  • In this video, we explore the often overlooked topic of loss of consortium claims in personal injury cases. When an individual is injured, the impact goes beyond the physical and emotional toll on the injured person; it also affects their loved ones. Loss of consortium refers to the deprivation of the benefits of a family relationship due to the injuries sustained by one of the family members.
We delve into the various aspects of loss of consortium claims, including the types of damages that may be sought, the eligibility of family members to file such claims, and the factors that influence the strength of these claims. Understanding loss of consortium is crucial for both plaintiffs and attorneys involved in personal injury cases, as it can significantly impact the compensation awarded to the injured party and their family.
If you or someone you know has been affected by a personal injury and are considering pursuing a loss of consortium claim, this video provides valuable insights that can help you navigate this often complex area of law. It also includes if your spouse is no longer up for affection...

Good content. I would imagine this includes sexual relations and ED problems following back injury in car accident.

You are correct. A healthy sex life is an important part of the martial relationship and should be included in a loss of consortium claim.

@@WILLIAMSELLEBY would ED from a car accident be considered a serious injury? Or a matter of fact to dispute and stop a summary judgement? Curious!🧐

If a medical doctor is able to say that the ED was most likely caused by the car crash (and not pre-existing or caused by anything else), most Courts will hold that it is a factual causation issue that must be decided by the jury (not the judge at the summary judgment stage). However, please note, that most states will require a medical provider to offer testimony linking the ED to the car crash in order for the claimant to avoid summary judgement. And, yes, ED is certainly a serious injury. It might not be on the same level of seriousness as paralysis or full body burns, but it can have a substantial negative impact on someone's (and their partner's) life.
