"Failed miserably" is not a negative or a positive. Based on what the question is and who is asked, can lead to the knowledge of or lack of, rolls played by individuals. It shows an avenue to go down that may very well lead to an intersect. This type of questioning is actually on the BAR exam.

I think Schiff did answer the question, I think Ratcliffe just didn't understand the answer. He made it short. He can make any challenges he wants, he's allowing a question despite facts not in evidence, not disallowing questions because of facts not in evidence. Objections on facts not in evidence will be most likely be heard. They may not be sustained, but they aren't being disallowed.
Counselling Taylor on the issue was quite the right thing to do after having him asked if "... some elements of the Ukrainian establishment ... were out to get him" after leading it with a mile long string words that included a few "facts not in evidence," theoretical adversarial elements and events, sheesh.
They may or may not exist, but they gotta actually appropriately introduce this stuff and not just try to sucker out some double edged responses on a complex situation.

@@stevenp25100 That's true, but in any similar scenario, a chairman of an inquiry, a judge in a court of law, or anyone in a comparable position of authority has comparable responsibility to the poor non-guilty fellow being grilled. It's pretty common, accepted and appreciated. Taylor's not a defendant, he's a witness. It might be different if he was being accused or something. You might even argue he's guilty of something - but then you're way out in left field because this is a hearing.
John Bellinger is Taylor's attorney, he may or may not have counselled him on the topic but the point stands that Schiff's interjection was not inappropriate.

The clash wasn't over facts not in evidence. The clash was over what rules the hearing is supposed to be operating under. Because Schiff outlined a very specific set of rules for these hearings that ignore all standard house rules and all normal rules of evidence. Yet in the middle of questioning he's suddenly interrupting testimony to direct a witness not to answer or at the very least be cautious about what answers to give to certain questions that may be considered improper questions under normal rules of evidence. You don't get to very intentionally suspend all normal rules of evidence to allow all the testimony you want as part of the record and then assert rules of evidence as justification for suggesting a witness shouldn't offer certain testimony.

Not really. That has to do more with rules, regulations, and precedents that are in place. The guy is an ambassador not a lawyer. He would have limited understanding if there would be any legal issues regarding these sorts of contacts. I'd be surprised if he did.

The comity herein these proceedings has all the underpinnings of agency, serving an administrative function, with that come the agency's duty to promulgate rules, if the rules exist only in the head and mind of the leading member and seem to constantly change then these proceedings are unconstitutional. There needs to be an emergency petition to the US Supreme court to determine this agency action in that all must be stricken and started anew with established rules......

Ok, it doesn't help that the counsel member asking the damn question sounds like he's gonna have a stroke. I don't like Schiff as well...however I believe he has a point in that the question being asked sounds like 3 different things in 1 and only 1/2 of what is being asked is about the core of the matter.
