiny homes).
I did some work for a guy who bought a small tract of land, a developer bought all the land around him, then formed an HOA, the guy tried to refuse the HOA forming, but as developer owned a majority of land involved he was forced into the HOA...the developer never started building the subdivision, so the guy is the only house for several miles and he gets fines all the time from the HOA. This was in Florida by the way.
HOAs need to be VOLUNTARY. Freedom of association needs to be upheld. I should not be required to bend the knee to an unaccountable hyper-local extra-Constitutional government just for the privilege of owning a home.
If you're living in a land-leased park, the HOA is required to represent you in regards to issues with the park owner. Why should you get the benefits without having to pay for them like everyone else?

That includes this governor. Take a look at the over 200 laws he put in place in the last year. He's supposed to be an Ivy league educated attorney but his ridiculous laws keep getting overturned by Florida Congress.
The governor did specifically ban trans people from using cheaper nurse practitioners/physician assistants for their specific medical stuff, also lab grown meat. He seems to do some good things but also some stupid political things, most likely hate motivated. I wouldn't eat lab grown meat but people should have the freedom to choose.
HOA started around 20 years ago and cities and counties allowed HOA to exist as a way of taking the burden of taking care of these from the cities and counties and putting the responsibility on the HOA's But now 20 some years later these same HOA's are out of control. My advice to anyone looking to buy real estate is to NOT BUY a condo or in a HOA because you can not control what happens or how much they can charge you. and if you do buy in these areas don't blame anyone but yourself when things go wrong.

I conpletely agree with you! We loved the HOA we lived in. There weren't cars parked all over the streets so no one could get through. The houses were well taken care of and kept the property values high. We voted in, and out, who was on the board, along with a management company, and it was great. In Florida, I bought a place with an HOA, and many of us were upset when they were voted out. The 4 wheelers racing down our streets and drag racing, etc. was too much so we moved.
HOA’s have been around formerly for over 100 years in the US. The basic concept likely goes back to Ancient Rome. Even older is the practice of people who know virtually nothing about something acting like they do and even having strong opinions about those things.

We built a home in early 2000 and had an HOA. Those were the days. It was a gated community, tennis courts, pool, cabana, stocked lake. Our HOA fees were less than $400 a year!! It was definitely needed. A family with 10 kids continued to have parties after the pool was closed and would throw the pool furniture in the pool and break the pool water system. Some people decided to paint their houses bright purple and flouresent pink!! It helped A LOT then. This stuff is too far.

Here's the issue first responder vehicles and tow trucks are legally labeled under Florida state law as an emergency vehicle and Not commercial, therefore HOAs never had the right to ban them to begin with. The issue is some hoas believe they are above state and federal law because it's private property , they can do what they want. No one is forcing anyone to purchase a home that is in a community that has an HOA. I purchased a home in a new development in 2008. Big mistake. The development looked like a 3rd world country by 2016. I left and bought into an established 15 year old community with an HOA. Homes and properties here are and remain pristine. 🤷🏽♀️
I get it.. I live in a non-HOA community and it is depressing how others impose their trashy ways on the neighborhood. HOA’s have their place but probably need to be regulated as some are just too strict with the rules. My sister was fined because her garage door was left up.. that’s a little much.

I have neighbors that park about 6-8 vehicles in their yard, ruining the swale and making everything look run down. Other neighbors who disrespect noise ordinance at sometimes all hours of the day. HOA's are really tempting to me because i want to be proud of my neighborhood, but i also dont want someone telling me what color my house can be or qhen to move my trash can.
Couldn’t agree more! We must live in the same neighborhood. Numerous cars parked on the grass, garbage cans left out for days, yards never mowed. It’s depressing to walk through my neighborhood. I do believe HOA rules need to be regulated though.. some are out of control. There is one HOA neighborhood nearby where the homeowner can’t park in their driveway, they must park in their garage. Rules like that give HOA’s a bad name.. in addition to the escalating monthly cost.

Most of the time it works. but the MINUTE you give the management over to a 'management' company.. then the fines come.. and the management companies are all about fines. how else will they make more money?? They get a percentage of the fines. sometimes all of it. My HOA was great until they did this. I sold and moved within a year. And bought a house that is not in an HOA and will never be in one. The city I live in has enough rules to be just about as bad as an HOA. Maybe they need to look at that next.

Now in Florida they have something worse. CDDs another property tax. Once sold as just for a few years to pay for development of the area. It never ended 😂, just like tolls. So you pay HOAs, CDDs, property tax, and property insurance. All fees that always go up and up. DeSantis approved all rate hikes. So all this companies plus all utility companies are living their best lives. And Floridians are paying 2x - 3x the cost of just a couple of years ago.
My HOA won’t tell me when they do their inspections. I said “so if I mow my lawn every single Friday, and you take pictures every single Thursday- I’ll always get violations, but if I mow my lawn on Wednesdays I never get violations. I don’t think you’re rolling dice before you go take pictures of the neighborhood, so there’s must be a plan. There’s no reason not to disclose that.”
Here in Las Vegas, most new homes are all HOA. We do not mind ours and they actually took care of our complaint about the new neighbors parking a SEMI TRACTOR TRAILER in front of their home...

I will be in the minority, but my HOA was the only thing that stop my neighbor's dogs from barking at 3am. Local government wouldn't do anything so I just reported them to the HOA every two weeks. And yes I talked with the neighbors about his dogs and received any ear full about "minding my own business".

I understand not wanting junk, trash, multiple vehicles parked in the yard all the tim, yard badly overgrown, anything that detracts from the home and becomes a burden for neighbors or an eyesore, that is reasonable. However, HOAs have become overbearing, fining people for first responders parking, trash cans out all day on pickup days, not allowing people to have guests that park on the street, threatening people with lawsuits. DeSantis is now the only governor that cares enough about FL residents to protect homeowners from this, about time. My neighborhood had an HOA in the process of forming, they got shot down, the original covenants from 1953 at the courthouse that they disregarded for their own personal agendas for the area made this possible.

In Jacksonville, FL the city has an ordinance where you must keep your grass mowed. if someone reports it, the City will come out, mow the lawn and charge the homeowner an arm and a leg for it. It works well here.

My condo board blocked cash sales on my unit and there were 3 people on the board but they never included the 3rd person - they declined 5 hispanic buyers and i lost over $9k in purchase price,taxes and maintenence on it. I finally got a litigation attorney to send a threatening letter and was finally able to get it sold. The attorney said its a waste of money to take it to court for it would cost me more in the long run. I would never live in a community where you have less power or control ! Before being on an HOA Board you HAVE to take the course that is required!!! I live in one and about 2 years ago, a number of home owners had issues with the then president. We contacted the DBPR in tallahassee, they did nothing. WE had proof of some infractions regarding MONEY. We wrote to the useless Attorney General Ashley Moody who didn't even have the decency to respond at all.

I also think about older people and the HOA telling them they have to pressure wash the roof, the driveway, change the mailbox, etc, etc, etc. When you pay off your home on retirement, your only income is your retirement, you don't have the ability to do some of this things yourself. And someone could take your home away because you can't afford to pay someone to pressure wash. That's actually pretty terrible. I also think that if you bought your home for a price your taxes should be based on that price. Because your home could also be taken away if you can't afford your property taxes.

You don’t like HOAs, then don't move into a community that has an HOA. No one is forcing you to live there. Besides, the HOA isn't a separate entitity. The body is literally made up of people who live in that community. As a resident of the neighborhood, you can run for office, and you can vote for rules you want to change. I happen to like a lot of the rules set by our HOA such as no parking your car in the street or in your lawn. Things like that look junky and may be better suited for other neighborhoods.
Our neighbors mom just passed. She lived in a ritzy neighborhood near Jacksonville FL Her house was payed off and her HOA payment was $1300 a month. Now our neighbors have to pay that until the house is sold.

The governor did specifically ban trans people from using cheaper nurse practitioners/physician assistants for their specific medical stuff, also lab grown meat. He seems to do some good things but also some stupid political things, most likely hate motivated. I wouldn't eat lab grown meat but people should have the freedom to choose.
HOA started around 20 years ago and cities and counties allowed HOA to exist as a way of taking the burden of taking care of these from the cities and counties and putting the responsibility on the HOA's But now 20 some years later these same HOA's are out of control. My advice to anyone looking to buy real estate is to NOT BUY a condo or in a HOA because you can not control what happens or how much they can charge you. and if you do buy in these areas don't blame anyone but yourself when things go wrong.
I refused to sign an HOA agreement when we moved in but that didn’t matter because Pasco County took over the HOA’s punitive measures here in New Port Richey, FL. We feel we’re prisoners.

I conpletely agree with you! We loved the HOA we lived in. There weren't cars parked all over the streets so no one could get through. The houses were well taken care of and kept the property values high. We voted in, and out, who was on the board, along with a management company, and it was great. In Florida, I bought a place with an HOA, and many of us were upset when they were voted out. The 4 wheelers racing down our streets and drag racing, etc. was too much so we moved.
HOA’s have been around formerly for over 100 years in the US. The basic concept likely goes back to Ancient Rome. Even older is the practice of people who know virtually nothing about something acting like they do and even having strong opinions about those things.

I have. As a realtor most ppl moving to Florida from places like NY want an hoA. Most other ppl hate them but these new yorkers tell me they want hoa so the area stays nice. I told them most ppl here live nicely but I guess they're so jaded from their experience in nyc they're willing to give up freedoms and have other ppl govern them. Also, a few have expressed interest in running for the board. I tell them that's great but In my head I'm think what bastards they are coming here and trying run things.
I'm sure you'd enjoy a well kept road, sidewalks and streetlights that normally wouldn't be there without an HOA.

I have lived in non neighborhoods and now live in HOA home. I like living with a HOA because our streets are free of RVS and boats , large commercial vehicles staring me in the face each time I am outside my home. If you do not like the HOA rules , don’t purchase a home in them.

An HOA is a Developer or Builder created Association Before the residents buy or majority of residents live in a community. There are Very Limited options in some areas (Florida). Current HOA is a Seriously flawed design

HOAs are good, but they should not be able to foreclose on a property for non-payment of small amounts. Also, the process for foreclosure needs to require some sort of in person interaction.

We built a home in early 2000 and had an HOA. Those were the days. It was a gated community, tennis courts, pool, cabana, stocked lake. Our HOA fees were less than $400 a year!! It was definitely needed. A family with 10 kids continued to have parties after the pool was closed and would throw the pool furniture in the pool and break the pool water system. Some people decided to paint their houses bright purple and flouresent pink!! It helped A LOT then. This stuff is too far.

Here's the issue first responder vehicles and tow trucks are legally labeled under Florida state law as an emergency vehicle and Not commercial,
therefore HOAs never had the right to ban them to begin with.
The issue is some hoas believe they are above state and federal law because it's private property , they can do what they want.
I do believe there are simply too many laws on the book that people don't remember them all.

No one is forcing anyone to purchase a home that is in a community that has an HOA. I purchased a home in a new development in 2008. Big mistake. The development looked like a 3rd world country by 2016. I left and bought into an established 15 year old community with an HOA. Homes and properties here are and remain pristine. 🤷🏽♀️

I get it.. I live in a non-HOA community and it is depressing how others impose their trashy ways on the neighborhood. HOA’s have their place but probably need to be regulated as some are just too strict with the rules. My sister was fined because her garage door was left up.. that’s a little much.
Our governor seems to enact all of these petty laws in hopes of diverting our attention from the real issues at hand - skyrocketing home owner and auto insurance rates as well as affordable housing.

I dont live in, nor have i ever lived in, an HOA, but whenever i drive theough one, im certainly jealous of how clean and tidy all the landscaping looks. I have neighbors that park about 6-8 vehicles in their yard, ruining the swale and making everything look run down. Other neighbors who disrespect noise ordinance at sometimes all hours of the day. HOA's are really tempting to me because i want to be proud of my neighborhood, but i also dont want someone telling me what color my house can be or qhen to move my trash can.
Couldn’t agree more! We must live in the same neighborhood. Numerous cars parked on the grass, garbage cans left out for days, yards never mowed. It’s depressing to walk through my neighborhood. I do believe HOA rules need to be regulated though.. some are out of control. There is one HOA neighborhood nearby where the homeowner can’t park in their driveway, they must park in their garage. Rules like that give HOA’s a bad name.. in addition to the escalating monthly cost.
outlaw them altogether!! It's one thing when the homeowners actually get together and make the decisions. Most of the time it works. but the MINUTE you give the management over to a 'management' company.. then the fines come.. and the management companies are all about fines. how else will they make more money?? They get a percentage of the fines. sometimes all of it. My HOA was great until they did this. I sold and moved within a year. And bought a house that is not in an HOA and will never be in one. The city I live in has enough rules to be just about as bad as an HOA. Maybe they need to look at that next.

Now in Florida they have something worse. CDDs another property tax. Once sold as just for a few years to pay for development of the area. It never ended 😂, just like tolls. So you pay HOAs, CDDs, property tax, and property insurance. All fees that always go up and up. DeSantis approved all rate hikes. So all this companies plus all utility companies are living their best lives. And Floridians are paying 2x - 3x the cost of just a couple of years ago.

My HOA won’t tell me when they do their inspections. I said “so if I mow my lawn every single Friday, and you take pictures every single Thursday- I’ll always get violations, but if I mow my lawn on Wednesdays I never get violations. I don’t think you’re rolling dice before you go take pictures of the neighborhood, so there’s must be a plan. There’s no reason not to disclose that.”

Here in Las Vegas, most new homes are all HOA. We do not mind ours and they actually took care of our complaint about the new neighbors parking a SEMI TRACTOR TRAILER in front of their home...

until you move out into the county where city code enforcement has no power and the county wont do or say nothing to you until you become a major health hazard lol. I will be in the minority, but my HOA was the only thing that stop my neighbor's dogs from barking at 3am. Local government wouldn't do anything so I just reported them to the HOA every two weeks.
And yes I talked with the neighbors about his dogs and received any ear full about "minding my own business".
This is the problem with living in a non-HOA community such as mine. Neighbors don’t respect neighbors.. it’s a “I’ll do what I want world”. So my neighborhood has multiple cars parked in the grass, yards not mowed, trash piled up alongside of the house etc etc. I do agree that HOA’s need to be regulated and ease up on some of the rules which can be ridiculous.. in addition, the escalating costs of some HOA’s make living in one almost impossible.

If you have an issue you can sue the HOA in a civil court. I have zero interest in some rando telling me how to manage my property. Our HOA told a neighbor their pool equipment was never approved. The Equipment CAME With the Pool when they bought it SEVENTEEN YEARS AGO! ABSURD! They were going to make them move it.

I understand not wanting junk, trash, multiple vehicles parked in the yard all the tim, yard badly overgrown, anything that detracts from the home and becomes a burden for neighbors or an eyesore, that is reasonable. However, HOAs have become overbearing, fining people for first responders parking, trash cans out all day on pickup days, not allowing people to have guests that park on the street, threatening people with lawsuits. DeSantis is now the only governor that cares enough about FL residents to protect homeowners from this, about time. Nowadays, most HOAs are a bunch of Karens and @$$holes that get off on controlling others. My neighborhood had an HOA in the process of forming, they got shot down, the original covenants from 1953 at the courthouse that they disregarded for their own personal agendas for the area made this possible.

HOA Homeowners associations have totally overstepped the Mark in my opinion. When it gets to the point where you can lose your home to these organizations, there’s something really wrong and fishy about it in my opinion stop HOA.

In Jacksonville, FL the city has an ordinance where you must keep your grass mowed. if someone reports it, the City will come out, mow the lawn and charge the homeowner an arm and a leg for it. It works well here.

Our city's code enforcement is already strict enough.
Airbnbs exist in almost every neighborhood. Hoas do a poor job of regulating against that and certainly aren’t the solution for that specific problem
@@LP-ct9nk Wrong on every point. Several of my old neighbors tried to do AirBnBs but the HOA shut them down immediately. Their listings were removed and banned from AirBnB website, the owners were fined directly, and no one tried again for the rest of the time I lived there
My condo board blocked cash sales on my unit and there were 3 people on the board but they never included the 3rd person - they declined 5 hispanic buyers and i lost over $9k in purchase price,taxes and maintenence on it. I finally got a litigation attorney to send a threatening letter and was finally able to get it sold. The attorney said its a waste of money to take it to court for it would cost me more in the long run. I would never live in a community where you have less power or control ! Tamarac,Fl Mcnab and University stay away from this drug and crazy people community.
Good. Another upgrade to HOA would be for part of the fees to be invested and profits given to residents. That's a stronger model.

Before being on an HOA Board you HAVE to take the course that is required!!! Laws need to be changed to HELP and benefit the home owners against insane board members that take matters into their own hands. Some people become dictators once on the board.. I live in one and about 2 years ago, a number of home owners had issues with the then president. We contacted the DBPR in tallahassee, they did nothing. WE had proof of some infractions regarding MONEY. We wrote to the useless Attorney General Ashley Moody who didn't even have the decency to respond at all.
That's simply not true in Florida. I am an HOA board member. You either have to take a short course or sign a statement that you have read all the HOA CC&Rs *AFTER* you are elected. I believe you have a 2-3 months to comply according to current Florida statues.

Long time needed. Those rules were put in place to keep sloppy and junkie neighbors from doing that or from using loud colors that were very distracting so things have gotten out of hand, but I do believe there should be some basic rules like junkyards cars in the yard noise ordinance, and that’s about it

I enjoy living in a nice neighborhood. But I also think is ridiculous that HOAs can foreclose on people's homes. I also think about older people and the HOA telling them they have to pressure wash the roof, the driveway, change the mailbox, etc, etc, etc. When you pay off your home on retirement, your only income is your retirement, you don't have the ability to do some of this things yourself. And someone could take your home away because you can't afford to pay someone to pressure wash. That's actually pretty terrible. I also think that if you bought your home for a price your taxes should be based on that price. Because your home could also be taken away if you can't afford your property taxes.

How about making a law prohibiting registered sex offenders to live in these communities?? I am in disbelief that I live in a gated community and register a sex offender ( who assaulted a minor!) just moved in. I reached out to the HOA and they said there is no regulation against that yet because of not enough votes from the community at last year‘s meeting. Why does something like that need community votes? This is common sense for God sake!

The body is literally made up of people who live in that community. As a resident of the neighborhood, you can run for office, and you can vote for rules you want to change. I happen to like a lot of the rules set by our HOA such as no parking your car in the street or in your lawn. Things like that look junky and may be better suited for other neighborhoods.

Our neighbors mom just passed. She lived in a ritzy neighborhood near Jacksonville FL
Her house was payed off and her HOA payment was $1300 a month.
Now our neighbors have to pay that until the house is sold.
