Yes yes yes, they can but they don't have to. Also 1/3 won't always be good for the orphan like if there is only one alive son of his grandfather, or the deceased children are more than alive children. Imagine if a grandfather doesn't write a will and the orphan grandchildren don't receive anything from the property, everything is done as per Sharia and nobody has sinned, but the orphans will suffer.
In muslims property distribution system is very faulty...I am the victim of father's negligence he sold all his father's and his own property and left me without anything which was my right he sold it all..I curse hum..and curse this faulty system..which says father can not give anything to his son till he is alive..as many father's take advantage of this system they sell their properties and diswn some sons at their will
If you are a father and don’t want to give ancestor property to your son’s then here is what you can do. Get a loan on that agriculture land from bank and cultivate some crops with some of that money. Make sure you go into some losses and then sell the land saying you are selling it to clear the bank loan debt. That’s it , son can’t do anything.😄😄 .This is the law , cases are won based on situations like above.🤦🏻
If grandfather didn't write anything about grandchildren in his wassiya , and now these grandchildren and their mother is coming and fighting with other sons and daughters and grandmother, what should these people do
For all the people having doubt and who are concerned. First of all, as Muslims we need to accept what Allah said. There is a test for all of us in everything that Allah says. Allah the greatest is the most merciful and does the best for us. The main point here is, the grandson will not het a share in inheritance if his father dies before his grandfather. But, since grandfather is alive, he has a choice to give 1/3 of his inheritance to the orphan grandson. In another case if grandfather and grandmother have expired before and then the father expired then automatically the share of fatehr comes to grandson. I have done considerable research on this and also consulted multiple lawyers. And what I have said is right. Rest Allah is the best planner 😊
My father passed away in 1998, March. I was in the womb, my parents got married in 1996. I was born after 5 months, in September. My father was a helpful person, He broke his life long fixed deposit and helped my granddad to buy a piece of land. My grand father passed away at February 2016. He didn’t leave any specific will. My grand dad has 6 children, 4 sons, 2 daughters. One son died before him( my father). What will happen to the land my father helped him to buy? Do I and my mother deserve a share of that land?
@@rifatkabirsamrat5237 Sorry for the loss. I am a normal person. I did research for my case. I suggest you consult more than one muslim lawyers. And also some imams from nearby masjids.

Exactly where do they go? What kind of law is this? I am suffering under same situation. Is all my fault tgat my father passed away sooner than his mother? Or that i was born muslim and that i have to follow sharia law
Obviously in that case girl's parents should take care of their daughter n grandchildren, sister I can understand your pain but meanwhile you should also trust and have faith in the will n wisdom of Allah.

There are 100 acre property in the name of Mr. X who was dead (without leaving any will) and has two sons namely M & N. Both the sons were married before 1980. Mr. M had a daughter and Mr. N had a son. Now Mr. M died before 1980 and his wife married to somebody else. The daughter of Mr. M went to her maternal uncles house and got married there. Mr. N sold 100 acres of property of his father Mr. X. in 1981 to A,B,C,D &E (Five Brothers of same village). Now the A,B,C,D, & E were in possession over the 100 acres since 1981 and made all documents in their name as per the sale deed of 1981 . In 2014 the daughter of Mr. M sold 50 acres of her share to Mr. F which was already sold in 1981 by Mr. N .Can she get her 50% share ???Can Mr. F became owner of 50% share????? Please reply
Mr Dr Zakir Naik this law does not hold good, at least, in Pakistan and Bangladesh. I think people of these two nations are more wise. Please update your information base.

Kanun nahi, jihalat hai. This used to be the custom of nomadic Arabs before Islam (Jahliyya) which was incorporated into Islamic/Quranic law.

The grand children of dead father wouldn't inherit but the living son will inherit and if they will die than they will inherit
If a children cannot marry with their Parents and no grandparents are mentioned but automatically grannies are linked with the section through the Parents
So they are like Parents so why can't they inherit>
